Chairperson Boyd called the December 17, 2003 Technical Review Committee meeting to order at 10:03 a.m. II. Chairperson and Staff Attendance - Chairperson Boyd. Each staff member stated their name and the organization they are representing for the record. New Business, continued. B. Buxton's Funeral Home, located at 110 N.E. 5th Street. Paul Buxton is the Steve Cooper, project Engineer, briefly explained the overview ofthe project. He also stated that property owner, Chris Close is the representative. Mr. Buxton is planning a two Mr. Buxton plans to abandon existing septic tank, and Mr. Cooper is working with the Okeechobee phase project. Phase one includes the construction of a metal building. Phase Utility Authority to meet their requirements. two will include a building addition and site work. Kelly Hill, representative of LaRue Planning and Management, reviewed the Staff Report with the Committee. Mr. Hill is recommending denial of the site plan due to the following: 1. Parking spaces are only 18' x 9' and the required is 20' x 9' C 2. Dumpster location needs to be moved so the dump truck is not backing out onto NE 2na Avenue 3. Parking or loading area East of new building backs onto NE 2nd Avenue in violation of Section 90-511 (e)(2) Mr. Hill also mentioned that the existing overhang and driveway where the hearses pull in to load the caskets, is in the middle of the City Right of Way. Mr. Cooper explained that they are trying to make a bad condition better, they are creating a new parking lot so the people don't have to park in the roadway. He will be getting a letter from Waste Management stating that the dumpster location is okay. The parking spaces will be made 20' x 9' by removing 2 feet from the 5 foot sidewalk, and adding that two feet to the parking spaces and adding the parking stops. Mr. Cooper explained that the overhang and driveway are an existing condition. Chris Close, representative of the applicant, briefly explaining the area of the property and the proposed new route for the hearses. Mr. Hill explained that the Code does not allow any vehicle to back into a City street, and that possibly creating a circular type driveway would eliminate the problem by not giving the drivers an option of backing into the Street. Mr. Close stated he would re-evaluate the plans to see if the circular drive would work. I-IilI explained to Mr. Cooper that when you improve an existing building, you have to bring it up to Code. Oscar Bermudez, City Engineer, explained that bringing a building up to Code means including drainage, parking, setbacks, and correcting any Code violations. Buxton's Funeral Home, continued. Mr. Cooper stated that he and Mr. Close will look at it to see what they can do. Keith Tomey, Fire Chief, stated that the only concern he had was already addressed, and that was getting permission from Waste Management allowing the dumpster location to remain as is. City Attorney, John Cook, stated that he and Oscar had discussed the project, and his only concern was the Right of Way issue. City Engineer, Oscar Bermudez, stated that the applicants need a permit from DEP, and to meet the Okeechobee Utility Authority's requirements for the pipe and force main. He is also requesting that the City Right of Way be vacated. Public Works Director, Donnie Robertson, and City Police Chief, Denny Davis, had no comments at this time. City Administrator, Bill Veach, stated that he had no comments other than agreeing with Oscar and City Attorney's comments. L.C. Former, Okeechobee Utility Authority, stated that no one would be responsible for maintaining, locates, or fixing the broken pipes due to being in the City Right of Way. The lift station belongs to Mr. Buxton, the force main from Buxton's to Okeechobee Utility Authority's main will not be maintained. Mr. Cooper said that they tried to work with the Bank, but were unable to do so. He then said that possibly Mr. Buxton would put in the lift station, and 4 inch force main, then dedicate it to the Okeechobee Utility Authority for them to be responsible for it. Mr. Boyd stated that it is very important for the City not to be responsible for the force main. City Attorney, John Cook, stated that he could draw up documents to release the City from any liability, and hold Mr. Buxton liable. Mr. Bermudez reminded the Committee that they would also need a permit from D.E.P. Mr. Cooper stated that they would change the specifications to a 4 inch main to meet the Okeechobee Utility Authority's requirements. Mr. Boyd stated for Mr. Cooper to make the required changes to the Site Plan, and submit the required paperwork for departmental review. COMMITTEE - PAGE 4 OF 7 III. New Business, continued. B. Buxton's Funeral Home, continued. Close asked if they change the Site Plan as soon as possible, could they start building the metal building before receiving the DOT permit for drainage. Mr. Boyd stated that yes they could, however there will be a contingency that a Certificate of Occupancy or power would not be released until receipt of the DOT permit. Keith Tomey, City Fire Chief, motioned to approve the Final Site Plan for Buxton's Funeral Home, based on the following items being corrected: C 1. Change the proposed 18' x 9' parking spaces to 20' x 9' 2. Letter from Waste Management submitted to the City, giving their approval on the dumpster location 3. Correct the Site Plan to show that the hearses will not be backing onto NE 2"d Avenue 4. Vacating the City Right of Way 5. D.E.P permit 6. D.O.T permit for drainage 7. Agreement with the City, that City is not liable for the force main in City Right of Way The motion was seconded by Denny Davis, City Police Chief. Keith Tomey, City Fire Chief, said that the only issue that he saw was there was no durnpster pad on the Site Plan. Oscar Bermudez, City Engineer, stated that he had an issue with the force main. There are three projects going in around that area Buxton's Funeral Home, Big Lake National Bank, and Bartel's Optometry, possibly they could all tie in together. Mr. Bermudez is also recommending to remove the entrance on NE 6th Street. Mr. Tomey then stated that if the entrance on NE 6th Street was removed, his Fire Trucks could not get in and out as easily if there were an emergency. Instead of simply driving through, the Fire Truck would have to back out onto North Pan'oR. That is a dangerous situation for both the Firefighters, patients to the Doctor's office, as well as traffic heading north on Parrott. Mr. Bermudez agreed with Mr. Tomey. Mr. Bermudez also addressed there needed to be a sidewalk on NE 6th Street. Donnie Robertson, Public Works Director, Denny Davis, Police Chief, and Bill Veach, City Administrator, had no comments at this time. JeffKennedy, Engineer of the project, stated that they are in the same situation as Buxton's Funeral Home with the force main issue. The Doctor's office will not produce enough waste for the four inch force main to pump but possibly once a day, that could cause an odor issue. City Administrator Veach stated that the four inch force main was required by the City. Keith Tomey made a motion to approve the Site Plan of Big Lake Eye Care; seconded by Kelly Hill. Douglas Fitness Club, located on south side ofN.W. 2"a Street, between N.W. 9a Kelly Hill, representative of LaRue Planning and Management, stated that a letter must be and l0th Avenue. Dr. Douglas is planning to build a proposed 7,875 square foot submitted to the City that states that Dr. Douglas's facility will be used as a private fitness club. private fitness club. Dr. Douglas stated that it would not be a problem for him to submit a letter to the City. Keith Tomey, City Fire Chief, questioned if there would be a dumpster. Dr. Douglas explained that at this time he has three garbage cans, and that is the maximum number of cans that a Commercial business can have before upgrading to a dumpster. He feels that a dumpster will be a better choice if or his facility, he will be contacting Waste Management for this. Oscar Bermudez, City Engineer, stated that he agreed with Mr. Hill, and the City needs something in writing addressing the private club issue. Donnie Robertson, City Public Works Director, Denny Davis, Police Chief, and Bill Veach, City Administrator, had no comments at this time. Keith Tomey made a motion to approve the Site Plan for Douglas Fitness Club based on the following criteria: 1. Letter submitted by the applicant stating that this will be a private club ' 2.
