CBC Management, Inc. is the property owner, Thomas C. Close is Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows: the applicant. The subject property is located in the 300 Block of North Parrott Avenue. This site plan was previously considered on October 20, 2005, Planning Staff Report Discussion: The matter before the Technical Review Committee is the December 15,2004, January 19,2005 and February 20,2005. Oscar Bermudez, City Engineer, explained that an agreement between Mr. Close and the City was to be executed to limit the size of the restaurant during lunch hours. . John Cook, City Attorney, explained under the first site plan, the agreement was necessary. If the parking requirements can be met with the revised site plan, it will not be necessary. Oscar Bermudez reiterated the importance of the agreement. Jim LaRue, City Planning Consultant, explained that he was recommending approval. LC Fortner, Executive Director of the Okeechobee Utility Authority, explained that the meter has been relocated, he stated he would check to see ifhe has a water main available for the west office building. If not, one of the existing water main would need to be extended. There were no comments from Herb Smith, Fire Chief; Eddie Trent, Health Department; or Donnie Robertson, Public Works Director. . Oscar Bermudez motioned to recommend approval for the Court Plaza Site Plan based on the following stipulations: 1. Meet the Okeechobee Utility Authority's requirements, 2. Agreement between property owners and the City regarding parking during lunch hours. The motion was seconded by Donnie Robertson. III. New Business, continued. A. Court Plaza, continued. BMJ Towing, Inc. is the property owner and applicant, Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows: represented by Loris Asmussen, project engineer. The applicant is proposing construction of a 70' x 70' metal building, containing three offices and a shop, as Planning Staff Report Discussion: This is a site plan review for construction of a 70' X 70" well as the associated infrastructure in a single phase. The subject property is metal building that will include three offices and a storage/shop with associated infrastructure. (2) The applicant should verify that the proposed building height would not exceed 45 feet. Clarification needs to be provided tying this site plan approval to all new parking and new structures. . Loris Asmussen, Project Engineer, explained that the building height will be below 45 feet. Oscar Bermudez, City Engineer, explained that he was concerned with the boundaries of the project. Jim LaRue explained that the Site Plan must demonstrate the designated area of development, so the parking can be calculated appropriately. He explained that since there are so many existing buildings on the site, the concern would be that some of them would be sold and the parking would become an issue. BMJ Towing, Inc., continued. David Williams, property owner, explained that the site is listed under unified ownership. Jim LaRue questioned whether it would be okay with the property owner if the City approved this Site Plan based on the entire site. David Williams responded yes, approval based on the entire site would be okay. Mr. Williams explained that the existing mobile home would be removed from the site. . Oscar Bermudez explained that he did not want Mr. Williams to sell off pieces of the property in the future. He continued by explaining that the future sale will cause parking problems for the existing buildings as well as the new buildings that the buyers are going to propose. Loris Asmussen, Project Engineer, explained that the site is currently elevated and they are unable to drain to the Department of Transportation's right-of-way. LC Fortner, Executive Director of the Okeechobee Utility Authority, questioned the property owner regarding the plan for water and wastewater disposal. David Williams explained that there is existing water available and an existing septic tank. LC Fortner explained that sewer was available across the street at V-Save in case they would rather . use sewer. Mr. Fortner asked if they were planning to use their existing meter for water. David Williams responded that the existing meter would be fine. Eddie Trent, Environmental Health Department, explained that the developers must comply with the Health Department's concerns related to the development or extension of the drainfield. John Cook, City Attorney, explained that the site plan is approved as outlined on the plans. If additional buildings are added, or if some of the property was sold; they would be required to meet all applicable City codes. He continued by explaining that a new site plan would have to be submitted showing that the parking and drainage requirements would be met. David Williams explained that the building would be used as temporary storage for cars. He stated there would be no hazardous materials stored within the building. Oscar Bermudez motioned to approve the BMJ Towing Site Plan with the following stipulations: 1. Meeting all of the Environmental's Health Department's concerns, 2. Meeting all of the Okeechobee Utility Authorities concerns, '" Fire Department access along Southwest Td A venue, and .J. . 4. Rear entrance that meets Engineering Department's concerns. Following is a list of the proposed changes: 1) North Entrance - To be moved towards the West approximately 70'. 2) 4,000 S.F. proposed office building - Flip flop with retention area, both are on the West side of the block. 3) 4th Street parking - Move the 7 parking spots to 2nd Avenue. 4) Relocated dumpster and added a dumpster. 5) On-site parking spots - Due to the above changes we have 4 less parking spots. According to the parking study we now have 3 extra parking spots. 6) Parking General ~ I will work closely with John Cook and the City Council in regards to our parking agreement and future buildings on this site. Vehicle access from the front of the building to the rear is not provided. As discussed on-site with the Florida Department of Transportation (FDOT) Staff, an exemption is allowable for the ¡roposed configuration. The existing access to BMJ Towing, located on Southwest 2n Avenue, will continue to be used by employees and tow-trucks. In addition to the proposed building, the necessary infrastructure is proposed. This includes parking (including two handicap spaces), storm water management, road access and landscaping. The site is designed to be handicap accessible. As discussed with FDOT, all drainage is to be directed away from US 441 South right-of-way. On-site retention swales will be used to provide one-half inch of dry pre-treatment prior to overflow to the historic receiving system (SW 2nd Avenue).
