City Attorney Cook advised the Committee to recommend to the City Council to approve a twenty percent
parking reduction for the off-street parking requirements. If the City Council approves the request, Mr. Maxwell
There was a brief discussion between Mr. Maxwell and the City staff regarding the reduction request. City
Engineer Bermudez recommended that Mr. Maxwell hire an Engineer or Architect to create a Site Plan to
show the amount of space that is available for an access to, as well as for the actual on-site parking spaces.

Maxwell are the property owners and applicants. Mr. and Mrs. Maxwell are requesting
a reduction of on-site parking space requirements at the proposed professional office,
located within a Commercial Professional Office (CPO) zoning district.
Jim LaRue, City Planning Consultant, submitted a memo to the City regarding the request of parking
reduction since he was unable to attend the meeting. The memo explained that in viewing Ordinance No.
815 and section 90-485 of the City's LOR there is a limit to using street parking. Since this property is in a
CPO zoning district street parking space requirements cannot be reduced more than 20%. Therefore a
request of no off-street parking cannot be recommended.

STATEMENT OF SPECIAL REASONS AND BASIS FOR REOUEST
The applicant is seeking a variance from LDR 90-512 Space Regt,llations which requires three
parking spaces to be provided on site. A literal enforcement ofthis provision would be impossible
given the physical characteristics of the property and its structures. Enforcement would result in an
unnecessary hardship because there is not sufficient area to install the required parking spaces.
The subject parcel is located at 405 NW 3rd Street and is made up of a single fifty foot wide
lot. There is a structure on the property that was built in 1935 with a front setback of only 16' 6".
There is not room in the front of the building to construct parking spaces.
The structure is 24' 3" wide and has left and right setbacks of 10' 9" and 14' 4" respectively.
There is not room alongside the building to access the rear portion of the lot behind the building.
There is sufficient on street parking on the south side ofNW 3rd Street to accommodate the
number of parking spaces required by ordinance for both the subject parcel and the adjacent parcel
to the east, used by Atlantic Reporting. The lot adjacent to the West is vacant.
The alley to the south of the property is not a suitable means of ingress to the property
because the east half of the alley is closed and the open portion is a narrow, unpaved area bordered
closely by a retention pond and foliage.
The special conditions which exist which are peculiar to this parcel and structure are that it
is one of the only developed single lot parcels in the area. The size and location of the structure
which was built nearly 70 years ago will not permit compliance with the current space regulations
ordinance.
