Elbert Batton, owner of Lake View Builders, is the Jeff Kennedy, Project Engineer, explained that Mr. Batton is proposing to add a small addition to each side of property owner and applicant. The applicant is proposing a 722 square foot addition his existing building. Mr. Kennedy explained that the owner is also going to add parking, landscaping, and to an existing office and a parking lot with 11 spaces in a single phase. The project drainage to meet the City's existing code requirements. location is 200 NW 5th Street. Jim LaRue, City Planning Consultant, requested that the Staff Report be reviewed in his absence. New Business, continued. A. Lake View Builders Addition, continued. B. Okeeland LLC Parking Lot. David Conlon, owner of Okeeland LLC, is the property owner and applicant. The applicant is proposing a 24 space parking lot to serve a previously approved, but not yet constructed, commercial project in a single phase. The project is located at the Southwest corner of Northeast 6th Avenue and Northeast 2nd Street. LC Fortner, Executive Director of the Okeechobee Utility Authority, questioned Mr. Batton whether any bathrooms would be added to the building. Mr. Batton explained that one handicap bathroom would be added. Oscar Bermudez, City Engineer, questioned where the positive outfall would go. Jeff Kennedy explained that there would not be any control structures at this site. He continued by explaining that the proposed ponds are designed to handle the 25 year, 24 hour storm. Mr. Kennedy explained that if the flooding was worse than tha;, the water would hopefully overflow into the street. There were no comments or concerns from Herb Smith, John Cook, Donnie Robertson, or Denny Davis. Herb Smith motioned to approve the Lake View Builders Addition Site Plan; seconded by Denny Davis. Jeff Kennedy, project engineer, explained that this is a parking lot addition to a previously approved Site Plan. Mr. Kennedy explained that Mr. Conlon, property owner, had a proposed tenant when the last Site Plan was approved, and due to time delays with Department of Transportation, Mr. Conlon lost the tenant. He continued, Mr. Conlon does have a new proposed tenant; however, they would like more parking than the amount that was originally approved. Mr. Kennedy explained that the proposed use of the entire building is unknown at this time; however, it is possible that as many as three (3) tenants could be there. Parking will be dealt with at the time each space is built out. Mr. Kennedy also explained that the Department of Transportation has approved a sixteen (16) foot entrance only off of Highway 70. Okeeland LLC Parking Lot, continued. Jim LaRue, City Planning Consultant, requested that the Staff Report be reviewed in his absence. John Cook, City Attorney and Interim Administrator, noted for the record that Mr. LaRue recommended approval in his Staff Report. John Cook questioned whether there would be enough parking under any scenario of proposed occupancy. . Mr. Kennedy explained that if the entire building was occupied by a restaurant, then there would be parking Issues. LC Fortner explained that water and sewer were available in the alley. Herb Smith, Fire Chief, explained that he was concerned with the proposed restaurant use. Mr. Smith explained that since the proposed occupancy load is unknown at this time, he would be unable to state whether a sprinkler system would be necessary. John Cook questioned whether the alley was open or closed, and whether or not Mr. Conlon was proposing to pave the alley. Mr. Cook also explained that a sidewalk would need to be provided along Highway 70, Northeast 5th Avenue, and Northeast 6th Avenue. Mr. Cook asked Mr. Kennedy if Mr. Conlon was aware of and understood these requirements; Mr. Kennedy stated yes, Mr. Conlon understood. . Mr. Kennedy stated that he was unsure if the alley was open or closed and that they were proposing to pave the alley. John Cook explained to Mr. Kennedy that an Alley Use Agreement would be required and that any improvements made to the alley would be at Mr. Conlon's expense. John Cook also explained that it is important that Mr. Conlon understands that if the entire building is to be used by a restaurant, an occupational licence would not be issued until all parking requirements are met. Mr. Cook reiterated for the record that all parking issues must be resolved prior to applying for an occupational license. Mr. Cook asked Mr. Kennedy if Mr. Conlon was aware of and understood these requirements; Mr. Kennedy stated yes, Mr. Conlon understood There were no comments or concerns from Oscar Bermudez, Donnie Robertson, or Denny Davis. Lowell Pritchard, owner of Pritchards and Associates, is the property owner and applicant. The applicant is proposing an addition to the drive aisle and an addition of 5 parking spaces to a previously approved commercial project in a single phase. The project is located at 1802 South Parrott Avenue. . Donnie Roberston motioned to approve OkeeLand, LLC Parking Lot Site Plan with the following stipulations: 1. Alley Use Agreement obtained through the City Clerk's office, 2. Fire Safety issues resolved with the Fire Chief once a proposed occupant load is reached, 3. Jim LaRue, City Planning Consultant, requested that the Staff Report be reviewed in his absence. John Cook, City Attorney and Interim Administrator, noted for the record that Mr. LaRue recommended approval in his Staff Report. Jeff Kennedy, project engineer, explained that Mr. Pritchard recently acquired the property containing the two storey building located to the South of his new commercial development. Mr. Kennedy explained that the previously approved site plan for the new commercial development was not modified. The reason that both properties were shown on the site plan was to show the drive aisle created to run through the two properties, connecting Southwest 18th Street and Southwest 19th Street. Mr. Kennedy explained that this drive aisle will give two means of ingress and egress to both properties. John Cook questioned whether Southwest 19th Street was going to be paved. Mr. Cook also questioned the proposed use of the two storey building. Mr. Kennedy responded that Southwest 19th Street was not proposed to be paved. Mr. Kennedy explained that the neighboring church is currently using Southwest 19th Street as their parking lot since it is undeveloped and because they currently have no other room for parking. Mr. Pritchard, owner, explained that the second storey is currently used as a residence, and the first floor will hopefully be used as office space. John Cook explained that a residence is permitted as a special exception within the Heavy Commercial zoning district if it is has no more than two bedrooms and is less than eight hundred (800) square feet. . Oscar Bermudez, City Engineer, explained that the five (5) parking spaces are encroaching onto the City Right-of-Way. Jeff Kennedy questioned whether vacating the roadway would be an option. Oscar Bermudez explained that vacating the roadway is not a decision made by the Technical Review Committee; it will have to be made by the City Council. Donnie Robertson, Public Works Director, explained that he was concerned with the parking spaces as well. He also stated that the street and alley may be closed because the daycare is currently using them. Mr. Robertson also explained that if Southwest 19th Street was developed the parking spaces must be removed. . John Cook verified with Lane Gamiotea, City Clerk, that Southwest 19th Street and the alley are both open. He explained that the daycare currently has an agreement with the City for use of Southwest 19th Street. Mr. Cook recommended that the Committee table this petition until next month's meeting so that more information could be gathered. Oscar Bermudez requested that the proposed use for the entire building be provided at that time. Lowell Pritchard explained that in approximately five (5) to ten (10) years that building will be torn down, and an additional wing will be added to the new commercial structure. D and A Sod and Landscaping, Inc. is the property owner, Anita Jim LaRue, City Planning Consultant, requested that the Staff Report be reviewed in his absence. John Nunez is the applicant. The applicant is proposing to construct a 3072 square foot office Cook, City Attorney and Interim Administrator, noted for the record that Mr. LaRue recommended approval building with 11 parking spaces in a single phase. The project is located at the Northeast in his Staff Report. corner of Northeast 6th Street and Northeast 2nd Avenue. . Jeff Kennedy, project engineer, explained that this property has been recently rezoned to construct a commercial office building. LC Fortner, Executive Director of the Okeechobee Utility Authority, explained that water and sewer were available. Mr. Fortner stated that a private pump station would be necessary to pump the sewer across Northeast 6th Street. Oscar Bermudez, City Engineer, explained that sidewalks will be required along Northeast 2nd Avenue and Northeast 6th Street. Mr. Bermudez also noted that three (3) of the parking spaces are located within the visibility triangle. He explained that this could be resolved by placing the parking spaces where the retention area is, and put the retention area where the parking spaces were. Tom Murphy, representative of the applicants, noted for the record that the sidewalks very expensive to create, especially when the sidewalks that the developers are putting in are going nowhere. It was explained that the Land Development Regulation's required sidewalks in connection with a project. There were no comments or concerns from Herb Smith, John Cook, Donnie Robertson, or Denny Davis. April 20, 2005 - Technical Review Committee - Pa e 7 of 10 III. New Business, continued. D. Nunez Office Building, continued. Oscar Bermudez motioned to approve the Nunez Office Building project, with the following stipulations: 1. Sidewalks be placed along Northeast 2nd Avenue and Northeast 6th Street. 2. Switch the location of the three parking spaces and retention pond to eliminate the visibility triangle conflict. Seconded by Denny Davis. . VOTE BERMUDEZ - YEA BOYD - ABSENT DAVIS - YEA LARuE-YEA ROBERTSON - YEA SMITH - YEA COOK-YEA MOTION CARRIED. E. Valente Apartments. RJ Remodeling Enterprises, Inc. is the property owner, Rick Valente Jim LaRue, City Planning Consultant, requested that the Staff Report be reviewed in his absence. John is the applicant. The applicant is proposing to construct a two storey, 7 unit apartment Cook, City Attorney and Interim Administrator, noted for the record that Mr. LaRue recommended approval complex with 14 parking spaces in a single phase. The project is located a the Northwest in his Staff Report. corner of Southeast 5th Street and Southeast 6th Street. Jeff Kennedy, project engineer, explained that Mr. Valente is proposing a seven (7) unit apartment complex. He explained that all of the apartments will be located under one roof with breeze ways located between each building. . Donnie Robertson, Public Works Director, explained that the alley could not be used as ingress or egress to the parking lot. Oscar Bermudez, City Engineer, recommended that the Committee should not approve the site plan with the alley being used as ingress and egress. LC Fortner, Executive Director of the Okeechobee Utility Authority, explained that water and sewer was available. Mr. Fortner also explained that he had concerns with the alley being used as ingress and egress to the parking lot because the current alley traffic breaks the meter boxes owned by the Okeechobee Utility Authority. Herb Smith, Fire Chief, explained that he would need additional information prior making a determination regarding the requirement of a fire sprinkler system. Oscar Bermudez explained that the entrance to the parking lot should be along Southeast 6th Avenue instead of from the alley. He also explained that sidewalks will be required along Southeast 6th Avenue and Southeast 5th Street. There were no comments or concerns from Denny Davis or John Cook. Denny Davis motioned to approve Valente Apartments with the following stipulations: 1. Subject to Fire Chief's sprinkler system requirements, 2. Sidewalks being installed along Southeast 6th Avenue and Southeast 5th Street. 3. Move the entrance to Southeast 6th Avenue. Seconded by Oscar Bermudez. VOTE BERMUDEZ. YEA BOYD. ABSENT DAVIS. Lowell Pritchard, owner of Pritchards and Mr. Lowell Pritchard, applicant, requested the Committee to reconsider his site plan. Mr. Pritchard explained Associates, is the property owner and applicant. The applicant is proposing an addition that he is working on a very tight schedule, and delaying the site plan approval will cause him severe losses. to the drive aisle and an addition of 5 parking spaces to a previously approved commercial project in a single phase. The project is located at 1802 South Parrott Billy White representative of Close Construction, Mr. Pritchard's building contractors, explained thatthe new Avenue. (Mr. Pritchard requested that the discussion be continued from earlier in building is almost complete and if the project is delayed it could cause liquidated damages. the meeting, instead of being tabled as the Committee requested). Oscar Bermudez, City Engineer, questioned when Mr. Pritchard acquired the property. Mr. Pritchard explained that he acquired the property one to two years ago. April 20, 2005. Mr. Bermudez explained that the City's Code requires property to be brought up to Code as much as possible once ownership transfers. Mr. Pritchard explained that the new commercial structure and the old commercial structure and properties are now both on one warranty deed. He reiterated to the Committee that his future plan is to tear the old building down and add a wing onto the new commercial structure. He stated that he did not anticipate the older building to be there forever. . Donnie Robertson, Public Works Director, explained that Mr. Pritchard may be required to pave Southwest 19th Street. Mr. Pritchard responded that he is creating new jobs for the area and constructing a large commercial structure to increase the tax base within the City and doesn't understand why paving Southwest 19th Street is such an issue. Mr. Pritchard explained that it will be very expensive to pave Southwest 19th Street too, as he is already having to pave Southwest 18th Street. John Cook explained that the Technical Review Committee could approve the project with the condition that an agreement between Mr. Pritchard and the City be created to hold the City harmless if someone was injured by backing from the parking spaces onto the City Right-of-Way, as well obtaining a Street Use Agreement. . Mr. Pritchard questioned whether he would have to place a sidewalk along Southwest 19th Street. Mr. Cook responded that a sidewalk would not be necessary, however he would have to pave Southwest 19th Street. Mr. Pritchard questioned Donnie Robertson regarding the proposed cost of paving Southwest 19th Street. Donnie Robertson responded that he was unsure of the cost. Billy White responded that he estimated the cost to be around twenty to twenty-five thousand dollars. John Cook explained that the Technical Review Committee could approve the project with the condition that Southwest 19th Street be paved. He continued by explaining that if Mr. Pritchard would like to dispute the requirement it would have to be heard before the City Council for an official rendering. . Donnie Robertson motioned to approve Pritchard's Parking Lot Addition with the condition that Southwest 19th Street be paved from South Parrott Avenue to the property line; seconded by Herb Smith.
