Technical Review Committee Meeting - Chairperson. John Cook, City Attorney, called the September 28,2005 Technical Review Committee meeting to order at 10:00 a.m. II. Chairperson and Staff Attendance - Chairperson. Each member stated their name and the organization that they are representing for the record. The application was submitted by Jeff Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows: Kennedy on behalf of the applicant, Heath Lawrence. The property owner is 4L Holdings, LLC. The property owner is proposing to construct a 6600 square Planning Staff Report Discussion: This is a site plan review for a proposed 6,600 square foot foot office building and parking lot in a single phase. The subject property is office building with 22 parking spaces. located in the 900 Block of Northwest 2nd Street. Planning Staff Report Recommendation: Staff recommends approval of the site plan when the following conditions are met: (1) The applicant must provide a minimum of 10 feet between the proposed building and the parking lot. Planning Staff Report Recommendation, continued: landscape buffer along NW 2nd Street. (3) Each parking space needs to have a car wheel stop. (4) Building elevations need to be provided in order to demonstrate height consistency. (5) The dumpster should be on the applicant's property rather on the alley right-of-way. Jeff Kennedy, Project Engineer, distributed revised plans to the Technical Review Committee. . Jim LaRue, City Planning Consultant, eXplained that he spoke with Jeff Kennedy after the Staff Report was prepared. He explained that item number one was no longer an issue, and that all of the other items have been taken care of. Oscar Bermudez, City Engineer, explained that a sidewalk will be required along Northwest 2nd Street. Jeff Kennedy explained that it was noted on the plans, however it was not labeled very well. Brian Whitehall, City Administrator, questioned Oscar whether issue regarding the distance between the parking spaces and the Right-of-Way was resolved. Oscar Bermudez. City Engineer, responded that yes, the revised plans addressed that issue. . There were no comments from Eddie Trent, Okeechobee County Health Department; LC Fortner, Okeechobee Utility Authority; Denny Davis, Police Chief; Donnie Robertson, Public Works Director; Herb Smith, Fire Chief; or Tom Forbes, Building Official. There were no further comments from the Committee, nor any public comment. Oscar Bermudez motioned to approve the Health Lawrence Office Building; seconded by Denny Davis. IV. The application was submitted by Jeff Kennedy on behalf Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows: of the applicant, Judy Kasten. The property owner is AZBLUE, LLC. The property owner is proposing to construct a 12 unit condo project with a parking Planning Staff Report Discussion: This is a site plan review for development of a twelve (12)- lot in a single phase. The subject property is located in the 100 Block of unit condominium with thirty-two (32) parking spaces. Southeast 8th A venue. Planning Staff Report Recommendation: Staff does not recommend approval of the site plan review until the following comments are addressed: (1) The side setbacks are required to be 20 feet, the applicant has only provided 10 feet. The plans need to be revised to be in compliance with the Code. (2) The applicant must provide drawings that demonstrate the buildings height and façades on all sides. (3) Only 8 parking spaces can be seen on the site plan, The Code requires the applicant to provide at least 24 spaces for the 12 dwelling units. The applicant has stated that the units have garages that can accommodate 2 cars, but this needs to be substantiated by drawings of the structures. (4) The size requirement of 9 x 20 for parking spaces is not being met at this time. . The 8 spaces that the applicant shows are only 9 x 18, This needs to be revised to be in compliance with the Code. (5) The plans submitted by the applicant shows trees in the same place as buildings. It appears that the site plan was drawn over the boundary survey. In any event, the site plan needs to show that these trees will be removed. Jeff Kennedy, Project Engineer, distributed revised plans to the Technical Review Committee. He explained that he revised the locations and angles of the buildings to meet the twenty foot side setbacks and the 9 x 20 parking space size requirements. He explained that each unit has a one car garage with a 12 x 20 parking space in front of the garage door. He stated that there are thirty-two total spaces on the site. He explained that all existing trees will be removed unless they are marked to be saved. IV. New Business, continued. B. Judy Kasten Condos, continued. Jim LaRue, City Planning Consultant, questioned whether the cypress tree would be saved? Jeff Kennedy stated that he was unsure. Oscar Bermudez, City Engineer, explained that any sidewalk damage that is done during the construction of the project must be repaired and/or replaced. . Herb Smith, Fire Chief, questioned the height ofthe proposed condo's and whether they would all be under one roof. He also questioned the type of fencing that will be utilized. Jeff Kennedy stated that they would be two stories, approximately twenty five feet. He continued by stating that they will all be under one roof, but will have a two hour fire wall between each unit. Jeff Kennedy explaining that he was unaware of the exact type of fencing that was proposed, however, Judy Kasten was in attendance and would be able to answer that question. Judy Kasten, property owner, explained that there would be a gated entry with a fence surrounding the entire property. Herb Smith, Fire Chief, explained that the gated entry had to be conducive to the fire trucks. He continued by explained that it was important to be able to get the trucks into the property quickly . in case of a fire, as well as be able to get the trucks out quickly in case they are faced with a dangerous situation. Judy Kasten, property owner, explained that she wanted the property to be safe, and stated that she would do what needed to be done to do so. Jeff Kennedy, Project Engineer, explained that there will be a median located in the entry. Herb Smith, Fire Chief, explained that the medians may cause a problem because twelve feet is a tight fit for the trucks. Jeff Kennedy, Project Engineer, explained that he could widen the radius of the entry, and that would increase the width. --~--- SEPTEMBER 2005 - TECHNICAL REVIEW IV. New Business, continued. B. Judy Kasten Condos, continued. Herb Smith, Fire Chief, explained that he would need access through the gate at all times. He requested that the applicant mark areas in the parking lot as a fire lane. He informed the applicant that the fire lanes will be enforced. Tom Forbes, Building Official, explained that he had some flood zone concerns. He explained that the base flood elevation for the property will need to be noted on the plans. He continued by stating that the applicant must meet the Fair Housing Act Requirements. He questioned whether . the proposed units were going to be condos (own the unit only), or townhomes (own the unit and the land under it). He also explained that the architect will have to note the handicap accessibility on the plans. Jeff Kennedy, Project Engineer, explained that the units were going to be condos. Brian Whitehall, City Administrator, explained that the sidewalk must be repaired if damaged during construction, He also questioned whether the entrance to the property would be aligned with the entrance to the shopping center across the street. Jeff Kennedy, Project Engineer, explained that the entrance was placed in the best spot on the property, and that he was unsure if it was aligned with the shopping center's entrance. LC Fortner, Okeechobee Utility Authority, explained that the sewer capacity is limited and will . require a developers agreement. He stated that water service is available on the property. There were no comments from Denny Davis, Police Chief; Donnie Robertson, Public Works Director; or Eddie Trent, Okeechobee Utility Authority. There were no further comments from the Committee, nor any public comment. Denny Davis motioned to recommend approval of the Judy Kasten Condo's Site Plan with the following stipulations: 1. The applicant and/or contractor must work with Herb Smith, Fire Chief, during the layout phase of the entrance to the project and must note fire lanes on the site plan. The application was submitted by Ted Kelchner on behalf of the Jim LaRue, City Planning Consulant, briefly described the Staff Memo as follows: The applicant property owner, K-Builders, Inc. The property owner is proposing to install a has submitted a request to install 6 parking spaces at a location where the structure is already parking lot for an existing structure in a single phase. The subject property is existing and is being proposed for an office use. The structure on site is approximately 1,548 located at 1306 Southwest 2nd A venue. square feet, which requires 5 parking spaces, As noted above the applicant is providing 6 spaces. However, in the site plan submitted by the applicant parking space #6 appears to be located in the right-of-way which is prohibited by the Code. As such, it is recommended that this 6th space be removed to avoid being in violation with the Code. As the strucutre is existing, and parking is the only issue, Staff recommends approval of the site plan after the deletion of the parking space has been made. . Ted Kelchner, Property Owner, distributed a revised plan showing the sixth parking space removed. There were no comments from Denny Davis, Police Chief; Donnie Robertson, Public Works Director; Oscar Bermudez, City Engineer; Herb Smith, Fire Chief; Tom Forbes, Building Official; Brian Whitehall, City Administrator; LC Fortner, Okeechobee Utility Authority; or Eddie Trent, Okeechobee County Health Department. There were no further comments from the Committee, nor any public comment. Brian Whitehall motioned to approve the revised K Builders Inc. Site Plan; seconded by Herb Smith. IV. New Business, continued. C. K - Builders, Inc, The application was submitted by Ted Kelchner on behalf of the VOTE property owner, K-Builders, Inc. The property owner is proposing to install a BERMUDEZ - YEA parking lot for an existing structure in a single phase. The subject property is DAVIS - YEA located at 1306 Southwest 2nd Avenue. ROBERTSON - YEA SMITH - YEA WHITEHALL - YEA MOTION CARRIED. . D. Okeeland, LLC. The application was submitted by David and Rose Conlon on Jim LaRue, City Planning Consultant, briefly described that reduction of parking requests can be behalf of the property owner, Okeeland, LLC. The property owner is requesting granted by the City Council based on a surplus of on-street parking being available. Mr. LaRue a twenty percent reduction in parking space requirements for a previously explained that in this case, there is no on-street parking available. Mr. LaRue questioned Mr. approved, but not yet constructed commercial project. The subject property is Conlon whether there was more proposed restaurant uses than before, Mr. LaRue also requested located at 501 Northeast Park Street. clarification regarding the Use of Alley Agreement. David Conlon, property owner, explained yes, three restaurant type uses are proposed. Mr. Conlon explained he did not have a Use of Alley Agreement with the City at this time. Mr. Conlon took a moment to explain his request to the Committee. He explained that he was utilizing Section 90- 482(6) of the City Codes related to non-competing businesses. He explained that he was currently requesting an 8% reduction (6 spaces) of parking as long as the in-store cooler was not utilized in calculating the parking space requirements. He explained that if the in-store cooler was utilized . in calculating the parking space requirements a 12% reduction (10 parking space) would be necessary. Mr. Conlon explained that he has three large parking spaces located in the rear parking lot to accommodate RV's or truck and trailer parking. He also explained that he has chosen to leave several large oak trees causing the limitation of parking spaces. He explained that he would rather not make the three large parking spaces into six regular sized ones, as well as remove all of the trees creating four more parking spaces. Mr. Conlon explained that his proposed tenant is Dunkin Donuts. He stated that most of their traffic would be drive thru, and would be completed by 11 :00 a.m, He explained that he would ensure the other two proposed tenants would not be open for breakfast. The other tenants will be quick-casual restaurants that open after 11:00 a.m. Mr. Conlon explained that one block away (at ABC Liquor) has on-street parking, and after inspecting his property there are several on-street parking spaces already striped. He explained that curb stops will need to be installed, and the stripes will need to be repainted. IV. New Business, continued. D. Okeeland, LLC, continued. John Cook, City Attorney, explained that three years from now when Dunkin Donuts moves out, and a new restaurant moves in, there will not be enough parking. David Conlon explained that he will sign an agreement with the City stating that he understands that. Jim LaRue questioned the parking ratio that was utilized when the building was approved. Oscar . Bermudez, City Engineer, explained that the ratio 1 space per 300 square feet was used initially. Then, the additional parking lot was added. Jim LaRue, City Planning Consultant, questioned Mr. Conlon if 1 space per 75 square feet is required throughout the building; how many spaces would the project be short? Mr. Conlon responded that if the square footage is based on gross floor area (including freezer space) he would be 10 spaces short, If the square footage is based on excluding the freezer space, he would be 8 spaces short. Mr. Conlon wanted to note for the record that someone at LaRue Planning and Management informed him that a freezer space is considered an ancillary use, and should not be included in the square footage for parking space requirements. John Cook, City Attorney, explained that in Section 90-483 it states that if there is not sufficient on-street parking, the owner must submit a parking study showing that the hours of the different . tenants will not overlap. David Conlon responded that there are five on-street parking spaces available at this time. Jim LaRue questioned Donnie Robertson, Public Works Director, whether the on-street parking spaces were currently being used? Donnie Robertson, Public Works Director, responded no, the parking spaces were not currently being used as the property is vacant. John Cook explained that the Technical Review Committee can make a recommendation to the City Council, however, they may require a parking study. IV. New Business, continued. D. Okeeland, LLC, continued. David Conlon requested that the proposal be placed in front of the City Council, and allow them to make the determination whether a parking study would be required. Jim LaRue explained that he would feel more comfortable approving the reduction after reviewing the parking study. Oscar Bermudez, City Engineer, noted that he agreed with LaRue. Brian Whitehall, City Administrator, questioned Mr. Conlon whether the Baskin Robins would be . closing at 11:00 a.m, as well? Mr. Conlon responded that Baskin Robins will be open in the afternoon. Herb Smith, Fire Chief, explained that a fire sprinkler system may be required for the entire building. He also requested that Fire Lanes be painted surrounding the building. He explained that the Fire Lanes will be enforced. Mr. Conlon explained that he would meet with Herb once all of the tenants are set and an occupancy load can be determined. Tom Forbes, Building Official, questioned whether Mr. Conlon would have cooking oil recycling tanks? . Mr. Conlon responded yes, they will be underground. Brian Whitehall, City Administrator, questioned if there are five on-street spaces, how many additional spaces are available on-site? Mr. Conlon explained that by reducing the three large R V parking spaces, he would gain six spaces. He explained by removing the trees, he would gain four spaces. Brian Whitehall, City Administrator, explained that would be ten spaces, fifteen including the on- street. IV. New Business, continued. D. Okeeland, LLC, continued. David Conlon eXplained that he would sign an agreement with the City stating that the project could be reevaluated after six months of operation. If there is a parking problem, he will remove the trees and reduce the large RV parking spaces at that time. John Cook, City Attorney, explained that the Technical Review Committee could make a recommendation to the City Council that a reduction of parking may be feasible for this location. He continued by explaining, if the Committee is not comfortable recommending approval of the . reduction request without first reviewing a parking study, the committee should state their concerns so the City Council is aware. There were no comments from Denny Davis, Police Chief; LC Fortner, Okeechobee Utility Authority; or Eddie Trent, Health Department. There were no further comments from the Committee, nor any public comment. Denny Davis motioned to recommend to the City Council that a reduction of parking may be feasible for this location; however, the Committee is not comfortable recommending approval without first reviewing a parking study. The application was submitted by Jim LaRue, City Planning Consultant, briefly described the Staff Memo as follows: On July 19, Deborah Nemec on behalf of the property owner, NEMEC, LLC. The property 2005, staff advised that the applicants application for final site plan approval be recommended owner is proposing to construct a parking lot for an existing warehouse in a single subject to the applicant submitting a written agreement to the City ensuring parking for the phase. The subject property is located at 911 Southwest Park Street. This item warehouse. Staff has received confirmation that the applicants own both lots where the warehouse was previously considered at the January 19, 2005 and the July 27, 2005 and the parking facility are being proposed. As such, the final site plan is being recommended for Technical Review Committee Meetings. approval. IV. New Business, continued. E. NEMEC, continued. Oscar Bermudez, City Engineer, explained that the building is labeled as a warehouse, and that he recommends that it is classified as retail sales. If classified as retail sales it will require thirty-three parking spaces, and the site plan only shows thirteen to fifteen. He stated that he recommends utilizing the vacant property to the rear of the building for the parking lot, and utilize Southwest Second Street as the entrance to the parking lot. Mr. Bermudez also expressed concerns with the storage of items in the alley. . Deborah Nemec, Property Owner, explained that she was unaware of the requirement of the additional parking spaces, so there was a miscommunication between herself and her Engineer. She explained that the plans were modified by moving the two parking spaces that were located where the doors and air conditioners were. She also explained that she spoke with Mr. Enfinger, the tenant, and he will move the tanks and dumpsters out of alley. John Cook, City Attorney, explained if the parking layout was approved, it would only be enough for a warehouse. He explained that warehouse parking would not be enough for the retail sales uses that are currently located within the building. He stated that a warehouse uses a ratio of 1 per 500 square feet, and the retail spaces utilize a ratio of 1 per 300 square feet. Jeff Kennedy, Project Engineer, explained that in January this project was considered and at that time a Unity of Title was the only concern. After that, Mr. Bermudez recognized a problem with the parking spaces being located where doors and air conditioners were placed, those problems . have been corrected. Mr. Kennedy explained that he was unaware of the increased parking requirements. Deborah Nemec, Property Owner, again explained that it must have been a miscommunication between herself and her Engineer. She apologized to the Committee and explained that revised plans will be submitted showing the increased parking requirements. John Spradley, representative of the Property Owner, questioned whether parking would be allowed in front of the four large garage doors. Oscar Bermudez, City Engineer, explained no parking would be allowed there, as the cars would be located in the alley. IV. New Business, continued. E. NEMEC, continued. Brian Whitehall, City Administrator, recommended reconfiguring the parking spaces to fit onto the other lot. He also recommended obtaining a Use of Alley Agreement with the City to use the alley as access to the rear parking lot. John Cook, City Attorney, agreed. He recommended the property owner to get with Lane Gamiotea, City Clerk, regarding the Use of Alley Agreement. . Herb Smith, Fire Chief, explained that fire lanes will need to be marked surrounding the building. He also explained that the fire lanes would be strictly enforced. LC Fortner, Okeechobee Utility Authority, questioned whether the tanks were attached to the building in any way. Deborah Nemec, Property Owner, responded no, they were not attached to the building. There were no comments from Donnie Robertson, Public Works Director; Denny Davis, Police Department; Tom Forbes, Building Official; or Eddie Trent, Okeechobee County Health Department. There were no further comments from the Committee; nor any public comment. . John Cook, City Attorney, recommended tabling the Site Plan until revised plans have been submitted showing the additional parking spaces. F. Lawrence Professional Building. The application was submitted by Loris Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows: Asmussen on behalf of the property owner, Ronnie and Ellain Lawrence. The property owners are proposing to construct an office building and a parking lot Planning Staff Report Discussion: This is a site plan review for an existing 1,920 square foot in a single phase. The subject property is located at the corner of Southwest 12th office building and 2 proposed office buildings totaling a 8,075 square feet. The existing building Street and Southwest 2nd Avenue. This item was previously considered at the and the proposed buildings will total approximately 9,995 square feet. August 24, 2005 Technical Review Committee Meeting. Planning Staff Report Recommendation: Staff recommends for approval of the site plan review when the following conditions are met: (1) The applicant must provide a drawing depicting the building facades on all sides. (2) Alleyway needs to be vacated. (3) Clarification needs to be provided regarding the existing structures remaining on the site. The square footage of the existing IV. New Business, continued. F. Planning Staff Report Recommendation, continued: structure has been reduced on the revised site plan and Staff is concerned as to how and why this has been done. Without this reduction, 3 additional parking spaces will be required. Jim LaRue, City Planning Consultant, questioned how the square footage on the existing structure was reduced. . Ronnie Lawrence, Property Owner, explained that the previous plan was including a two-hundred square foot porch, which was removed because that will never be utilized as office space. Oscar Bermudez, City Engineer, explained that the aisle width between parking spaces must be a minimum of 24'. He also explained that the building did not meet the setback requirements because of the proposed overhang and columns. Mr. Bermudez questioned the location of the dumpster. Tom Forbes, Building Official, explained that the front building must have a handicap space. Herb Smith, Fire Chief, explained that there must be fire lanes surrounding the buildings. Mr. Smith explained that the fire lanes will be enforced. Ronnie Lawrence, Property Owner, questioned whether a sidewalk will be required on the West . side of the property on Southwest Second A venue. Mr. Lawrence stated if a sidewalk was required, several large trees would have to be removed. Oscar Bermudez, City Engineer, responded yes, a sidewalk will be required. Mr. Bermudez recommended that Mr. Lawrence leave the trees, and have the sidewalk go around them. There were no comments from Denny Davis, Police Chief; Donnie Robertson, Public Works Director; Tom Forbes, Building Official; Brian Whitehall, City Administrator; Eddie Trent, Okeechobee County Health Department; or LC Fortner, Okeechobee Utility Authority. Denny Davis motioned to approve the Lawrence Professional Building Site Plan based on the following conditions: 1. Sidewalks along Southwest Second A venue, 2. Front setbacks must be met, 3. 24' aisle between parking spaces, 4, Dumpster moved to a City approved location, 5. Move 1 handicap parking space to accommodate the front building, and . 6. Brentwood Estates - Pre-Application Plat Review. The application was submitted Jim LaRue, City Planning Consultant, briefly reviewed the Staff Report Memo as follows: This by Loris Asmussen on behalf of the property owner Mark Troendle. The property is a memo regarding the pre-application submittal for a preliminary plat for Brentwood Estates. owner is proposing to modify a previously approved plat. The plat was approved This involves a subdivision that had been recently approved and recorded utilizing a sewer system. . with water and sewer. The property owner is now proposing to develop the Now, the request is for a septic system rather than utilizing the Okeechobee Utility Authority's subdivision with water and septic tanks. The proposed plat is to be located in the sewer system. The relevant comments are as follows: (1) Lot sizes should retain consistency with 900, 1000, 1100, and 1200 Blocks of Southwest 10th Street. RSF-l standards for widths, minimum size and setbacks. (2) The items of approval regarding sidewalks and other infrastructure shall remain in place. (3) With some of the lots being less than .5 acre, it should be determined whether it is appropriate to not require sewer for the whole subdivision. This determination should be from the Health Department, Utility Authority and/or the City Engineer. LC Fortner, Okeechobee Utility Authority, explained that if sewer is available it should be used. Brentwood Estates - Pre-Application Plat Review, continued. Eddie Trent, Health Department, questioned where the sewer was located? LC Fortner responded that the sewer was located in the Northwest Corner of Lot 1. Loris Asmussen, Project Engineer, briefly described the history of the subdivision. He explained that an individual can and pump systems were proposed; however it was decided that septic tanks would be better. He explained that he and the applicant met with both the Okeechobee Utility . Authority and the Health Department; however, did not meet with the City. LC Fortner stated that the individual can and pump systems are not the best system. Eddie Trent explained that under the Health Department Regulations, Mr. Troendle will meet the requirements for septic tanks ifhe has public water. Public water is proposed. Mr. Trent explained that he met with both Mr. Asmussen and Mr. Troendle and they have reached an agreement, providing the City approved the plat with septic tanks, He stated that the agreement involves: (1) no circle driveways will be permitted and (2) setback requirements must be more than 25 feet to allow for all septic tanks to be placed in the front yards. Mark Troendle, Property owner, explained that the existing houses have 40 - 45 foot setbacks. Jim LaRue, City Planning Consultant, questioned whether any of the homes would require a front . setback of less than 40 feet? Mark Troendle responded, not at this time, unless the lots have a curve in the front yard. Eddie Trent explained that 35 feet may be sufficient, as long as all driveways be placed along the side property line. Mr. Trent questioned the depth of lots 1 and 2. Mark Troendle responded that they are approximately 90 feet. He explained that they did a preliminary site plan for each lot with the spec house, and all setbacks were met including the septic tank. City of Okeechobee Technical Review Committee Hearing and Deadline Dates The City ofOkeechobee Technical Review Committee meets on the third Wednesday of each month at 10:00 a.m. in the City Council Chambers, City Hall, 55 S.E. Third Avenue, Okeechobee, Florida. A completed application, supporting documents and appropriate filing fee must be submitted by the cut-off date to be scheduled for the next available hearing date. Incomplete applications will not be scheduled until they are complete. Submit completed applications to the General Services Department, 55 S.E. Third Avenue, Room 101, Okeechobee, Florida, 34974. The Department requires that the applicant or a representative attend each hearing. (Revised 12-] -03) . . . . 7 September 2005 City of Okeechobee Technical Review Committee 55 Southeast 3rd Avenue Okeechobee, FL. 34974 Subject: BRENTWOOD ESTATES To Whom It May Concern: Enclosed is our re-submittal of Brentwood Estates for review and approval by the City of Okeechobee Technical Review Committee. This submittal is provided at the request of Brian Whitehall, in an effort to address the utilization of septic tanks and drain-fields in lieu of the "can and pump" systems initially proposed for this development, Following Final Plat approval for this project, the utilization of septic tanks and drain- fields was discussed and agreed to as the logical means of handling on-site sewage. My recollection is that based on soils and the depth to the water table, that installation of septic tanks was deemed logical and more efficient than the "can and pump" systems originally proposed. The potential problems associated with using individual "can and pump" systems were discussed, It appears that we were remiss in not including the City in this process. We hope that this submittal will resolve the issues and clear up any confusion that has resulted rrom using septic tanks and drain-fields at this site.
