IV. New Business.
A.
New American Physical Therapy. The application was submitted by Asmussen
Engineering, LLC on behalf of property owner Muhammad Nooruddin. The
property owner is proposing to develop a 9,960 square foot office/storage
building to be used for physical therapy, office and storage supply to be
constructed in a single phase. The subject property is located in City of
Okeechobee Lots 15 through 18, Block 15 North on State Route 15 to Northeast
12th Street, right, property is on the corner.

Site Plan Review Application for New American Physical Therapy was submitted by property owner
Muhammad Nooruddin. Property is located at North Parrott Avenue and Northeast 12th Street.
Legal description: Lots 15 through 18 of Block 15, City ofOkeechobee Subdivision. The property
owner is proposing to construct a two-story 9,960 square foot building to be used for a Physical
Therapy Office and supply storage in a single phase.
Ladaysha King, LaRue Planning, was present and reviewed the Planning Staff Report,
recommending denial of the site plan until the following conditions are satisfied:
1. The maximum height of the building cannot exceed 45 feet, the applicant must provide a
drawing of the structure which illustrates the building facades on all four sides and shows the
proposed height.
2. The Land Development Code requires medical offices within the CHV Zoning District to
provide 1 parking space per 180 square feet of floor area. The applicant is proposing to
construct a 9,960 square foot medical office which requires 55 parking spaces. The applicant
has only provided 32 spaces. The applicant should provide an additional 23 parking spaces.
3. The applicant should also provide 1 more tree and 3 more shrubs.
Mr. Loris Asmussen, Engineer, and Mark McCree, Architect, of the project, were present. Mr.
Asmussen stated that the landscaping will be no problem and the height will not exceed 45 feet.
There was a concern with the parking spaces. The applicant stated that since he has been issued a
"Professional" Occupational License, then his business should be considered as Professional which
requires parking spaces 1 per 300 feet of floor area rather than 1 per 180 square feet.
City Staff proceeded to explain, as listed under General Provisions in the City's Code Book Chapter
66-1 Definitions states: Office, Professional, means an establishment of an accountant, architect,
attorney, engineer, landscape architect, surveyor, urban planner, and similar nonmedical
professionals. Office, Medical means an establishment providing human out-patient services by
persons practicing health services, including acupuncturist, chiropodist, chiropractor, dentist,
optician, optometrist, osteopath, physical therapist, physician, or any such lawful profession, but
excludes masseur, in-patient hospital care and veterinarian. This definition establishes the applicant
to be considered as a Medical Office.

A.
New American Physical Therapy continued.
Mr. Nooruddin, explained that his business, Big Lake Home Health, will have an office on the
second floor of the building. Staff will consist of one receptionist, and one billing clerk, the rest
of the staff will not be at the site, but will go to the homes of the clients. The bottom floor will be
used for the Physical Therapy Center which will be opened Mondays, Wednesdays and Fridays
from 7:45 a.m. to 6:00 p.m. The Center will only be used on Tuesdays and Thursdays in case of
emergencies. There will not be an abundant overflow of parking needs as the clients are scheduled
by appointments which usually last for 45 minutes to an hour.

City Staff suggested since the building is being used as a mixed use then perhaps a 50/50 split of
parking would be more suitable and it will give the applicant a total of 40 spaces.
In conclusion, Planning Staff Recommendations: Should the 50/50 split be allowed, the
applicant would be required to have 28 parking spaces for the therapy center (9,960/2 =
4,980/180 = 27.67) and 17 spaces for the office uses (9,960/2 = 4,980/300 = 16.60). In total the
applicant should provide 45 spaces. Staff has suggested that the applicant submit a parking
analysis which would clarify the calculation of the required parking spaces as allowed by Section
90.482(6) which states: Parking spaces for two or more businesses may be combined, provided
that the total number of spaces shall not be less than the sum of required spaces computed
separately. Where it can be demonstrated that the need for parking from specific uses do not
overlap in time, the number of spaces may be reduced by the number required by the lesser use.

Thus, the number of spaces can be combined but two things would need to be demonstrated by the
parking analysis:
1. The use would have a demand less than the requirements of the Regulations; and
2. The hours of need for maximum parking for two or more uses do not overlap.
There was no official action taken on this item. Once the parking analysis is completed and
submitted to the General Services Department, the matter will come back to the Technical Review
Committee for final consideration.
Notation: Engineer Bermudez met with Mr. Nooruddin following the meeting. The proposed site
is being scaled back to accommodate for required parking spaces.

B. MD-13 Warehouses. The application was submitted by Asmussen Engineering, Site Plan Review Application for MD-13 Warehouses was submitted by Asmussen Engineering
LLC on behalf of property owner Roland Mossel. The property owner is on behalf of property owner Roland Mossel. Property is located at the corner of Northwest 6th
proposing to construct 13 warehouse units on 1.03 acres of Industrial Property Street and Northwest 7th Street; East ofrailroad. Legal description: Lots 1 to 6 of Block 70, City
with infrastructure, in a single phase. The subject property is located in the City of Okeechobee Subdivision. The property owner is proposing to construct a 13 unit warehouse on
of Okeechobee, Lots 1 to 6, Block 70, corner of Northwest 6th Street and 1.03 acres of Industrial Property with infrastructure, in a single phase.

Planning Consultant Ladaysha King reviewed the Planning Staff Report, the structure will be
approximately 17,492 square feet, and is being proposed to be sold as warehouse space with
possible office uses.
Planning Staff is recommending denial of the site plan until the following conditions are satisfied:
1. The maximum height of the building cannot exceed 45 feet, the applicant must provide a
drawing of the structure which illustrates the building facades on all four sides and shows
the proposed height.
2.
The Land Development Code requires warehouse buildings within the IND Zoning District
to provide 1 parking space per 1,000 square feet of floor area up to 20,000 square feet. The
applicant is proposing to construct a 17,492 square foot warehouse building which requires
18 parking spaces. The applicant has only provided 15 spaces. Staff would usually
recommend that the applicant provide an additional 3 parking spaces. However, the
applicant also is proposing to sell some of the units to be used as professional offices. The
Land Development Code requires 1 parking space per 300 square feet of office space floor
area. As such, the applicant may need to provide more parking spaces for the office use
as opposed to providing all parking corresponding to the warehouse use.
3. In addition, the rear setback (which has been interpreted to be the east side of the property)
is 12 feet, where the Code requires 20 feet.
Project Engineer Asmussen responded to the noted conditions, the 20-foot setback can be met. The
parking is still an issue since the proposed use is not determined whether it will be for warehouse
use or office space.

Staff has requested that the applicant resubmit drawings for the subject property noting the location
for the front of the building showing a setback of 25 feet and the two side fronts being 75 percent
of the 25 feet setback requirements. Also, the drawing must show parking requirements should it
be used for offices and the additional 3 spaces needed should it be used as warehouses.
There was no official action taken on this item. Once the information is resubmitted, as noted
above, to the General Services Department, it will then be reconsidered by the Technical Review
Committee.

Recommendation:
Staff recommended denial of the site plan review until the following conditions are
satisfied:
1. The maximum height of the building cannot exceed 45 feet, the applicant
must provide a drawing of the structure which illustrates the building facades
on all four sides and shows the proposed height.
2. The Land Development Code requires medical offices within the CHV
Zoning District to provide 1 parking space per 180 square feet of floor area.
The applicant is proposing to construct a 9,960 square foot medical office
which requires 55 parking spaces. The applicant has only provided 32
spaces. The applicant should provide an additional 23 parking spaces.
3. The applicant should also provide I more tree and 3 more shrubs.
TRC Conclusion:
To address the items above, at the August 23, 2006 TRC meeting the applicant
stated that the building height for the proposed building would not exceed 35 feet.
In addition, the applicant agreed to meet the landscaping requirement by adding 1
tree and 3 shrubs to the proposed landscaping plan. As such, items (1) and (3) have
been adequately addressed by the applicant.
In regards to item (2), the applicant suggested that only the 1 st floor of the proposed
building will be used for the therapy center and professional office uses are being
proposed for the 2nd floor. As a result, the TRC members suggested a 50/50 split of
parking which give the applicant a total of 40 spaces.
Staff Recommendations: If the 50/50 split is allowed, then the applicant would be
required to have 28 parking spaces for the therapy center (9,960/2 = 4,980/180 =
27.67) and 17 spaces for the office uses (9,960/2 = 4,980/300 = 16.60). In total the
applicant should provide 45 spaces. Staff has suggested that the applicant submit a
parking analysis which would clarify the calculation of the required parking spaces
as allowed by Section 90.482(6) which states:

Parking spaces for two or more businesses may be combined, provided that the
total number of spaces shall not be less than the sum of required spaces
computed separately. Where it can be demonstrated that the need for parking
from specific uses do not overlap in time, the number of spaces may be reduced
by the number required by the lesser use.
Thus, the number of spaces can be combined but two things would need to be
demonstrated by the parking analysis:
1. The use would have a demand less than the requirements of the Regulations;
and
2. The hours of need for maximum parking for two or more uses do not overlap.

the applicant provide an additional 3 parking spaces. However, the applicant
also is proposing to sell some of the units to be used as professional offices.
The Land Development Code requires 1 parking space per 300 square feet of
office space floor area. As such, the applicant may need to provide more
parking spaces for the office use as opposed to providing all parking
corresponding to the warehouse use.
