THIS CAUSE came before the Special Magistrate, City of Okeechobee, for public
hearing on March 10 , 20 20. After due notice to the respondent, the Special Magistrate
having heard evidence on the alleged violation by witnesses or affidavit makes the following
findings:
A. FINDINGS OF FACT:
Lots:21 and 22 Blk:15 Section: City of Okeechobee, according to the plat thereof
in Plat Book 5, Page 5, Public records of Okeechobee County, Florida
Parcel: 3-15-37-35-0010-00150-020
Property location: 200 Block Northeast 12th Street
Property owner: Muhammad and Shanaz Nooruddin
B. CONCLUSIONS OF LAW:
The owner of the property described above has been found in violation
of: Chapter 30 Section 30-43 Public Nuisance and Chapter 30 Section
30-44 General Cleaning and Beautification. Property need to be
mowed.
C. ORDER: The City of Okeechobee Code Enforcement Special Magistrate has
determined you have violated the Code of Ordinances Ch 30 Sec 30-43 and 30-44
concerning your property located at 200 Block Northeast 12th Street.
If you do not correct the violation Fourteen (14) Days After Proper Notification , or notify the
Code Enforcement Officer of the correction, the Magistrate imposes a fine of $ 25.00 per
day, Also a onetime fee of 50.00 for administrative fees, commencing that date and continuing
daily until the violation is corrected or the city is notified by you and verifies the correction,
which ever first occurs. Further, if you do not correct the violation by said date, a copy of this
order as a claim of lien, shall be recorded in the office of the Clerk of Circuit Court, Okeechobee
County, Florida, and once recorded, becomes a lien
on real and personal property pursuant to Florida Statute 162. You have a right within thirty
days, to appeal this finding and order by Writ of Certiorari to the Circuit Court, Okeechobee
County, Florida. If you correct the violation prior to the above date, it is your obligation to
contact the Code Enforcement Officer to verify such compliance.

Maintenance Code 304-1 Exterior of Structure must be Maintained and in Good
Condition/Repairs and Must be Structurally Sound) Florida International Property Maintenance
Code. Code Officer Sterling stated that he has been in touch with the owner and they are in the
process of selling the property. They also stated that the repairs will be done, but they need
more time. Due to Officer Sterling's Testimony this case was tabled until the next scheduled
Special Magistrate Hearing.
VI. REPEAT VIOLATIONS
A. There were no repeat violations heard.
VII. NEW CASES
A. Case Number 190925012; Muhammad and Shahnaz Nooruddin 200 Block Northeast 12th
Street, Okeechobee, Florida 34972. [Lots 7,8,9,10,26 and 34 Block 15 City of Okeechobee,
According to the Plat thereof in Plat Book 5, Page 5, Public Records of Okeechobee County,
Florida] (Chapter 30 Section 30-43 Public Nuisance and Chapter 30 Section 30-44 General
Cleaning and Beautification) Code Officer Sterling was sworn in and testified to the following.
The grass on this property has not been mowed since September 2019 and is about 2 to 3
inches high. Officer Sterling stated that he has spoken to Mr. Nooruddin on numerous occasions
and he was going to get the property mowed. As of March 9, 20020 the property had not been
touched. Officer Sterling recommended that Case 190925012 be found in violation and a fine
imposed. Due to Officer Sterling's testimony Special Magistrate Azcona found case 190925012
to be in violation of Chapter 30 Section 30-43 Public Nuisance and Chapter 30 Section 30-44
General Cleaning and Beautification of the City of Okeechobee Ordinances. Magistrate Azcona
imposed a fine of $25.00 a day to start 14 days after proper notification, with a $50.00
Administrative fee.

Regarding Case Number: 190925001 &190925012
Mr. Noorddin,
As you are aware at the March 2020 Special Magistrate Meeting, you were found in violation of Ch 30
Sec 30-43 Public Nuisance and Ch 30 Sec 30-44 General Cleaning & Beautification and Chapter 30-
43 Public Nuisance. The Special Magistrate imposed a fine of $25.00 a day for each property. The
fines of $25.00 a day started on April 2, 2020 and ran until April 13, 2020 at that time you came into
compliance. The balance due for both properties together is $650.00 this includes a onetime fee of
$50.00 for administrative fees on both properties. I would like to get this issue resolved and file a
satisfaction of lien for this property. This has run well over 90 days and I would like to give you a
chance to make a payment before I start the foreclosure process. You can also come before the
Special Magistrate and ask for a fine reduction. We meet every second Tuesday of the month.
You can make a payment at/or mail to the City Police Department at the above address, by a check
or money order made out to the City of Okeechobee. Or you can go to the Okeechobee City Hall
Finance Department.

Beautification) City of Okeechobee Ordinances,
On September 25, 2019; Officer Sterling noticed the property needed to be
mowed and debris removed. We sent a courtesy card, giving the owner 10 days
to come into compliance, but nothing had been done. On December 19, 2019 we
sent through certified mail a Statement of Violation and Notice of Hearing which
was returned Unclaimed. As of January 28, 2020, nothing had been done to the
property. Officer Sterling hand delivered Statement of Violation and Notice of
Hearing on February 4, 2020 as well as posting the property. Officer Sterling
testified that he spoke with the owner of the property and that they would get the
property mowed. Mr. Sterling asked for this case to be tabled until the next
scheduled Special Magistrate Hearing. On February 25, 2020 another Statement
of Hearing was sent out Certified Return Receipt mail and the property was also
posted for the March 10, 2020 Hearing.

Officer Sterling was sworn in and testified that the construction on the above property had come
to a halt after a month. Building Official Jeffery Newell was sworn in and testified the framing of
the roof was under construction, then gave the floor over to the contractor. Mr. Mossel was sworn
in and testified that he is the contractor that was hired to do the roof repairs. Mr. Mossel stated
that the job had come to a halt due to lack of funds. Mossel stated that he would be back on the
job as soon as possible and finish up the roof. Special Magistrate ask Building Official Jeffery
Newell what he would like to see done? Mr. Newell stated he was looking for a time frame as to
when the roof would be completed. Mr. Mossel stated that it should be done in 2 to 3 weeks.
Officer Sterling stated that they needed to make some other improvements on the property as

Chambers. The Magistrate will receive testimony and evidence at said Hearing and shall make findings of fact and
conclusions of law as are supported by the evidence and testimony, and shall make an order thereupon. You are entitled to be
represented by counsel, present evidence, and present testimony. Please be advised that any evidence presented to the
Magistrate for his consideration will be retained by Code Compliance Department. If you fail to appear at the hearing the
Magistrate may enter an Order of Violation, & impose a fine in your absence.
