Technical Review Committee Meeting - Joe Boyd, Chairperson. In Chairperson Boyd's absence, Jim LaRue called the February 16, 2005 Technical Review Committee meeting to order at 10:00 a,m, .1. Chairperson and Staff Attendance· Chairperson Boyd. Each member stated their name and organization they are representing for the record, Voting Members: Joe Boyd, City Building Official Absent Bill Veach, City Administrator Present Denny Davis, Police Chief Absent Donnie Robertson, Public Works Director Present Jim LaRue, LaRue Planning and Management Services Present Herb Smith, Fire Chief Present Oscar Bermudez, City Engineer Present Katrina Cook, General Services Coordinator Present Non-Voting Ex-Officio Members: Eddie Trent, Okeechobee County Health Department Absent John Cook, City Attorney Absent L.C. Fortn III. New Business. A. Court Plaza, CBC Management, Inc, is the property owner, Thomas C, Close is the Jim LaRue, City Planning Consultant, explained that since the last meeting where Court Plaza was considered, applicant, Vikki Aaron is representing the applicant. The applicant is proposing to the City has received a revised parking study and a revised site plan, Mr. LaRue explained that the City is now develop a two phase project consisting of a restaurant in phase one and office buildings considering Phase One, Two, and Three all together, in phase two. The subject property is located in the 300 Block of North Parrott Avenue, This site plan was previously considered on October 20, 2004 and December 15, 2004 City Engineer, Oscar Bermudez, explained that he still had concerns with the parking, He stated that Mr, and the applicants were requested to submit revised drawings. Close, Mr. Lightsey (owner of proposed restaurant), and Attorney Cook need to get together to create an agreement to allow shared parking. He also recommended that the proposed uses and hours of operation for the restaurant be included in the agreement. Court Plaza, continued, Chris Close, applicant, requested that the parking study information be tied into the agreement. Jim LaRue agreed with Mr, Close's request. The agreement should include hours of operation for the proposed uses within the restaurant, a listing of the uses that will be allowed, phase two and three of the project, and a listing of the uses that will not be permitted in phase two and three of the project due to the intensity. . Bill Veach, City Administrator, requested that a draft of the agreement be completed and provided to the City Council when they consider the parking reduction request. Jim LaRue, City Planning Consultant, stated that the agreement will need to be very detailed, This request is not to hurt Mr, Close or the proposed development, but to give him guidelines to follow, Herb Smith, Fire Chief, briefly discussed the fire department connection with Mr. Close, Bill Veach, City Administrator, questioned Mr, Fortner whether a sewer capacity reservation will be required, Mr. Fortner explained that this project should be okay without one, Oscar Bermudez motioned to recommend to City Council to approve the twenty percent reduction of parking request subject to an agreement being drafted by Attorney Cook specifically related to the shared parking, hours of operation for the proposed used within the restaurant, listin of the ermitted u an ree 0 t e project, listing of the uses that will not be permitted within phase two and three; seconded by Donnie Robertson, VOTE BERMUDEZ - YEA BOYD - ABSENT DAVIS - ABSENT LARuE - YEA ROBERTSON - YEA SMITH - YEA VEACH - YEA MOTION CARRIED. John Whidden, owner of Whidden Enterprises, Inc., is Oscar Bermudez, City Engineer, explained that this project has had a problem with parking since the the property owner and applicant. The applicant is proposing to change an existing beginning and Mr, Whidden has been working with the City to resolve the problem, Mr. Whidden has come 1300 square foot pawn shop into a 48 seat restaurant. The applicant is planning to before us to resolve the parking problem. He has received permission from Chris and Gail Newman to use utilize the same building with modifications to existing paved parking. The five parking spaces at their un-occupied commercial building located next door to the proposed restaurant. applicant is requesting a twenty percent reduction to the parking space There is no landscaping plan provided, however Mr, Bermudez recommended the applicant to place some requirements. trees around the property line, and some shrubs in the front of the building, . LC Fortner, Okeechobee Utility Authority, explained that there is existing water and sewer at this location, however, the applicant will need to install a grease trap, Herb Smith, Fire Chief, questioned the amount of square footage of where the occupants will be seated, the type of seating that will be provided, amount of exits, and whether a hood system will be installed, John Whidden, applicant, explained that the occupants will be using approximately 800 square feet for seating purposes. There will be fixed benches, two tables, and eight bar stools for seating, There will be an entrance, an exit, and a kitchen delivery door. Mr, Whidden explained that a hood system will be installed and there will be two to three fryers, an oven, and a grill all located under the hood system, Jim LaRue, City Planning Consultant explained that a reduction of parking request usually requires a parking study to be submitted. A landscape plan will also need to be provided. Mr. LaRue also questioned whether the Newman's were using the five parking spaces that the are donatin to ? Mr, Whidden explained that he is proposing to use every available square foot for parking, there was no plan to put landscaping within the parking lot. Mr, Whidden continued by explaining that the Newman's were not using any of the five parking spaces at this time, so they will be used for his restaurant only, Donnie Robertson, Public Works Director, explained that Mr, Whidden will be required to obtain a Use of Alley Agreement to utilize the alley as ingress and egress to the parking lot. Jim LaRue explained that it will be hard to provide additional parking as you get more popular, Mr, LaRue again noted the following concerns for the record: twenty percent reduction of parking granted by City Council; parking study showing that the reduction can be supported; alley use agreement; on-street parallel spots approved by Public Works Department; variance request approved to allow backing onto street; landscaping plan provided; and developers agreement permitting shared parking, John Whidden explained that the area has a lot of surrounding on-street parking within walking distance, . Herb Smith, Fire Chief, noted that this parking situation is better than the parking situation at Pizza Heaven, Bill Veach explained that since one restaurant has a bad parking situation, why create another one? Mr, Veach explained that this is a tough situation, and questioned Mr, LaRue whether the obstacles could be overcome, Jim LaRue explained that a landscape plan is possible to overcome, The code specifically allows for an alternate landscape plan if the regular landscaping requirements are unable to be met. John Whidden explained that some landscaping could be provided by the dumpster, by the fire hydrant, and on the eastern side of the handicap parking space. Jim LaRue explained to the applicant that the en ineer has d oca lon, owever he is concerned with the impact that a restaurant will have at this location, Mr, LaRue recommended to wait and see how the variance goes next week therefore not recommending approval for the twenty percent parking reduction request at this time, During the next week or so work on obtaining a use of alley agreement, obtain someone to do an alternate landscape plan, and work with Attorney Cook to get a Developer's Agreement for the shared parking, John Whidden questioned the amount of landscaping that would be required? He asked if potted plants would qualify as landscaping?
