property owner's Ernest and Ella Whaley. The subj ect property is located at 1416
Southwest 3rd Avenue. The purpose for the request is to allow a single family
dwelling to be built on a lot, 50 feet wide and 6,650 square feet of area. The
minimum lot width requirement is 75 feet and lot area 10,000 square feet (Ref.
LDR's Sec. 90-105(1)).

Mr. LaRue briefly reviewed the Staff Report as follows:
Planning Staff Report Discussion: Staff has determined that the request generally does satisfy
the criterial outlined below for granting the variance: (A) The subject property has unique
conditions of size and shape which are not applicable to other areas within the RSF-l Zoning
District in the City. The lack of width is a major circumstance of uniqueness. Also it appears that
contiguous lots to the subject parcel are also 50 feet in width. (B) The size of the lot does not
result from the actions of the applicant and it appears that the subject lot has not recently been

Planning Staff Report Discussion (B) continued: converted to its substandard width. (C)
Literal interpretation of the minimum lot area requirements of 10,000 square feet and minimum
lot width of 75 feet would unnecessarily deprive the applicant of rights to build a dwelling on the
property. This would create an undue hardship on the applicant and would appear inequitable as
other homes next to this lot are built on similar small sized lots. (D) The requested variance of
3,350 square feet would reduce the minimum lot area to 6,650 square feet and the requested
variance of 25 feet would reduce the minimum lot width to 50 feet. This would allow the applicant
to use the land as proposed. (E) By granting this request the City will not be conferring any
special or unique privileges to the applicant that is denied by the Code to other properties in the
same Zoning Districts. This variance is not for setbacks or anything but the lot width and
minimum size provisions. (F) Granting the variance would be in harmony with the intent and
purpose of the Code. The variance would not be injurious to the neighborhood or detrimental to
public welfare.
Planning Staff Report Recommendation: Staff recommends approval of the request to allow
a variance from Section 90-105(a) permitting the applicant to construct a single-family home on
a 50-foot wide lot with a total area of 6,650 square feet. It should be noted that this recommenda-
tion does not give permission for the location of the proposed house. The proposed site plan as
submitted does not meet the RSF-l front setback provisions.
Mr. LaRue recapped that this item had been tabled due to a voting tie from the March 28, 2006
meeting.
Board Member Maxwell brought to the Boards' attention as he read LDR Section 90-32 (a) and
(c). "Development of nonconforming lot. (a) Residential lot in separate ownership. A lot in a
residential zoning district which is nonconforming because of insufficient area, which has at least
4,000 square feet and 40 feet frontage, and was in separate ownership on the date of enactment of
these regulations, may be used to build a single-family dwelling. (c) Contiguous lots. When three
or more vacant nonconforming lots with continuous frontage are in single ownership, they shall
be resubdivided in such a manner as will make them conforming lots. If resubdivision to eliminate
nonconforming lots is impossible, application shall be made for a variance prior to development
of the lots. This subsection shall not apply to contiguous nonconforming lots in single ownership
if a majority of the lots on the street or within 500 feet of such lot in the same zoning district are
also nonconforming".

property owner K Builders, Inc. The subject property is located at 1306
Southwest 2nd A venue. The purpose for the request is to allow a metal enclosed
storage building within a Light Commercial Zoning District (Ref. LDR' s Sec. 90-
253(11)).

Mr. LaRue briefly reviewed the Staff Report as follows:
Planning Staff Report Discussion: (A) The enclosed storage for the professional office is not
contrary to the Comprehensive Plan. (B) Section 90-253(11) of the Land Development code
included enclosed storage as a special exception use. (C) A service will be provided as this is for
storage. (D) The use is appropriate and compatible with adjacent uses. It should be determined
whether or not separate parking should be allocated for the storage facility. It is assumed that the
shed is for internal use only, not for a separate commercial/storage use which would require
separate parking. (E) This use will not be a deterrent if the property is properly landscaped. (F)
This is a possibility, but the location as shown probably does not require this precaution. (G)
Density is not an issue. (H) Public safety will not be an issue.
Planning Staff Report Recommendation: Based on the above Special Exception findings and
on the condition that the storage is restricted for owner use only, the request should be approved.
Should there be any aesthetic requirements for this storage facility, they can be imposed as
conditions of approval.

Consider Petition No. 06-004-SE: Malissa Morgan is the applicant on behalf of
property owner A Child's World Childcare and Preschool, Inc. The subject
property is located at 702 and 704 Southwest 7th A venue. The purpose for the
request is to allow a Day Care Center within a Residential Multiple Family
Zoning District (Ref. LDR's Sec. 90-193(4)).
Board Member Maxwell moved to approve Petition No. 06-003-SE submitted by Ted Kelchner
on behalf of property owner K Builders, Inc. to allow a metal enclosed storage building within a
Light Commercial Zoning District (Ref. LDR's Sec. 90-253(11)), with the special conditions that
the storage building be used for applicants use only and landscaping be added; seconded by Board
Member McCoy.

Mr. LaRue briefly reviewed the Staff Report as follows:
Planning Staff Report Discussion: (A) Should the applicant's request for the RMF Zoning be
approved, then the proposed use would not be contrary to the Comprehensive Plan requirements.
(B) Section 90-193(4) allows a day care center as a Special Exception use in the proposed RMF
Zoning District. (C) Public interest will not be adversely affected by this day-care facility as it
will provide needed services to the community. (D) The use is appropriate for the proposed
location and will provide reasonable compatibility with adjacent uses. The property is bordered
on two sides by residential uses with a public school across the street. The proposed special
exception use will relate well with surrounding land uses. (E) The proposed use will not adversely
affect adjacent property. (F) The property must meet the City's landscaping requirements to
provide suitable buffering. (G) The proposed use is not expected overburden facilities. (H) Staff
does not view this is an issue because traffic flow will be based on ingress/egress and the hours of
operation.
Planning Staff Report Recommendation: Based on the findings contained in this report it is
recommended for approval. It shall also be a condition of approval that the parking for employees
and drop-off be approved by the City Engineer.

Consider Petition No. 06-005-SE: Robert Dudley is the applicant on behalf of
property owner Park Tire Land Revocable Trust. The subject property is located
at415 East North Park Street. The purpose for the request is to allow mechanical
and repair services within a Heavy Commercial Zoning District (Ref. LDR' s Sec.
90-283(7)).

Board Member Hoover motioned to approve Petition No. 06-004-SE submitted by Malissa Morgan
on behalf of property owner, A Child's Wodd Childcare and Preschool, Inc. to allow a Day Care
Center within a Residential Multiple Family Zoning District (Ref. LDR's Sec. 90-193(4)) with the
special conditions of the approval of the Small Scale and Rezoning applications; seconded by
Board Member Maxwell.

Mr. LaRue briefly reviewed the Staff Report as follows:
Planning Staff Report Discussion: (A) An auto service and repair shop of the type requested is
not contrary to the Commercial Future Land Use category. (B) This use is authorized under
Section 90-283(2) and (7) as a special exception in the CHV Zoning District. (C) The proposed
use is limited in terms of impact and a Tire Sales and Service Center will not have an adverse
impact on the public interest. (D) The use is appropriate for this existing building as it was
originally designed for a similar use. It is also within an intensive commercial neighborhood. (E)
This use is compatible with adjacent properties as long as the tire sales and related services are
done within a building and not in the open. (F) Since this is a use within an existing building
buffering may be limited. However, landscaping would lessen the impact and should be provided.

Consider Petition No. 06-005-SE continued.
Planning Staff Report Discussion continued: (G) Not applicable. (H) This special exception,
if limited, should not have a negative traffic impact. It is important to have defined ingress/egress
and parking delineated for customers and employees. It appears that the existing building has been
enclosed since it was established as a car dealership, limiting parking in the front. Lack of parking
and access must be improved to service the public properly.
Based on the report [mdings staff recommends approval subject to: (1) parking to be provided for
customers and employees. A Site Plan illustrating this must be approved by City Staff. (2) No
body work or heavy engine repair. (3) Landscaping to be included as a part of the Site Plan for
this Special Exception.
Mr. Robert Dudley, applicant, and Mr. Tom Elmore, previous owner were present. Mr. Elmore
gave the history of businesses at this location and informed that there was not a problem with
parking and traffic off of State Road 70 in the past. Chairperson Ledfered also spoke of the past
stores being busy and not recalling a problem with parking or traffic. Board Member McCoy
suggested that the owner keep the business attractive and inquired about overnight parking and
chemical storage. Mr. Dudley replied that should any cars be kept overnight they would be kept
inside the building and also all chemical storing will be inside of the building. Board Member
Maxwell cautioned the board to use discretion with their decision since in a previous situation they
had declined an auto sales petition located west of this property because of appearance. Board
Member Hoover replied that in the previous situation there was also a parking issue as well. Board
Member Juarez mentioned his concern of traffic and after a brief discussion the Board suggested
that the applicant use State Road 70 for entrance only. There was a brief discussion.
Board Member McCoy motioned to approve Petition No. 06-005-SE submitted by Robert Dudley
on behalf of property owner Park Tire Land Revocable Trust to allow mechanical and repair I
services within a Heavy Commercial Zoning District (Ref. LDR' s Sec. 90-283 (7)) with the special .
conditions that there be no egress on to North Park Street East (State Road 70), ingress is
permitted, no overnight parking allowed and all chemicals be stored inside the building;
seconded by Board Member Hoover.

requir~~ents to provide suitable buffering. (G) The proposed use is not expected overburden
facilities. (H) Staff does not view this is an issue because traffic flow will be based on
ingress/egress and the hours of operation.
Based 'On the findings contained in this report it is recommended for approval. It shall also be a
condition of approval that the parking for employees and drop-off be approved by the City

Park Street. The purpose for the request is to allow mechanical and repair services within
. a Heavy Commercial Zoning District (Ref. LDR's Sec. 90-283(7)).
Staff Report Findings: (A) An auto service and repair shop of the type requested is notcontrary
to the Commercial Future Land Use category. (B) This use is authorized under Section 90-283(2)
and (7) as a special exception in the CHV Zoning District. (C) The proposed use is limited in
terms of impact and a Tire Sales and Service Center will not have an adverse impact on the
public interest. (D) The use is appropriate for this existing building as it was originally designed
for a similar use. It is also within an intensive commercial neighborhood. (E) This use is
compatible with adjacent properties as long as the tire sales and related services are done within a
building and not in the open. (F) Since this is a use within an existing building buffering may be
limited. However, landscaping would ~en the impact and should be provided. (G) Not
applicable. (D) This special exception\.lVlimited, should not have a negative traffic impact. It is
important to have defined ingress/egress and parking delineated for customers and employees. It
appears that the existing building has been enclosed since it was established as a car dealership,
limiting parking in the front. Lack of parking and access must be improved to service the public
properly.
Based on the report findings staff recommends approval subject to: (1) parking to be provided
for customers and employees. A Site Plan illustrating this must be approved by City Staff. (2)
No body work or heavy engine repair. (3) Landscaping to be included as a part of the Site Plan
for this Special Exception.

Clearing and Grubbing sholl be performed within the limits of the
property In accordance with Section 110, florida Department of
Transportation (FOCH) Speclftcatlons. This shall include, but not
be limited to, the complete removal of all trees, brush, stumps.
roots, grass, weeds, rubbish and other undeslreable m.aterlal, (If
necessary). Upon completion of finished grades, vegetative cover
(seeding or sodding) sholl be employed and maintained until
completion of construction. Erosion control sholl be
accomplished by seeding and mulching. os determined to be
necessary by the contractor, the engineer or the South Florida
Water Mangaement District (SFWMD). Sodding will consist of
Bahia.
All material removed from the site shall be legally disposed of in
accordance with local. state and federal requirements.
THE CONTRACTOR SHALL MAINTAIN ALL STORMWATER ON-SITE
DURING CONSTRUCTION. TO PREVENT DISCHARGE OF TURBID
WATER TO THE RECEIVING SYSTEM. SHOULD SEVERE STORM
EVENTS OCCUR, THAT MAKE CONTAINMENT IMPOSSIBLE, THE
CONTRACTOR SHALL TAKE ALL POSSIBLE STEPS TO PREVENT
DISCHARGE OF TURBID WATER. SOME OF THESE "STEPS"
INCLUDE: INSTALLATION OF SILT FENCE. UTlUZA TlON OF HAY
BALES. CONTAINMENT BERMS AND TREATMENT OF STORM WATER
PONDS WITH ALUM (AS A LAST RESORT). RUNOFF TO FOOT
RIGHT-OF-WAY SHALL BE PREVENTED.
2. Earthwork & GradinQ:
All earthwork and grading shall be performed cs required to
achieve the final grades, typical sections and elevations Indicated
on the plans. In 011 other respects. materials and con struction
methods for earthwork. embankment. excavation and grading
sholl conform to the requIrements of FDOT Specifications, Section
120.
3. PavinQ Improvements:
All areas proposed for paving shall be constructed In
accordancew with the plans and typical section shown herein. In
addition, construction sholl be In accordance with the City of
Okeechobee requirements.
A. ASPHALT: The prime coot and tack coot for base course
and between lifts, shall conform to the requirements of sections
300-1 through 300-7 of the FOOT specifications. Prime coot
shall be applied at a rote of 0.25 gallons per square yard and
tack coot at a rate of 0.10 gallons per square yard. unless
otherwise approved by the engIneer.
Asphalt surface course sholl be one and 1/2" of Type S-3 per
FOOT section 331, with 0 maximum aggregate size of 1/2- and
sholl hove a minimum marshall stability of 1,000 pounds.
Thickness sholl be as specified above for each pavement section.
B. Base: An eight-Inch IImerock base material sholl be
compacted to 98% of maximum density per AASHTO T-180. All
IImeroek-shell sholl meet the minimum requirements of FOOT
Section 911. As on altematlve. cemented coquina conforming to
FOOT Section 915 may be used os 0 substitute, with the some
compaction spclflcotlons described above.
C. SUb-grade: An eight-Inch subgrade sholl be compacted to
98" of maximum density' per AASHTO T -180 and shall be
stabilized to a minimum FBV of 50 PSI. Sub-grade sholl be
thouroughly rolled with 0 pneumatic-tired roller prior to
scheduling any sub-grade Inspection.
D; Sod: A minimum of 0 four-foot wide strip of Bahia sod shall
be plaGed aiong the edge of 011 construction to aide in controlling
erosion and maintaining soli stability. Sod sholl be placed In
conformance with FOOT Section 570. 575 and 981.
E.. Seeding, fertllrzlng and Mulching: All disturbed areas. sholl be
stabilized with seed, fertilizer and mulch upon completion and
acceptance by the Engineer of final grading. Seeding, fertilizer
and mulch shall be used In conformance with FOOT Sections 570,
575 and 981. Hydromulching will be on acceptable method of
providing ground cover, where sod Is not employed. However.
established methods of application must be employed. The
contractor is responsible for establishing 0 stond of grass
sufficient to prevent erosion and to allow ultrmate removal of any
temporary slit fencing deemed necessary by the contractor during
construction. This applies to those areas not covered by sod
(specified above).
4. DRAINAGE IMPROVMENTS:
All labor. materials and construction methods shall be In
conformance to the minimum engineering and construction
standards.
IF REQUIRED, THE CONTRACTOR SHALL COMPLY WITH CHAPTER
90-96. LAWS OF FLORIDA, Vv'HICH REQUIRES THE CONTRACTOR
PERFORMING TRENCH EXCAVATIONS OVER FIVE FEET IN DEPTH TO
COMPLY WITH ALL APPLICABLE TRENCH SAFETY STANDARDS AND
SHORING REQUIREMENTS AS SET FOR1l-l IN 1l-lE OCCUPATIONAL
SAFETY AND HEALTH ADMINISTRATION'S (OSHA) EXCAVATION AND
SAFETY STANDARDS. 29 C.F.R. 19926.650. SUB-PART P AND
INCORPORA TED AS THE ST A IT OF FLORIDA STANDARD. AS REVISED
AND/OR UPDATED. THE COST OF COMPLIANCE WITH THIS
REQUIREMENT SHALL BE INCLUDED AS A SEPARATE LINE ITEM ON
THE CONTRACTOR'S BID. OTHERWISE. THE CONTRACTOR CERTIFIES
THAT THE COST OF COMPLIANCE IS INCLUDED IN THE UNIT COST
OF ALL ITEMS OF WORK, Vv'HICH THIS REQUIREMENT APPLIES.
A; Sufficient cover sholl be provided to conform with FDOT
requirements.
B. Corregated Metal Pipe (CMP /CAP): All CMP, If required, shall
be aluminum olloy, round, helical-wound corregated pipe
conforming to the AASHTO-M 196-74 and FOOT Section 945.
Pipe ends at joints shall be reformed to annular corrugations for
the complete bond width. All joints shall be soil-tlght. All
connecting bonds sholl be corrugated annular coupling bonds. A
Neoprene gasket of at least seven Inches wide by 3/8 inch thick
sholl be used for 011 pipes. All CMP shall be Installed at
maximum lengths to reduce the number of Joints.
C. The 15" diameter access culvert sholl be inspected following
asphalt paving to assure that blockage has not resulted. Any
blockage shaJl be rectified prior to demobflizatlon by the
contractor.
D. Asphalt parking sholl be Installed with finished grades matching
existing gradee. It is intended that 0 smooth transition between
NW 2nd Avenue and the parking slots result. Any confusion
should be cleared up with the engineer of record prlor to
Inltiatlan of actIvity.

EROSION AND SEDIMENT CONTROL NOTES
...............
Construction octlvitl8$ can tesult In the generatlan of significant levels of
pollutants, which may reach surface and/or ground waters. One of the
primary pollutants of surface waters is sediment in erosion. Excessive
quantities of sediment. reaching water bodies, has been shown to adversely
affect the physical. biological and chemical properties of receIving waters.
Transported sediment con obstruct stream channels, reduce the hydraullc
capacity, reduce the conveyance capacity of culverts and other conveyance
facilltes and adversely Impact benthic Invertebrate and fish species through
siltatation. Excessive suspended sediments reduce light penetration and
therefore reduce primary productivity within these receiving systems.
MINIMUM STANDARDS:
1. Sediment basins, perimeter berms. erosIon control borriers and other
msasures, implemented to trap sediment transpart. shall be constructed as
the first step in any land disturbing activity and shall be mode functional
before any land disturbance takes place. .
2. All sediment control measures ore to be adjJsted to meet field
conditions at the time of construction and be constructed prior to any
grading or disturbance of existing surface material. Perimeter sediment
barriers shall be constructed to prevent sediment or trash from flowing,
floating ~r blowing onto adjacent properties.
3. Permanent or temporcry soil stabilization sholl be applied to denuded
areas within seven days after final grade Is reached on any portion of the
site. Temporary soil stabilization shall be applied within seven days to
denuded oreas that may not be at final grade, but will remain undisturbed
for ionger thon 30 days. Permanent stabilization shall be applied to areas
that ore to be left undisturbed for more than one year.
4. During construction of the project. soil stockpiles sholl be stabilized or
protected with sediment trapping measures. The applicant is responsible
for the temporary protection and permanent stabilization of all stockpiles
maintained on-site. os well os, soil intentionally transported from the sIte.
5. A permanent vegetative cover sholl be establlshed on denuded areas. not
otherwise permanently stabilized. Permanent vegetation shall not be
considered established until 0 ground cover Is achieved that, In the opionlon
of the Reviewer. Is uniform. mature enough to survive and will function to
inhibit erosion.
6. Stabmtatlon measures shall be applied to earthen structures such os
dams, perimeter berms, dIkes and dIversions immediately following
Installation .
7. Surface runoff from disturbed areas. that are comprised of flow from
drainage areas greater than or equal to one acre, shall be controlled by 0
sediment basin. The sediment basin shall be designed and constructed to
accomodate the anticipated sediment loading from the disturbed area. The
outfall device or design sholl toke Into account the total drainage area
flowing through the device from the disturbed area.
8. Following any slgnlflcant rainfall event. sediment control structures will be
inspected for integrity and functionality. Any damaged devices sholl be
corrected Immediately.
9. Concentrated runoff shall not flow down cut or fill slopes unless
contained within an adequate temporary or permanent channel or structure.
10. Wnenever water seeps from 0 slope face. adequate drainage or other
effective protection shall be provided.
11. Before swales are made operational, compaction and sodding of
these areas shall be comple~ed in accordance with the plans.
12. Periodic inspection and maintenance. of all sedlnient control
structures must be provided to ensure that the Intended purpose Is
accomplished. The developer. owner and/or conl'rac;tor sholl be
continually responsible for 011 sediment leaving the property. Sediment
control measures shall be in working condition at the end of each
working day.

13. Where construction vehicle access routes Intersect paved public
roods, provisions shall be made to minimize the transport of sediment
by tracking onto paved surfaces. . Areas where sediment Is transported
onto a public rood surfaces sholl be cleaned regularly. Sediment shall
be removed from the roods by shoveling or sweeping with tranport to 0
sediment control disposal area. Street washing shall be allowed. only
after sediment is removed in this manner.
14. All temporary erosion and sediment control measures shall be
remOved within 30 days after final site stabilization or after the
temporary measures are no longer needed, in the opinion of the
reviewer. Disturbed soil areas. resulting from the disposition of
temporary measures, sholl be permanently stabilized to prevent further
erosion and/or sedImentation.
15. Properties and waterways downstream from the construction site
shall be protected from sediment deposition and erosion.
16. Erosion control design and construction shall follow the requirements
in Index No. 101. 102 ond 103 of FOOT Roadway and Traffic Design
Standards.
17. The reviewer moy approve modifications or alter the plans for these
erosion control criteria due to site specific conditions.

Pursuant to our recent conversations, please find attached information intended to
supplement the above-referenced applications. Attached to this letter are:
· A Conceptual Site Plan for the proposed childcare facility expansion. This site plan
is to be included in the forthcoming Application for Special Exception, but is also
intended to supplement the petitions currently under review.
· A Preliminary Traffic Impact Assessment. The calculations were based on data
provided in the Institute of Traffic Engineers (ITE) Trip Generation Manual, as
noted in the calculations. It is noted that the peak hour volumes equate to one full
vehicle trip (entering and exiting) every 2.25 minutes. It is not believed that this
volume will create a significant impact on adjacent roads.
Thank you in advance for your continued assistance in this matter. We hope these
responses have sufficiently satisfied the concerns expressed in previous staff reports on
the project. If, however, any additional minor issues are identified in your review, we would
appreciate the opportunity to meet with you for further discussion, and submit any

I hereby certify under the penalty of law or the revocation of the requested approval sought
that to the best of my knowledge and belief, the attached list constitutes the complete and
accurate list of the property owners, addresses, and parcel identification numbers of all
parcels and tracts within three hundred (300) feet not including intervening streets, alleys,
or waterways, of the perimeter of the lands which are subjects of, or are contiguous to but
held under the same ownership as, the lands subject to the application for a change in land
use or zoning, said list constituting a portion of that application. This affidavit is made
based upon an inspection of the tax rolls of the Property Appraiser of Okeechobee County
