A.
Firestone All American Tire & Service. The Application was submitted by
Ricky Farrell, Trustee on behalf of property owner Park Tire Land Revocable
Trust. The property owner is proposing to open a Tire Store with associated
open shop/garage in a single phase. The subject property is located at 415 NE
Park Street.
Site Plan Review Application for Firestone All American Tire & Service was submitted by Ricky
Farrel on behalf of property owner Park Tire Land Revocable Trust. Property is located at 415 NE
Park Street, Lot 10, less the South 15 feet of the West 8.83 feet thereof, and Lots 11 and 12 and the
South one-half of the alley adjoining said lots, Block 151 City of Okeechobee. The property owner
is proposing to open a Tire Store with associated open shop/garage in a single phase.
Planning Staff Report Discussion: This is a site plan review for an automotive service and repair
shop. In April 2006, the applicant applied for and was granted a Special Exception (Petition No. 06-
005-SE) contingent upon: (1) Parking to be provided, (2) No body work or heavy engine repair,
and (3) Landscaping to be included as a part of the Site Plan for this Special Exception.
At the time, Planning Staff stated that it was important to have defined ingress/egress and parking
delineated for customers and employees. It appears that the existing building was enclosed since it
was established as a car dealership, limiting parking in the front. Lack of parking and access must
be improved to service the public properly. Additionally, since this is a use within an existing
building buffering may be limited, but landscaping would lessen the impact and should be provided.
Planning Staff Report Recommendation:
1. The applicant has exceeded the maximum amount of impervious surface coverage by 4.6
percent. This should be corrected.
2. The applicant has not complied with the conditions set forth in the approved Special
Exception Petition and does not meed Code requirements. The site is required to have
approximately 54 parking spaces, but has only provided 20 spaces. This should be corrected
and the applicant should not be allowed to separate the usage of the building into net usable
and non-usable floor space to calculate parking. This privilege is strictly reserved for
government office, courthouses, and other public facilities. Additionally, 10 parking spaces
back out onto Northeast 5th A venue.

Again, the applicant has not complied with conditions set forth in the Special Exception.
This site was granted the special exception based on adequate landscaping being provided.
The applicant has only provided three trees instead of the 14 required by the Code. The
applicant must provide a landscaping plan which is consistent with Sections 90-534 and
90-535 of the Land Development Code.
4. The applicant must provide a drawing of the structure which illustrates the building facades
on all four sides and shows the proposed height.
S. The setback and buffer requirements are not being met.
Loris Asmussen for Asmussen Engineering presented revised plans for Firestone All American
Tire & Service. Building Official Forbes and Fire Chief Smith stated they did not have any
comments or issues. Engineer Bermudez advised of parking issues, 54 spaces are required the
documents indicate only 32 are provided for.
Mr. LaRue added further planning issues regardIng the revised plans in that the maximum
impervious surface ratio is 90 percent, and asked whether there was any way to reduce it to 85
percent? Mr. Asmussen replied, in the effort to provide enough parking, additional pervious surface
is unpredictable. Mr. LaRue responded that, 20 parking spaces, plus the eight for backing-out is
all he sees. The landscaping requirements are not noted on the new plans.
It was stated that the previous business, Radio Shack, only had 20 parking spaces, and that the new
business could make the same number work for their business. However, that is not an issue to be
resolved since the Code Book clearly states that when a business changes owners or use, the
existing must comply with current regulations. Mr. Tom Elmore, the previous owner of the
property, explained how he was able to operate the previous business at the location, with only the
limited parking and using Northeast 5th A venue to back -out on. Various City Staff members again
explained that when businesses change ownership or use, the site must be brought up to meet
current regulations and that where the City can compromise they work with the owner.
Attorney Cook suggested that a parking agreement could be worked out so that the garage area,
where they change tires and the customers are not allowed to enter, could be taken out of the total
parking formula.

Mr. Dudley, the current owner stated that he has a similar store in Port St. Lucie, and gave what
the parking regulations are there. Shared parking has been discussed with McDonald's who owns
the parking lot behind this building. Mr. Elmore said that he never anticipated there would be a
parking proble, there was never an automobile accident associated with the parking or backing-out
on Northeast 5th A venue. He also noted that 14 trees in a parking lot is ridiculous. Mr. Dudley
added that should a buffer be needed he will provide it.
Attorney Cook explained that the building has not been in operation for some time and needs to
be brought up to current code. Mr. Elmore interjected that it was in operation six months ago as
a Radio Shack, he said that he cannot understand how this building worked with its existing
parking for the last 38 years, why now does it have to have so many added parking places?
Attorney Cook replied that the City would like to cooperate with the new owner, however, we
cannot ignore the current codes for parking or landscaping.
Administrator Whitehall suggested the use of the alleyway. Mr. Elmore added that the alleyway
is 15 feet wide, plenty enough to turn a car around, could remove the fence that exists if needed.
Discussion continued regarding the site being brought up to current codes. The TRC does not have
the prerogative to change the codes, only the City Council. Administrator Whitehall stated that
while he would much rather see a business than an empty building, and have the tax revenue from
the business, the TRC cannot contradict the code.
Attorney Cook asked whether there were any issues other than parking. Mr. LaRue answered only
the pervious area percentage and landscaping.
Building Official Forbes stated that what is needed is a redevelopment area and codes for the
downtown area that has existing buildings that cannot meet current code.

finding under Section 90-483 paragraph 2, where City Council can waive parking requirements
when a parking study is presented indicating that an increase or decrease in the number of parking
spaces may be warranted and that the applicant will gather together documentation supporting a
lesser number of required parking spaces and set the matter on the City Council Agenda; seconded
by Building Official Forbes.

Discussion:
This is a site plan review for an automotive service and repair shop. In April 2006, the
applicant applied for and was granted a Special Exception (Petition No. 06-005-SE)
contingent upon:
1. Parking to be provided.
2. No body work or heavy engine repair.
3. Landscaping to be included as a part of the Site Plan for this Special
Exception.
At that time, Staff stated that it was important to have defined ingress/egress and parking
delineated for customers and employees. It appears that the existing building was enclosed
since it was established as a car dealership, limiting parking in the front. Lack of parking
and access must be improved to service the public properly. Additionally, since this is a use
within an existing building buffering may be limited, but landscaping would lessen the
impact and should be provided. .

Recommendation:
Staff recommends denial of the site plan review for the following reasons:
1. The applicant has exceeded the maximum amount of impervious surface
coverage by 4.6%. This should be corrected.
2. The applicant has not complied with the conditions set forth in the Special
Exception Request and does not meet Code requirements. The site is
required to have approximately 54 parking spaces but has only provided 20
spaces. This should be corrected and the applicant should not be allowed to
separate the usage of the building into net usable and non-usable floor space
to calculate parking. This privilege is strictly reserved for government
offices, courthouses, and other public facilities. Additionally, 10 parking
spaces back out onto NE 5th Avenue.
3. Again, the applicant has not complied with the conditions set forth in the
Special Exception Request. This site was granted the special exception based
on adequate landscaping being provided. As can be seen above, the applicant
has only provided 3 trees instead of the 14 required by the Code. The

-Dust Control
DESCRIPTION
Dust controls reduce the surface and air transport of
dust, thereby preventing pollutants from infiltrating
into storm water. Control measures are often
instituted in industrial areas or in areas where land
is being disturbed.
Dust control for industrial actiVIties normally
involves mechanical systems designed to reduce
dust emissions from in-plant processing activities
and/or materials handling. These may include
hoods, cyclone collectors, bag-type collectors,
filters, negative pressure systems, or mechanical
sweepers.
Dust control measures for construction activities
include windbreaks, minimization of soil
disturbance, spray-on adhesives, tillage, chemical
treatment, and water spraying.
While there are a number of temporary alternatives
for dust control, one option is to permanently
modify the site to eliminate dust generation.
Modifications could include such measures as
covering exposed areas with vegetation, stone, or
concrete.
APPLICABILITY
Dust control measures may be applied to any site.
However, application of dust controls is especially
critical in arid areas, where exposed soil is more
likely to be transported into receiving water bodies
through runoff or wind action. Dust control
measures should also be applied to any industrial
activity that generates large quantities of dust,
particularly if this dust could be transported to a
nearby water body.
ADVANTAGES AND DISADVANTAGES
There are several advantages to using dust control
measures.
.
Dust control reduces the surface and air
transport of dust, which minimizes
pollutants from infiltrating into the storm
water.
Dust control methods are widely applicable.
Most dust control methods are inexpensive,
non-intrusive, and promote natural growth.
.
The majority of dust control methods are
easy to install and maintain.
Some disadvantages to dust control may include the
following.
· Some temporary dust controls must be
reapplied or replenished on a regular basis.
Some controls are expensive (e.g., chemical
treatment), may be ineffective under certain
conditions or have their own associated
impacts.
.
Industrial dust control is typically labor and
equipment intensive (i.e., using
conventional street sweepers), and may not
be effective for all sources of pollution.
· Some dust control measures (i.e.,
windbreaks) may require land space that is
not be available at all locations.
· Ifa chemical dust control treatment is over-
applied, excess chemicals could potentially
cause both surface and groundwater
contamination.
PERFORMANCE
In order to determine which dust control measures
to implement at a specific site, it is necessary to
consider the performance obj ectives required at that
site. Some examples of performance objectives
include:
.
Preventing wind and water-based erosion of
disturbed areas.
.
Reducing employee respiratory problems.
Implementing the control rapidly and at low
cost and effort.
Causing little or no impact on the
environment.
Permanently controlling the dust problem.
Determination of the objectives for the dust control
program will often determine the appropriate
control measure. For example, simply sweeping
the impervious areas for larger dust particles on a
daily basis may provide an efficient and reliable
method of dust control that can be quickly
implemented. However, this method would not
permanently control the dust problem. If the
objective was to permanently control the dust
problem, then another alternative, such as
constructing vegetative windbreaks, would be more
appropriate.
DESIGN CRITERIA
The design of any dust control project should limit
the amount of soil or dust particulates exposed at
one time, and reduce the potential for dust
generation. The performance objectives established
for the particular project should also be considered
during the design stage. Additionally, some project
sites may require solutions to both industrial and
land disturbance dust control problems.
Realistically, it may not be practical or possible to
develop a design that meets all of the project goals
and objectives at one time. Therefore it may be
more appropriate to develop a phased design
approach that utilizes a combination of temporary,
permanent, and mechanical measures for dust
control.
Temporary Measures
· Vegetative Coverings: Temporary seeding
and mulching may be applied to cover bare
soil and to prevent wind erosion. The soil
must be kept moist to establish cover.
Barriers: Solid board fences, snow fences,
burlap fences, crate walls, bales of hay, and
similar material can be used to control air
currents and blown soil. Barriers placed at
right angles to prevailing wind currents at
intervals of about 15 times the barrier
height are effective in controlling wind
eroSIOn.
Calcium Chloride: This material is applied
at a rate that will keep the surface moist.
Pretreatment may be necessary due to
varying site and climatic conditions.

Irrigation: This is generally done as an
emergency treatment. The site is sprinkled
with water until the surface is wet and
repeated as necessary. If this method is to
be employed at a construction site, it is
recommended that a temporary gravel rock
entrance be created to prevent mud from
spreading onto local streets.
Tillage: This practice roughens the soil and
brings clods to the surface. It is an
emergency measure that should be used
before wind erosion starts. Plowing should
begin on the windward side of the site using
chisel-type plows spaced about 12 inches
apart, spring-tooth harrows, or similar
plows.

Adhesives: Use spray-on adhesives
according to Table 1. These adhesives form
fairly impenetrable surfaces, and should be
used only if other methods prove to be
difficult to work with.

Permanent Site Modification Measures
Permanent Vegetation: Seeding and
sodding should be done to permanently
stabilize exposed areas against wind
erosion. It is recommended that existing
trees and large shrubs be allowed to remain
in place to the greatest extent possible
during site grading processes.
· Stone: Coarse gravel or crushed stone may
be placed over highly erodible soils.
· Topsoiling: This method is recommended
when permanent vegetation cannot be
established on a site. Topsoiling is a
process in which less erosive soil material is
placed on top of highly erodible soils.
Dust Collection Methods
· Cyclone Collectors: Cyclone collectors use
centrifugal force to separate dry dust and
chemical pollutants in the air.
Bag Collectors/Fabric Filters: Bag
collectors and fabric filters remove dust by
filtration. Storage and disposal of collected
dust should be carefully considered so that
it does not become a source of fugitive dust.
Negative Pressure Systems: These systems
minimize the release of dust from an
operation by maintaining a small negative
pressure or suction to confme the dust to a
particular operation.
.
Water Spraying: This temporary
mechanical method confines and settles the
dust from the air by dust and water particle
adhesion. Water is sprayed through nozzles
over the problem area.
Street Sweepers: Recent studies have shown
that street sweepers effectively remove the
smallest dust particles and achieve
meaningful runoff quality benefits. Two
kinds of street sweepers are common in
mechanical dust collection systems. The
brush system has proven to be efficient at
an industrial facility generating dust on a
daily basis. It has proven to be extremely
dependable and picks up the majority of
generated dust. Vacuum sweepers may be
the best choice for areas that are prone to
storm water overflow. This is because they
are more efficient at picking up the smaller
particles that are typically associated with
contaminated storm water. Other
technologies include the tandem sweeping
operation, the regenerative air sweeper, and
the "EnviroWhirl." The tandem operation
involves two successive cleaning passes,
first by a mechanical sweeper and then
followed by a vacuum assisted sweeper.
The regenerative air sweeper blows air onto
the pavement and immediately vacuums it
up. The "EnviroWhirl" is a vacuum-
assisted dry sweeper. It is able to remove
debris and dust down to 2.5 microns.
Independent studies conducted in Oregon
and Washington report that the Enviro Whirl
sweeper alone was able to remove 99.6
percent of all particulates over 10 microns.
A series of once-a-week sweepings resulted
in a 76 percent reduction of suspended
solids in downstream receiving waters.
OPERATION AND MAINTENANCE
Typically, dust control measures require periodic
and diligent maintenance. For example, mechanical
equipment should be operated according to the
manufacturers' recommendations and inspected
regularly as part of an industrial site's preventive
maintenance program. Temporary dust control
measures, such as chemical spraying~ waterhlg, etc.,
require periodic renewal. Permanent solutions
such as vegetation, wind barriers, and impervious
surfaces, also require upkeep and maintenance in
order to remain effective.
COSTS
The costs associated with dust control measures are
generally lower for more temporary methods such
as vegetative and barrier methods. This is
attributed to the availability of the materials and
the common practices associated with them. Other
dust control methods, such as using street sweepers,
cost considerably more because ofthe investment in
specialized equipment. For example, a mechanical
brush sweeper can range from $60,000 to $120,000
and will last for about five years while vacuum-
assisted sweepers can range from $75,000 to
$180,000 and have a life of eight years. The City of
Lakeland (Florida) has determined their costs to be
$33.38 per curb-mile of street sweeping. This cost
includes equipment costs (for a vacuum assisted
street sweeper), maintenance costs (i.e., fuel), the
employee's salary (not including benefits), and
transferring the collected debris to a landfill. The
City of Lakeland also has an arrangement whereby
they are not charged for sending the sweeping
debris to a landfill because it is then used as ground
cover for the landfill.

Enclosed is our site plan submittal for the above-referenced commercial property located
at the northwest corner of State Road 70 and Northeast 5th Avenue. The owner purchased
this property and proposes to utilize it as a tire and service facility. As you are aware, the
site was originally developed in 1973. The building and associated facilities remain, as
shown on the enclosed survey (Expedition Surveying & Mapping, Inc.).
Due to the high percentage of imperious area that presently exists, we are unable to
provide the parking spaces required per the intended use (refer to the enclosed Parking
Smnmary). The owner has committed to providing as much parking as physically
possible for the site. We recommended to the owner that he contact McDonalds to
investigate the possibility of shared or leased parking. Due to the liability associated with
shared parking, McDonalds may decline to entertain any shared or leased parking
proposal. Additional water storage and water quality treatment (water management)
cannot be provided over what already exists due to limited pervious area availability.
Landscaping is proposed over the green space that does exist (refer to Site Plan).
We have looked at various alternatives and provide herein the most feasible layout for
this existing developed site. The owner has indicated that the parking space requirements
(per LDRs) are in excess of what he anticipates will be needed for his business. Please
review the enclosed site plan and offer any suggestions that will allow this use to proceed.
In summary, we have concluded that the use of the building (as a business) is preferable
to the building remaining unoccupied. Please contact our office at (863) 763-8546 with
