meeting to order at 10:00 a.m.

A. Magic Mile Dairy Queen Expansion, revised. The application was submitted Jim LaRue, City Planning Consultant, briefly described the Memo that he provided.

The property owners are proposing a 932 square feet building expansion, Planning Staff Report Memo: On August 3, 2005, the applicants submitted revisions to the Site
including parking lot modifications, in one phase. The subject property is Plan for the Magic Mile Dairy Queen. Staff offers the following comments: (1) It appears that the

A. Magic Mile Dairy Queen Expansion, continued. drive through lane is not appropriate because of severe safety concerns. (2) The applicant has stated
in the attached letter (see enclosure) that landscaping requirements have been met. Staff has only
calculated seven trees on the latest submitted Site Plan. Additionally, the applicant stated that "over
150 shrubs will be provided." These shrubs are not shown on the site plan and neither are any
previously existing trees or shrubs. Thus, the landscaping requirements have yet to be verified.
Conversations with the applicant's representative indicate that there is existing landscaping on site
and the verification needs to be on the landscape plans prior to the issuance of a building permit. (3)
. The rear portion of the lot can only be used for parking when the applicant has received approval
from the City Council for a rezoning to the appropriate Zoning District which would allow such a
use. (4) Finally, the alleyway must be vacated for the site plan to work.
Oscar Bermudez, City Engineer, eXplained that he had some drainage concerns; however, Mr. Dobbs
is currently working on that.
There were no comments from Eddie Trent, Health Department; LC Fortner, Okeechobee Utility
Authority; Herb Smith, Fire Chief; Brian Whitehall, City Administrator; Denny Davis, Police Chief;
or Donnie Robertson, Public Works Director.
Denny Davis, Police Chief, motioned to recommend to City Council to approve a twenty percent
parking reduction; seconded by Donnie Robertson, Public Works Director.

B. Buxton Funeral Home, revised. The application was submitted by Close Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows:

Mr. LaRue questioned Mr. Fortner whether the water main was approved.
. LC Forner, Executive Director of the Okeechobee Utility Authority, responded yes it was
approved.
Mr. LaRue expressed concern with this being a corner lot. He questioned Mr. Cooper whether the
setback from the property line to the overhang was eight (8) feet.
Steven Cooper, Project Engineer, responded yes, the overhang was setback eight feet from the
property line.
Mr. LaRue questioned whether the foundation was the same, excluding the sidewalk surrounding
the building and the ten (10) foot overhang.

B. Buxton Funeral Home, continued. Brian Whitehall, City Administrator, explained that the foundation was removed and a new
building was going to be constructed.
Mr. LaRue explained ifthe project was new they would have to meet seventy-five (75) percent of
the front setback requirements. Mr. LaRue questioned whether the foundation was going to be
exactly the same as before.
. Mr. Cooper explained that he couldn't answer that question. He stated that he was the Project
Engineer and was not in charge of the foundation.
Mr. LaRue explained that it is very important to establish that the foundation is exactly how it was,
when the site plan was previously approved; except for the newly added sidewalk and overhang.
He questioned whether Mr. Cook agreed.
John Cook, City Attorney, responded yes.
Mr. Cooper explained that the new building had the same footprint as the old building.
Jim LaRue questioned Attorney Cook whether the previously approved variance on the parking
spaces sizes would still apply even though there is a new structure.
. Attorney Cook responded yes, the previously approved variance would still apply.
Brian Whitehall, City Administrator, questioned the distance between the East side of the building
and the property line and the distance between the North side of the building and the property line.
Jim LaRue explained that the Eastern setback was fifteen (15) feet, and the Northern setback was
eight (8) feet.
Oscar Bermudez, City Engineer, explained that when he scaled the measurements he got thirteen
feet, six inches (13' 6"). Mr. Bermudez explained that the Site Plan must show all measurements,
and a sidewalk along Northeast 2nd Avenue.
Mr. Cooper explained that a sidewalk will be constructed, only if the code requires them.

B. Buxton Funeral Home, continued. There were no comments from Herb Smith, Fire Chief; LC Fortner, Executive Director of the
Okeechobee Utility Authority; Eddie Trent, Environmental Health Department; Donnie Robertson,
Public Works Director; and Denny Davis, Police Chief.
Brian Whitehall questioned whether the maximum impervious surface would be exceeded.
. Oscar Bermudez explained that the impervious surface was not exceeded at this time; however, in
the future when the existing houses are torn down and new structures are built there, the maximum
impervious surface would be exceeded at that time.
Brian Whitehall motioned to approve the revised Buxton Funeral Home Site Plan subject to the
following:
1. Sidewalk be placed along Northeast 2nd Avenue,
2. Final Site Plan must have all dimensions noted on the drawing,
3. Construction Plans must be submitted showing the positive outfall,
The previously requested items must also be corrected:
1. Change the proposed 18' x 9' parking spaces to 20' x 9' (Variance 04-001- V
Approved),
2. Letter from Waste Management submitted to the City, giving their approval on the
dumpster location. (Letter received 8/16/05),
. 3. Correct the Site Plan to Show the hearses will not be backing onto NE 2nd Avenue,
4. Vacate the City Right of Way,
5. D.E.P Permit and D.O.T Permit,
6. Agreement with the City that the City is not liable for the force main in the City
Right-of-Way.
The motion was seconded by Denny Davis, Police Chief.

C. Lawrence Professional Building. The application was submitted by Loris Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows:
Asmussen on behalf of the property owner, Ronnie and Ellain Lawrence. The
property owners are proposing an office building and a parking lot in a single Planning Staff Report Discussion: This is a site plan review for an existing 2800 square foot
phase. The subject property is located at the corner of Southwest 12th Street and office building and 2 proposed office buildings totaling 9,250 square feet.
Southwest 2nd A venue.
Planning Staff Report Recommendation: Staff does not recommend for approval of the site plan
review until the following conditions are met: (1) The applicant must provide a drawing depicting
. the buildings facades on all sides. (2) Required parking spaces are not met. Applicant only has
33 spaces. (3) The width of some of the parking spaces do not meet the required 9x20 minimum
size. (4) No landscaping plan provided. (5) Alley way needs to be vacated. (6) Clarification
needs to be provided regarding the existing structures on the site and what will be continued.
Loris Asmussen, Project Engineer, explained that the proposed building facade is not available yet.
He explained that there are 33 parking spaces, however, the building size was modified and he
created a new Site Plan. Mr. Asmussen started to distribute the revised site plan, however was
asked to stop.
Jim LaRue recommended tabling the site plan to give the City Staff adequate time to review it,
instead of reviewing the new site plan right now.
Oscar Bermudez, City Engineer, explained that Department of Transportation (D.O.T) approval
. would be required on the existing entrances. Mr. Bermudez also expressed concerns with the flow
of traffic through the parking lot.
Jim LaRue requested that the drawings be larger than the 11 x 17 size that are normally provided.
He explained that it is very hard to review the site plans and measure them to scale since they are
a reduced size.
Loris Asmussen explained that only 2000 square feet of the existing building is considered to be
usable, the extra 800 square feet is a sunroomlcabana type space and will never be used as office
space.
Ronnie Lawrence, property owner, explained that the new building is all under one roof. There
will be two buildings with a breezeway in between.

C. Lawrence Professional Building, continued. Herb Smith, Fire Chief, questioned what type of use will be in all of the buildings.
Ronnie Lawrence explained that all of the buildings would be used as office space, except for the
carport and sunroom/cabana areas.
Jim LaRue requested that the buildings be broken down and shown on the plans. He requested that
. the square footage for all the buildings be shown.
Oscar Bermudez, City Engineer, requested that the dimensions be provided on the drawings.
Brian Whitehall, City Administrator, questioned Herb Smith whether he had any fire safety
concerns with the proposed new building.
Herb Smith responded that all fire safety concerns would be addressed at permitting time.
Ronnie Lawrence explained that a fire wall will go up every one thousand feet.
Brian Whitehall questioned Donnie Robertson whether he had any concerns with the culvert size.
Donnie Robertson, Public Works Director, responded that the culvert would need to be fifteen
. inches. He stated it could be elliptical if the owner so desired.
Jim LaRue explained that the site plan would be tabled for revised drawings. He explained that
the Project Engineer would need to verifY with DOT that the exiting curb cuts are okay. He also
explained that sidewalks will be required along Southeast 12th Street and Southeast 2nd A venue, the
sidewalk along South Parrott A venue is existing.
There were no comments from Eddie Trent, Environmental Health Department; LC Fortner,
Okeechobee Utility Authority; Donnie Robertson, Public Works Department; and Denny Davis,
Police Chief.
Denny Davis motioned to table Lawrence Professional Building Site Plan; seconded by Donnie
Robertson.

D. Echol's Building. The application was submitted by Thomas Close on behalf of Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows:
the property owner Close Properties. The property owners are proposing the
remodel of an existing commercial structure with site improvements in a single Planning Staff Report Discussion: This is a site plan review for an existing office building
phase. The subject property is located at the corner of Northwest 4th Avenue and located at the corner of 4th Avenue NW and 3rd Street NW. The applicant is proposing to remodel
Northwest 3rd Street. the exterior of the building and to improve the site. The building is approximately 12,500 square
feet and rests on 4 lots.
Planning Staff Report Recommendation: Staff does not recommend approval of the site plan
review until the following requirements are met: (1) The applicant exceeds the maximum
allowable impervious surface percentage by 19%. The applicant should conform to the required
60% or receive a variance of the impervious improvements of the CPO district. (2) The applicant
. has not provided a landscaping plan. (3) The new parking number is still below the required
amount necessary for the existing building. Since the building is not being enlarged, the TRC must
confirm that adherence to all new parking requirements are not necessary in this remodeling
situation. (4) The City engineer must confirm that if a variance is granted for the new impervious
threshold the drainage at the site will be adequate. Until the applicant has satisfactorily met these
requirements and clarifications the site plan cannot be approved at this time.
Oscar Bermudez, City Engineer, explained that a sidewalk will be required along Northwest 4th
Avenue.
Stephen Cooper, Project Engineer, explained that 4th Avenue is an awkward place to put a
sidewalk.

D. Echol's Building, continued. LC Fortner, Executive Director ofthe Okeechobee Utility Authority, questioned how deep the dry
retention would be because there was a sewer line coming from the building to the alley that may
be in the way.
Mr. Cooper responded that it would be two feet deep.
. Brian Whitehall questioned the gravel parking under the metal roof.
Sheryl Wells, representative of Close Construction, explained that area would be used to place
picnic tables for the employees to use on their lunch breaks.
Oscar Bermudez, City Engineer, recommended that the gravel area be paved along the City Right-
of-Way on Northwest 4th Avenue.
Sheryl Wells responded that the back parking lot was being paved for their employees to park, if
the City Right -of- W ay was paved it would be used by the Courthouse, not them.
Oscar Bermudez explained that it was only a suggestion to pave that area. He explained that by
paving the gravel area it would help them to comply with the parking requirements.
. Mr. Cooper stated that they did not want to do anything along Northwest 4th Avenue unless
required.
Jim LaRue questioned whether the Technical Review Committee thought a variance would be
necessary for the impervious surface.
Oscar Bermudez stated that it was not necessary.
Oscar Bermudez motioned to approve the Echol's Building Site Plan with the following
stipulations:
1. Sidewalk must be placed along Northwest 4th A venue,
2. Landscape Plan approval,

Subject: Site Plan Update for Magic Mile Dairy Queen
On August 3,2005, the applicants submitted revisions to the Site Plan for the Magic Mile
Dairy Queen. Staff offers the following comments:
1. It appears that the applicants have reduced the building footprint from 3,450 square
feet to approximately 3,069 square feet. This reduction would require the applicant to
provide 41 parking spaces. rfthe applicant applies for a 20% reduction, then 33
spaces would be required and the 35 spaces provided will suffice. Only when the
reduction is approved by the City Council can the proposed parking be satisfactory.
Still, the one parking space located in the front of the building which will require
backing out into the drive through lane is not appropriate because of severe safety
concerns.
2. The applicant has stated in the attached letter (see enclosure) that landscaping
requirements have been met. Staff has only calculated seven trees on the latest
submitted Site Plan. Additionally, the applicant stated that "over 150 shrubs will be
provided." These shrubs are not shown on the site plan and neither are any previously
existing trees or shrubs. Thus, the landscaping requirements have yet to be verified.
Conversations with the applicant's representative indicate that there is existing
landscaping on site and the verification needs to be on the landscape plans prior to the
issuance of a building report.
,.., The rear portion of the lot can only be used for parking when the applicant has

District which would allow such a use.

Enclosed fmd 3 copies of signed and sealed Revised Drainage Calculations and 11 copies
of signed and sealed Revised Site Plan Drawings including Landscaping plan. This
information was revised in response to the Staff Report submitted by Jim LaRue July 20,
2005. Comments will be listed below following each item in italics is the proposed
resolution to the issues raised in that report.
1. The Code requires the applicant to provide 54 parking spaces, only 35 have been
provided. Nineteen is a greater number that can be authorized under an
exemption process.
The building has been reduced to 3,300 sf, which would require 44
parking spaces and would fall within the 20% reduction since 35 spaces
are provided. See the revised Parking Consideration section of the
attached Engineer's Report.
2. 1 parking space located at the SE corner of the building is not suitable as a
parking space.
The parking space while not considered as meeting the parking
requirement will remain with an additional parking space added at the
entrance to the drive thru. See revised Construction Drawings.

3. The applicant has not provided the required landscaping.
The required landscaping has been provided with the addition of 7 trees to
the Paving, Grading, Drainage and Landscaping Plan. Over 150 shrubs
will be provided and less than 40 are required
4. The alleyway needs to be vacated before it can be calculated as parking spaces.
The alley abandonment Ordinance No. 905 will be readfor the first time
August 2, 2005 and will be read for the second time on September 7, 2005.
5. The rear portion of the property is zoned RSF-l. Recently, the Code was
changed to not allow commercial parking in a RSF -1 Zoning District.
A rezoning petition to rezone the parcels currently zoned RSF-1 to
Commercial is being filed for consideration by the Planning and Zoning
Board on September 27, 2005, presentation to the City Council on
October 4, 2005 and final action by the City Council proposed for
October 18, 2005. The future land use on the parcels zoned RSF-1 is
commercial and is in accordance with the request.

Recommendation:
Staff does not recommend approval of the site plan review until the following
requirements are met:
1. The applicant exceeds the allowable . . surface
mmamum lffipervlOus percentage by 19%. The applicant should confonn to the required 60% or
receive a variance of the impervious improvements of the CPO district.
2. The applicant has not provided a landscaping plan.
3. The new parking number is still below the required amount necessary for the
existing building. Since the building is not being enlarged, the TRC must
confinn that adherence to all new parking requirements are not necessary in
this remodeling situation.
4. The City engineer must confinn that if a variance is granted for the new
impervious threshold the drainage at the site will be adequate.
Until the applicant has satisfactorily met these requirements and clarifications the
site plan cannot be approved at this time.
