Jim LaRue, City Planning Consultant, called the June 22, 2005 Technical Review Committee meeting to order at 10:00 a.m. .1. Chairperson and Staff Attendance - Chairperson. Each member stated their name and the organization that they are representing for the record. Courthouse Plaza, LLC is the property owner, Mike Jimenez Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows: is the applicant. The applicant is proposing to construct an office building and parking lot in one phase. The subject property is located at the comer of Planning Staff Report Discussion: This is a site plan review for 8,000 square feet office building Northwest Third Avenue and Northwest Fifth Street. with a parking lot. Planning Staff Report Recommendation: Staff does not recommend for approval of the site plan review until the following conditions are met: (1) The applicant is proposing street parking along NW 5th Street. It must be demonstrated that on-street parking is available in the area. (2) The applicant must provide 2 additional parking spaces for the proposed structure. (3) Building elevations should be demonstrated. JUNE 22, 2005 - TECHNICAL REVIEW COMMITTEE - PAGE 2 OF 5 III. New Business, continued. A. Courthouse Plaza, continued. LC Fortner, Executive Director of the Okeechobee Utility Authority, stated that water and sewer were available. Oscar Bermudez, City Engineer, explained that he was concerned with the parking at this location. He stated that 8000 square feet of office space is too big for this site. He also explained that a reduction of parking request must be approved by the City Council for this project to be approved. Mr. Bermudez requested that revised drawings be submitted showing where the positive outfall . is going to go. Loris Asmussen, Project Engineer, explained that he counted the on-street parking to meet the parking requirements. He stated that the square footage could be reduced a little due to the placement of a hallway. Mr. Asmussen stated that if a twenty percent reduction of parking is given, the parking requirements could be met. Jim LaRue, City Planning Consultant, explained if the twenty percent reduction of parking is approved, the site plan will still be seven spaces short. Loris Asmussen explained that he could alter the site plan to meet the parking requirements. Jim LaRue requested that a revised plan be submitted showing 22 parking spaces off-street or the building size must be reduced. . There were no comments by Eddie Trent, Health Department; LC Fortner, Executive Director of the Okeechobee Utility Authority; Herb Smith, Fire Chief; Brian Whitehall, City Administrator; Denny Davis, Police Chief; and Donnie Robertson, Public Works Director. Oscar Bermudez motioned to table the Courthouse Plaza Site Plan until a revised plan is submitted showing that all of the requirements can be met (The reduction of parking space request will be considered at that time); seconded by Denny Davis. MOTION CARRIED. B. Lundy Ice Machine. Richard and Sandra Vest are the property owners, Brad Jim LaRue, City Planning Consultant, briefly described the Staff Report Memo as follows: Lundy and Wes Abney are the applicants. The applicants are proposing to place a self containing ice vending machine in the Southwest comer of the Pogey's Planning Staff Report Memo: After reviewing the proposed site plan and examining the Unified Plaza parking lot in one phase. The subject property is located at 1759 South Land Development Code, the following concerns were raised: (1) The applicant has not provided Parrott A venue. a letter of consent from the property owners stating that the proposed use would be lawful. (2) There is no data to support whether the use is compatible with current and future uses on the subject property. (3) The applicant has not stated or shown on the site plan whether the proposed structure would be discontinuing any of the existing/proposed parking spaces that would be required for the current use (or future uses for that matter). (4) It is not known whether the parking is conforming (in terms of number of spaces) for the existing uses. (5) This request is not listed-either as a permitted, special exception, or accessory use-in the CHV Zoning District. (6) The location ofthe ice house machine is not conducive to the best traffic patterns for ingress/egress . and parking. Planning Staff Report Memo Revised: The applicant has submitted new information for the proposed Ice House to be located on US 441. In our original review, outlined in a memo dated June 13th, Staff had concerns that the applicant has satisfied. (1) The applicant has provided a letter of consent from the property owner allowing a portion of the property to be used as an ice house. (2) There is no data to suppOli whether the use is compatible with current and future uses on the subject property but such an accessory use is similar to bottled water stations located at other locations in Town. (3) The applicant has shown that the proposed ice house will be placed on 4 of the 61 parking spaces on the lot. The current uses only require 47 spaces. As such, the applicant will not be bringing the total number of spaces below what is required. (4) The Unified Land Development Code is silent as to whether this use is allowed in the CHV district but it is a retail/service oriented use. As such, Staff sees no reason why the applicant should not be allowed to have this use as he has complied with our concerns. Staff recommends that the use be approved. JUNE 22, 2005 - TECHNICAL REVIEW COMMITTEE - PAGE 4 OF 5 IV. New Business, continued. B. Lundy Ice Machine, continued. Brad Lundy explained that the parking for the neighboring restaurant is separate from this request. LC Fortner, Executive Director of the Okeechobee Utility Authority, explained that additional fees will be required due to the increased water usage. He also questioned the distance between the proposed ice machine and the fire hydrant. Brad Lundy responded that it was approximately fifteen to twenty feet. . Herb Smith, Fire Chief, questioned whether there will be compressed gasses inside the structure. He also questioned the size of the structure. Brad Lundy responded that there will not be any compressed gasses inside the machine, nor will it be manned. He stated the machine will be ten feet tall, twenty feet long, and thirteen feet wide. Herb Smith requested that a lock box be provided to get inside the facility. There were no comments by Eddie Trent, Health Department; Brian Whitehall, City Administrator; Denny Davis, Police Chief; and Donnie Robertson, Public Works Director. Donnie Robertson motioned to approve the Lundy Ice Machine Site Plan; seconded by Oscar Bermudez. . VOTE BERMUDEZ - YEA DAVIS - YEA ROBERTSON - YEA SMITH - YEA WHITEHALL - YEA MOTION CARRIED. In our original review, outlined in a memo dated June 13th, Staff had concerns that the applicant has satisfied. 1. The applicant has provided a letter of consent from the property owner allowing a portion of the property to be used as an ice house. 2. There is no data to support whether the use is compatible with current and future uses on the subject property but such an accessory use is similar to bottled water stations located at other locations in Town. 3. (a) & (b) The applicant has shown that the proposed ice house will be placed on 4 of the 61 parking spaces on the lot. The current uses only require 47 spaces. As such, the applicant will not be bringing the total number of spaces below what is required. 4. The Unified Land Development Code is silent as to whether this use is allowed in the CHV district but it is a retail/service oriented use. As such, Staff sees no reason why the applicant should not be allowed to have this use as he has complied with our concerns. Staff recommends that the use be approved.
