Whaley is the applicant on behalf of property owner's Ernest and Ella Whaley. The subj ect property is located at 1416 Southwest 3rd Avenue. The purpose for the request is to allow a single family dwelling to be built on a lot, 50 feet wide and 6,650 square feet of area. The minimum lot width requirement is 75 feet and lot area 10,000 square feet (Ref. LDR's Sec. 90-105(1)). Mr. LaRue briefly reviewed the Staff Report as follows: Planning Staff Report Discussion: Staff has determined that the request generally does satisfy the criterial outlined below for granting the variance: (A) The subject property has unique conditions of size and shape which are not applicable to other areas within the RSF-l Zoning District in the City. The lack of width is a major circumstance of uniqueness. Also it appears that contiguous lots to the subject parcel are also 50 feet in width. (B) The size of the lot does not result from the actions of the applicant and it appears that the subject lot has not recently been 54 IV. NEW BUSINESS CONTINUED. A. 3) Consider Petition No. 06-003- V: continued. Planning Staff Report Discussion (B) continued: converted to its substandard width. (C) Literal interpretation of the minimum lot area requirements of 10,000 square feet and minimum lot width of 75 feet would unnecessarily deprive the applicant of rights to build a dwelling on the property. This would create an undue hardship on the applicant and would appear inequitable as other homes next to this lot are built on similar small sized lots. (D) The requested variance of 3,350 square feet would reduce the minimum lot area to 6,650 square feet and the requested variance of 25 feet would reduce the minimum lot width to 50 feet. This would allow the applicant to use the land as proposed. (E) By granting this request the City will not be conferring any special or unique privileges to the applicant that is denied by the Code to other properties in the same Zoning Districts. This variance is not for setbacks or anything but the lot width and minimum size provisions. (F) Granting the variance would be in harmony with the intent and purpose of the Code. The variance would not be injurious to the neighborhood or detrimental to public welfare. Planning Staff Report Recommendation: Staff recommends approval of the request to allow a variance from Section 90-105(a) permitting the applicant to construct a single-family home on a 50-foot wide lot with a total area of 6,650 square feet. It should be noted that this recommenda- tion does not give permission for the location of the proposed house. The proposed site plan as submitted does not meet the RSF-l front setback provisions. Mr. LaRue recapped that this item had been tabled due to a voting tie from the March 28, 2006 meeting. Board Member Maxwell brought to the Boards' attention as he read LDR Section 90-32 (a) and (c). "Development of nonconforming lot. (a) Residential lot in separate ownership. A lot in a residential zoning district which is nonconforming because of insufficient area, which has at least 4,000 square feet and 40 feet frontage, and was in separate ownership on the date of enactment of these regulations, may be used to build a single-family dwelling. (c) Contiguous lots. When three or more vacant nonconforming lots with continuous frontage are in single ownership, they shall be resubdivided in such a manner as will make them conforming lots. If resubdivision to eliminate nonconforming lots is impossible, application shall be made for a variance prior to development of the lots. This subsection shall not apply to contiguous nonconforming lots in single ownership if a majority of the lots on the street or within 500 feet of such lot in the same zoning district are also nonconforming". IV. NEW BUSINESS CONTINUED. . I A. 3) Consider Petition No. 06-003- V: continued. I B. Consider Petition No. 06-003-SE: Ted Kelchner is the applicant on behalf of property owner K Builders, Inc. The subject property is located at 1306 Southwest 2nd A venue. The purpose for the request is to allow a metal enclosed storage building within a Light Commercial Zoning District (Ref. LDR' s Sec. 90- 253(11)). I Board Member Burroughs motioned to approve Petition No. 06-003-V, submitted by Randy G. Whaley on behalf of property owners Ernest and Ella Whaley, to allow a single family dwelling to be built on a lot, 50 feet wide and 6,650 square feet of area; seconded by Board Member Maxwell. (Note for clarification: due to information provided by Mr. Maxwell as discussed above, this motion is not necessary since a variance is not needed). VOTE HOOVER - NAY KELLER - NAY LEDFERD - YEA MAxWELL - YEA McCOY - NAY BURROUGHS-YEA JOHNS-YEA MOTION CARRIED. Mr. LaRue briefly reviewed the Staff Report as follows: Planning Staff Report Discussion: (A) The enclosed storage for the professional office is not contrary to the Comprehensive Plan. (B) Section 90-253(11) of the Land Development code included enclosed storage as a special exception use. (C) A service will be provided as this is for storage. (D) The use is appropriate and compatible with adjacent uses. It should be determined whether or not separate parking should be allocated for the storage facility. It is assumed that the shed is for internal use only, not for a separate commercial/storage use which would require separate parking. (E) This use will not be a deterrent if the property is properly landscaped. (F) This is a possibility, but the location as shown probably does not require this precaution. (G) Density is not an issue. (H) Public safety will not be an issue. Planning Staff Report Recommendation: Based on the above Special Exception findings and on the condition that the storage is restricted for owner use only, the request should be approved. Should there be any aesthetic requirements for this storage facility, they can be imposed as conditions of approval. There was a brief discussion. .:)(0 IV. NEW BUSINESS CONTINUED. B. Consider Petition No. 06-003-SE continued. c. Consider Petition No. 06-004-SE: Malissa Morgan is the applicant on behalf of property owner A Child's World Childcare and Preschool, Inc. The subject property is located at 702 and 704 Southwest 7th A venue. The purpose for the request is to allow a Day Care Center within a Residential Multiple Family Zoning District (Ref. LDR's Sec. 90-193(4)). Board Member Maxwell moved to approve Petition No. 06-003-SE submitted by Ted Kelchner on behalf of property owner K Builders, Inc. to allow a metal enclosed storage building within a Light Commercial Zoning District (Ref. LDR's Sec. 90-253(11)), with the special conditions that the storage building be used for applicants use only and landscaping be added; seconded by Board Member McCoy. Mr. LaRue briefly reviewed the Staff Report as follows: Planning Staff Report Discussion: (A) Should the applicant's request for the RMF Zoning be approved, then the proposed use would not be contrary to the Comprehensive Plan requirements. (B) Section 90-193(4) allows a day care center as a Special Exception use in the proposed RMF Zoning District. (C) Public interest will not be adversely affected by this day-care facility as it will provide needed services to the community. (D) The use is appropriate for the proposed location and will provide reasonable compatibility with adjacent uses. The property is bordered on two sides by residential uses with a public school across the street. The proposed special exception use will relate well with surrounding land uses. (E) The proposed use will not adversely affect adjacent property. (F) The property must meet the City's landscaping requirements to provide suitable buffering. (G) The proposed use is not expected overburden facilities. (H) Staff does not view this is an issue because traffic flow will be based on ingress/egress and the hours of operation. Planning Staff Report Recommendation: Based on the findings contained in this report it is recommended for approval. It shall also be a condition of approval that the parking for employees and drop-off be approved by the City Engineer. IV. NEW BUSINESS CONTINUED. I C Consider Petition No. 06-004-SE continued. I D. Consider Petition No. 06-005-SE: Robert Dudley is the applicant on behalf of property owner Park Tire Land Revocable Trust. The subject property is located at415 East North Park Street. The purpose for the request is to allow mechanical and repair services within a Heavy Commercial Zoning District (Ref. LDR' s Sec. 90-283(7)). I Mrs. Malissa Morgan, applicant on behalf of A Child's World Childcare and Preschool, Inc. was present. There was a brief discussion. Board Member Hoover motioned to approve Petition No. 06-004-SE submitted by Malissa Morgan on behalf of property owner, A Child's Wodd Childcare and Preschool, Inc. to allow a Day Care Center within a Residential Multiple Family Zoning District (Ref. LDR's Sec. 90-193(4)) with the special conditions of the approval of the Small Scale and Rezoning applications; seconded by Board Member Maxwell. VOTE HOOVER - YEA KELLER - YEA LEDFERD - YEA MAXWELL - YEA McCoy - YEA BURROUGHS-YEA JOHNS - YEA MOTION CARRIED. Mr. LaRue briefly reviewed the Staff Report as follows: Planning Staff Report Discussion: (A) An auto service and repair shop of the type requested is not contrary to the Commercial Future Land Use category. (B) This use is authorized under Section 90-283(2) and (7) as a special exception in the CHV Zoning District. (C) The proposed use is limited in terms of impact and a Tire Sales and Service Center will not have an adverse impact on the public interest. (D) The use is appropriate for this existing building as it was originally designed for a similar use. It is also within an intensive commercial neighborhood. (E) This use is compatible with adjacent properties as long as the tire sales and related services are done within a building and not in the open. (F) Since this is a use within an existing building buffering may be limited. However, landscaping would lessen the impact and should be provided. IV. NEW BUSINESS CONTINUED. D Consider Petition No. 06-005-SE continued. Planning Staff Report Discussion continued: (G) Not applicable. (H) This special exception, if limited, should not have a negative traffic impact. It is important to have defined ingress/egress and parking delineated for customers and employees. It appears that the existing building has been enclosed since it was established as a car dealership, limiting parking in the front. Lack of parking and access must be improved to service the public properly. Based on the report [mdings staff recommends approval subject to: (1) parking to be provided for customers and employees. A Site Plan illustrating this must be approved by City Staff. (2) No body work or heavy engine repair. (3) Landscaping to be included as a part of the Site Plan for this Special Exception. Mr. Robert Dudley, applicant, and Mr. Tom Elmore, previous owner were present. Mr. Elmore gave the history of businesses at this location and informed that there was not a problem with parking and traffic off of State Road 70 in the past. Chairperson Ledfered also spoke of the past stores being busy and not recalling a problem with parking or traffic. Board Member McCoy suggested that the owner keep the business attractive and inquired about overnight parking and chemical storage. Mr. Dudley replied that should any cars be kept overnight they would be kept inside the building and also all chemical storing will be inside of the building. Board Member Maxwell cautioned the board to use discretion with their decision since in a previous situation they had declined an auto sales petition located west of this property because of appearance. Board Member Hoover replied that in the previous situation there was also a parking issue as well. Board Member Juarez mentioned his concern of traffic and after a brief discussion the Board suggested that the applicant use State Road 70 for entrance only. There was a brief discussion. Board Member McCoy motioned to approve Petition No. 06-005-SE submitted by Robert Dudley on behalf of property owner Park Tire Land Revocable Trust to allow mechanical and repair I services within a Heavy Commercial Zoning District (Ref. LDR' s Sec. 90-283 (7)) with the special . conditions that there be no egress on to North Park Street East (State Road 70), ingress is permitted, no overnight parking allowed and all chemicals be stored inside the building; seconded by Board Member Hoover. 9 IV. Staff Report Findings: (A) An auto service and repair shop of the type requested is notcontrary to the Commercial Future Land Use category. (B) This use is authorized under Section 90-283(2) and (7) as a special exception in the CHV Zoning District. (C) The proposed use is limited in terms of impact and a Tire Sales and Service Center will not have an adverse impact on the public interest. (D) The use is appropriate for this existing building as it was originally designed for a similar use. It is also within an intensive commercial neighborhood. (E) This use is compatible with adjacent properties as long as the tire sales and related services are done within a building and not in the open. (F) Since this is a use within an existing building buffering may be limited. However, landscaping would ~en the impact and should be provided. (G) Not applicable. (D) This special exception\.lVlimited, should not have a negative traffic impact. It is important to have defined ingress/egress and parking delineated for customers and employees. It appears that the existing building has been enclosed since it was established as a car dealership, limiting parking in the front. Lack of parking and access must be improved to service the public properly. Based on the report findings staff recommends approval subject to: (1) parking to be provided for customers and employees. A Site Plan illustrating this must be approved by City Staff. (2) No body work or heavy engine repair. (3) Landscaping to be included as a part of the Site Plan for this Special Exception. ~\ . Petitions 06-o04-SSA and 06-o03-R and Special Exception Request City of Okeechobee Pursuant to our recent conversations, please find attached information intended to supplement the above-referenced applications. Attached to this letter are: · A Conceptual Site Plan for the proposed childcare facility expansion. This site plan is to be included in the forthcoming Application for Special Exception, but is also intended to supplement the petitions currently under review. · A Preliminary Traffic Impact Assessment. The calculations were based on data provided in the Institute of Traffic Engineers (ITE) Trip Generation Manual, as noted in the calculations. It is noted that the peak hour volumes equate to one full vehicle trip (entering and exiting) every 2.25 minutes. It is not believed that this volume will create a significant impact on adjacent roads. Thank you in advance for your continued assistance in this matter.
