I. Call to Order· Chairperson.
Technical Review Committee Meeting - Joe Boyd, Chairperson. In Chairperson Boyd's absence, Bill Veach called the January 19, 2005 Technical Review Committee meeting
to order at 10:00 a.m.

III. New Business.
A. Court Plaza. CBC Management, Inc. is the property owner, Thomas C. Close is the Chris Close, applicant, explained that he is waiting on an alley closure to be approved and the 20% parking
applicant, Vikki Aaron is representing the applicant. The applicant is proposing to reduction request to be considered and approved. He requested if phase one, two, and three be approved at

Administrator Veach explained that the Committee is only considering phase one today.

A. Court Plaza, continued. LC Fortner, Okeechobee Utility Authority, explained that they needed easements to access the water and
sewer lines if the alleys are closed. He explained that the applicants will need to get with Fire Chief Smith
regarding hydrant placement, therefore if another hydrant is required in phase three it would be more cost
effective to do it all at once. Mr. Fortner asked the applicant if the sewer lines in the north-south alley were
shallow? (Applicant responded that the lines were four to five feet deep) Mr. Fortner then explained that
OUA needed to replace the sewer line, and that it will be done prior to paving. In the east-west alley a sewer
line is proposed, then on the landscaping plan it is showing trees in that exact location, and that can't
. happen. Mr. Fortner explained that the trees needed to be relocated.
Fire Chief Smith submitted written comments in his absence. He requested that the fire hydrant remain as
placed and that the sprinkler system/fire department connection remains the same as previously discussed
at a prior meeting.
Administrator Veach recommended that Chris Close, Fire Chief Smith, and LC Fortner get together to work
out the hydrant and connection issues.
City Engineer Bermudez explained that he still has a problem with parking. Only seventy-four off street
spaces for the restaurant are shown, one hundred twenty-four off street spaces are needed. The parking
study that the applicant provided says ninety-seven spaces are need. In conclusion, there is not enough off
street spaces provided. Mr. Bermudez explained that it is recommended that a twenty percent parking
reduction request is made to the City Council. I recommend to the Committee not to approve the pro'ect until
Administrator Veach explained that all parking must be off street. Ninety-eight to ninety-nine spaces for the
restaurant are needed if the twenty percent parking reduction is granted. The parking study that was
provided does not match City Codes.
Chris Close questioned the Committe whether phase one could be approved with parking in its entirety? He
explained that he will apply for the reduction of parking.
Administrator Veach explained that the Committee can approve the plans based on ninety-eight to ninety-
nine parking spaces being provided off street, with City Council approving the twenty parking reduction
request and the alley closure request. He continued that those items are needed before you can move
forward with phase one only. Phase two and three are not being considered at this time.

B. Florida Floors and Moore. Paul Howell is the property owner and applicant. The LC Fortner explained that water and sewer was available.
applicant is proposing to construct a Concrete Block Building to sell flooring. The subject
property is located at 513 SW Park Street. City Engineer Bermudez explained that the parking in the rear of the building was approved to be shell
parking due to the drainage issues in that area. Mr. Bermudez also questioned the situation between Mr.
Howell and his neighbor regarding the exhaust fan blowing on his proposed building.
Mr. Howell, applicant, explained that during the rebuilding from hurricane damage of Glady's Restaurant he
explained to the contractor that he would be building a building next door and that they should vent the

B. Florida Floors and Moore, continued. exhaust out of the roof since the roof had not been placed on, instead of venting the exhaust out the side
of the building. Mr. Howell explained that he was willing to work with the City regarding whatever needs to
be done to resolve the situation.
City Engineer Bermudez explained that the City has no bearing on the situation between neighbors.
Fire Chief Smith submitted written comments in his absence. He recommended that the Site Plan not be
. approved until the situation between Mr. Howell and the owner of Glady's is resolved.
Administrator Veach explained that the City is just trying to prevent conflicts between neighbors.
Mr. Howell explained that he is willing to work with the owner of Glady's to resolve the problem.
Public Works Director Robertson questioned how high the shell parking will be, and where the drainage from
the gutters will be directed.
Mr. Howell explained that the property will be raised a little, however the parking can not be raised too much
because it will flood the business. The drainage from the gutters will be directed to the parking lot.
Administrator Veach instructed Mr. Howell to get with Fire Chief Smith to resolve the pending issues between
neighbors.
Denny Davis motioned to approve the Site Plan for Florida Floors and Moore; seconded by Oscar Bermudez.

C. NEMEC, LLC Warehouse Parking Addition. NEMEC, LLC is the property owner and Jeff Kennedy, Project Engineer, explained that this is an existing building that the property owners are trying
applicant, Jeff Kennedy is representing the applicants. The applicant is proposing to to bring up to code as much as possible with regards to parking and drainage. In the Staff Report, LaRue
construct a paved parking lot for an existing warehouse. The subject property is located Planning and Management is recommending that the property titles be joined. Mr. Kennedy continued by
at 911 South West Park Street. explaining that although he understands where Mr. LaRue is coming from, it is not feasible at this time. The
property is currently in an estate, and the estate attorney's are not allowing for that to be done at this time.
Deborah Nemec, trustee of the estate, explained that the attorney's are not allowing any changes to the
. property to be done at this time. Superior Water Works, the tennant, has a temporary occupational license
to operate however it will be expiring soon. That is why the property owners are trying to act quickly.
Administrator Veach explained that the joining of titles needs to be done, however it can't be done due to
pending legal issues. He recommended that the Occupational License for Superior Water Works be
extended thirty days to give the applicants attorney and the City attorney a chance to get together to discuss
the matter.
There was no further discussion on this matter.

Due to court scheduling, I cannot make it to the Jan. 19 m
applications with Oscar Bennudez, and note the following:
1. 507 SW Park St. request for zero setback on 50' lot in C zoning; This project next
to Gladys' restaurant, appears to meet our CBD code; there is no urn buildable lot size in
CBD, and the plan submitted does not appear to exceed the 85% 10 coverage restriction. While I
questioned a shell parking lot, our engineer believes that it will imp ove drainage in the alley as
opposed to requiring a paved lot.
2. Court restaurant/office building in commercial zonin ; My calculations show a
requirement of 123 off-street parking spaces for the restaurant, and 2 for the office building. I
am told the TRC recommended a 20% reduction per the LDR's, but the applicant did not take
that to the city council to my recollection. With such reduction, we ould require 98 off-street
spaces for the restaurant, and 34 for the office, for a total of 132 spa es.
The parking analysis provided by the applicant appe s to indicate the provision of
102 total off-street spaces for both business', 30 spaces less than LD requirements. I question
the conclusions made in the study in several respects:
a. The urban land institute chart indicates that peak: re taurant use would be 7 to 9
p.m., with virtually no activity ITom 7 to 9 a.m., which does not ap to be realistic.
b. The ULI finding that by using shared parking, the Ice building requires only
3 off-street spaces, is again unrealistic.
c. I do not agree that the two uses do not coincide in urs of demand, except after
5 :00 p.m. when the office would be likely closed.
Since the applicant owns the entire block, and the exi . g commercial structure
appears to have an excess of parking spaces, I would agree a few of ose spaces may be able to
be counted towards their total requirement in phase I & II.
Since the TRC cannot grant parking exceptions, I wo d suggest the applicant set
the matter before the city council with their report and this boards ree mmendations.
