Brian Whitehall, City Administrator, called the January 25, 2006 Technical Review Committee meeting to order at 10: 10 a.m. II. Chairperson and Stafr Attendance - Chairperson. . A. G4 Office Park I. Bradley Goodbread submitted a reduction of parking request Jim LaRue, City Planning Consultant, briefly described the Staff Memo as follows: for property owner, Southern Construction Development, Inc. The subject property is located at 200 Southwest 3rd Street. This item was previously Planning Staff Memo: At the December TRC meeting, the applicant was asked to submit a site plan considered at the December 21,2005 Technical Review Committee Meeting. which depicts the amount of on-site parking spaces in order for staff to make an educated recommendation for the applicant's request. After reviewing the revised site plan, staff has determined that the applicant has approximately 10 spaces on-site and several on-street parking spaces are available to accommodate parking in the area. The City Engineer should verify that the existing spaces conform to City requirements. Only then can a parking reduction of 20% be recommended for this site. Chairperson Whitehall requested comments from each of the Committee Members. . . Oscar Bermudez, City Engineer, explained that under the Land Development Regulation's it clearly states that new owners must bring non-conforming property up to code as much as possible. He suggested that the two parking spaces located along the side of the building be moved due to safety concerns. Herb Smith, Fire Chief, explained that the he had concerns with the two parking spaces as well. He stated that the parking space closest to the building could be dangerous if there was a fire. He recommended moving both parking spaces so that fire safety equipment could gain access to the rear of the building in a safe manner. There were no comments from John Hayford, Okeechobee Utility Authority, or Donnie Robertson, Public Works Director. Steve Dobbs, Project Engineer, explained that there is a two way drive on the East side of the building; however, there is not access on the North side of the building to gain access to the rear of the building. Brad Goodbread, Property Owner, stated that the entire building needed thirteen (13) parking spaces. He explained that he currently has ten (10) parking spaces on-site and five (5) parking spaces available on-street. Brian Whitehall, City Administrator, explained that Mr. Goodbread had to provide 13 off-street parking spaces. He stated that the City considers a parking reduction based on whether there is on- street parking available. Two spaces are in a bad location and the City is recommending that they be moved to the rear of the building. Mr. Whitehall explained that the City requires all parking areas be improved but is trying to work with Mr. Goodbread to get this situation resolved. Mr. Whitehall questioned whether the septic field encroached on the vacant grassy area. Mr. Goodbread responded no, the septic tank and drain field were both located within the fenced area. Brian Whitehall, City Administrator, explained that there was plenty of room to create the needed parking lot in the vacant grassy area. He also reiterated that the two unsafe parking spaces should be moved to the rear of the building. . Brad Goodbread, Property Owner, stated that pouring concrete to create a parking lot costs a lot of money and he doesn't want to spend the money for the improvements if a parking reduction could be granted. Oscar Bermudez, City Engineer, explained to Mr. Goodbread that the City has been very lenient with him. He stated that the City had strict codes regarding new property owners bringing the non- conforming properties up to code. He continued by explaining that the City has not required Mr. Goodbread to address drainage requirements for the property. Brian Whitehall, City Administrator, explained that he recommended that Mr. Goodbread improve the area where the two parking spaces will be moved to; however, it would be okay to leave the area between the existing and new improvements to be pervious surface. There was no further discussion from the Committee, nor any further comments from the Project Engineer or Applicant. . Herb Smith motioned to recommend that the City Council approve a twenty percent reduction in parking for the G4 Office Park I Project based on the following: (1) applicant being required to move the two unsafe parking spaces to the Southeast corner of the property (2) applicant being required to ensure that the parking spaces to be constructed to meet City Regulations; seconded by Oscar Bermudez. The application was submitted by Steve Dobbs on behalf of Jim LaRue, City Planning Consultant, briefly described the Staff Memo as follows: the property owner, Gagbee, Inc. The property owner is proposing to construct a 32 unit condominium complex and parking lot in a single phase. The subject Planning Staff Report Discussion: The applicant is requesting a site plan review for a 32-unit property is located East of North Parrott A venue between Northeast 10th Street multi-family complex with parking. and Northeast 11th Street. . Planning Staff Report Recommendation: Staff does not recommend for approval of the site plan until the following conditions are met and the applicant has provided the required information: (1) In order to meet the minimum lot area and get the full use of 32 dwelling units, the alleyway must be vacated to be included in the acreage. The applicant must request and receive approval from the City Council for vacation of the alley. (2) Building elevation and height must be demonstrated on a separate drawing which also shows each building's fa9ade on all sides. (3) The agent for the applicant (Steve Dobbs) stated in a phone conversation that he believes the units will be two- bedroom, two-bathroom units. If so, parking is well over the required amount of 64 spaces. However, if the units are 3 or 4 bedrooms, the parking will be insufficient. The applicant must provide the size of the units to determine whether or not parking can be met for the site. (4) A landscaping plan must be submitted in accordance with Section 90-532 of the Code. (5) It should be verified that 1 dumpster will be enough for the 32 units. . Oscar Bermudez, City Engineer, explained that he had the following concerns with the project: (1) Entire alleyway must be abandoned for the project to be approved. (2) Sidewalk must be installed along Northeast 12th Street. (3) Culverts must be installed along Northeast 11 th Street and Northeast 12th Street to direct water flow towards Taylor Creek. (4) Clarify amount of bedrooms in each unit. (5) Receive approval from South Florida Water Management District regarding the wetlands on this property. Steve Dobbs, Project Engineer, explained that Mr. Goodbread is currently working on getting the alleyway abandoned; however, he is having difficulty contacting the adjacent property owner within the block to obtain his permission for the abandonment. He also explained that Mr. Goodbread confirmed that the units will be two bedroom and two bathroom. Mr. Dobbs explained that he has been in contact with South Florida Water Management District regarding the wetlands and development of this property. SFWMD is requesting approval from the City that the property owner will be able to reshape the ditches along Northeast 11th and 12th Streets to maximize drainage. Mr. Dobbs explained that he felt the wetlands on this property had already been impacted by the roadway improvements and the development of the existing house on the block. Mr. Dobbs stated that the Property Owner's intent was to fill in the smaller wetland and to maintain the wetlands West of this site. Mr. Dobbs confirmed that the building elevations, landscaping plan, and Waste Management confirmation regarding the dumpster size would be submitted at a later date as they were currently unavailable. Mr. Dobbs explained that the proposed project will be an apartment complex with one owner, and no homeowners association. He stated that the wastewater system would remain private. Herb Smith, Fire Chief, explained that he was concerned with the hydrant location. He stated that Fire Lanes would need to be marked once the parking lot is paved. Mr. Smith explained that once the Fire Lanes were completed, they would be strictly enforced. He also explained that water lines would need to be installed and fire hydrants would need to be operating prior to the beginning of construction. John Hayford, Okeechobee Utility Authority, explained that if the alleyway was vacated an easement would need to be provided to access the water lines. Mr. Hayford stated that usually dead-end lines are not accepted by the OUA; however, due to the need for a fire hydrant in that area the dead-end line would be acceptable. Mr. Hayford had the following concerns related to the proposed water system: (1) The system needs to be looped from Northeast 12th Street West to the eastern property line, then South to Northeast 11th Street, then back to the West to the 16" water main. (2) The water meters will need to be placed out at the right-of-way line as opposed to internally within the property. (3) Fire hydrants need to be located as directed by the Fire Chief.( 4) Add in-line valves as required with the new route. He had the following concerns related to the wastewater system: (1) Flip system as to put pump station on the east end of property, this will move the force main away from the 16" watermain in the alley. (2) Raise the manholes to prevent surface run-off from entering the manhole. (3) Raise the pump station (++ 1 foot) above grade and ensure it will be above the 100-foot flood elevation. (4) Is this system to be privately owned or owned by the OUA after it is completed. Donnie Robertson, Public Works Director, explained that Northeast 3rd Avenue is not developed to the East of the property. Mr. Robertson stated that all the water from this property flows down Northeast 10th Street and Northeast 11 th Street to the East across private property. Utah Apartments, continued. he wanted approval from South Florida Water Management District allowing the water to cross private property prior to draining into Taylor Creek. Steve Dobbs, Project Engineer, explained that historically the subject property has drained into the wetlands. . Oscar Bermudez, City Engineer, stated that it was his understanding that all water and wastewater within the City must belong to the Okeechobee Utility Authority and recommended that the property owner check with Attorney Cook regarding the proposal. John Hayford, Okeechobee Utility Authority, explained that as long as the pump station and collection system is on private property, it could remain private; however, where the forcemain leaves private property it becomes the property of the Okeechobee Utility Authority. He explained that if the wastewater system was private, the owner will be required to post a sign on the property listing the name of the company to contact in case of an emergency related to the private pump station and lift station. Mr. Hayford explained that if the Property Owners constructed the wastewater system to the OUA standards, OUA would accept it from them and own, operate, and maintain it in the future. Oscar Bermudez, City Engineer, questioned who certified the lift station. . John Hayford, Okeechobee Utility Authority, responded that Department of Environmental Protection certified the lift station. Steve Dobbs, Project Engineer, explained that the property owners would be required to obtain a permit from the Department of Environmental Protection for the wastewater system. Brian Whitehall, City Administrator, explained that if the wastewater system was to remain private it would be the responsibility of the property owner, not the City. John Hayford, Okeechobee Utility Authority, noted for the record that there was not a local company that repairs or maintains private wastewater systems.
