The Special Magistrate, having given the Respondent, Mr. Randy Simlar, an opportunity to be heard, including his counsel, Mike Ryan, and together with respondent's witness, Steve Dobbs, and the City of Okeechobee with testimony from Code Enforcement Officer Anthony Smith, finds as follows: Counsel for Fosler LLC, Mr. Mike Ryan, advised that Fosler bought the property 16 years ago, then it was acquired by Mr. Abuaita to increase the density with a plan of building apartments and affordable housing. When Mr. Abuaita bought the property, they did a title search and there was no issue and later combined the properties through a quit-claim-deed and did not bother to get another title search because they had not done any work on the property and no title policy was issued when they unity deed was done. The notice was sent to Mr. Abuaita about the fence and vegetation, but he had moved. The concierge signed the certified mail, but Mr. Simlar was not notified. When he found out he spoke with Steve Dobbs who called Mr. Smith and within two days the property was in compliance. Mr. Steve Dobbs testified that Mr. Simlar called him and gave him a fence company and met him at the property. He called Code Enforcement and spoke with Mr. Smith about the violation. He testified that in the past, the former Code Enforcement Officer Mr. Fred Sterling would call him if there were any problems with properties belonging to any of his clients. He has helped Mr. Simlar with other 1 properties in the past and stated that if Code Enforcement had called him, he would have helped brought it to the attention of his client. Mr. Simlar testified under oath that the violation and fines only became known to him on July 21, 2021, and that he took care of the violations the following day. He spent $1,300.00 to repair the fence. He explained that it was only recently that he became partners with Mr. Abuaita to develop the property. The property was transferred to the partnership (Fosler, LLC) via a quit-claim-deed and no title search was done prior to the transfer. It is a vacant property, and they are getting ready to build 92 apartments on it. He did not know why the mail was not forwarded to him by the concierge immediately. Mr. Smiler requests that his fines be reduced to zero amount. In response, Code Officer Anthony Smith reiterated all the efforts by Code Enforcement to bring the Respondent's property into compliance. Mr. Smith testified under oath that the violations were first brought to Mr. Abuaita's attention on September 26, 2019, when a courtesy card was provided. On January 29, 2020, a Statement of Violation and Notice of Hearing was received by a person who signed the receipt at the address. On May 5, 2020, another Statements of Violation and Notice of Hearing was sent certified mail and received by someone at the address. At the hearing on June 9t"° 2020, a fine of $50/day was imposed together with $50 administrative fees. The fines accrued beginning October 12, 2020. The property was still in non-compliance all this time. On October 22, 2020, the property was transferred to Fosler LLC, which is co-owned by Randy Simlar. Officer Smith inspected the properiy on June 25, 2021 and found it still in non-compliance. A 90-day letter was mailed to the respondents pertaining to the lien. On July 21, 2021, Officer Smith was able to meet with Mr. Smiler who addressed the violations. The property came into compliance on July 22, 2021. To accommodate the circumstances, Mr. Smith recommended that the accumulated fines of $13,950.00 be reduced by seventy-five percent (75%) together with applicable administrative fees. Having carefully considered the testimony of all witnesses and arguments of both parties, this Court also reviewed the records pertaining to this case and fnd that not only was the respondent properly served with written notice via two Statement of Violation and Notice of Hearing, which was mailed on January 29, 2020, and May 5, 2020, at the respondent's address and served upon and received by a person at the address. Therefore, this court finds that the Respondent, Mr. Abuaita, in this case had � sufficient notice regarding the Code violations in this matter. This court also finds that a copy of the lien order was sent certified mail to the respondent's address on June 22, 2020, and the property was properly posted with a lien order on September 29, 2020. This property was in non-compliance until Mr. Simlar addressed the violation on July 22, 2021, which is six-hundred-sixty-five (665) days after the violation was initially noted on September 26, 2019. Therefore, based on the foregoing findings of facts, this Court finds that a seventy-five percent (75%) reduction of the total fine of $13,950.00, plus administrative fees, under the facts and circumstances of this case is reasonable and fair, and that such reduction is in the best interest of the City of Okeechobee. The fine will be reduced to $3,487.50 plus the administrative fee of $50.00. The Respondent should arrange a payment plan to pay the reduced fines and fees within a reasonable time. Code Officer Smith testified that the properry is in violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for a strong urine smell coming from the fence line, overflowing dumpster, debris/garbage scattered throughout the neighborhood and a truck being parked in the right-of-way. The property is not a repeat violator. A Statement of Violation/Notice of Hearing (SOV/NOH) was mailed via United States Postal Service (USPS) certified return receipt on March 23, 2021, for the May 11, 2021 Hearing. Code Officer Smith testified that the properry is in violation of Code of Ordinances Chapter 30, Sections 30-41 Disabled vehicles, 30-44 General cleaning and beautification for untagged vehicles, the grass in need of being mowed and debris cleaned up. The property is not a repeat violator. A Courtesy Card was mailed via USPS regular mail on March 19, 2020. Tlie property was inspected and found to be non-compliant on June 15, 2020. A SOV/NOH was mailed via USPS certified return receipt on July 28, 2020, for the September 8, 2020 Hearing. The City has not received anything back as of the date of this Hearing. The property was inspected and found to be non-compliant on July 31, 2020. The property was posted with a Notice to Appear (NTA) on July 31, 2020, for the September 8, 2020 Hearing.
