January 7, 2020 Code Enforcement Special Magistrate Hearing — this property was recently
purchased by Mr. David Feltenberger and he has brought the property into compliance. With
foreclosure proceedings having been filed, Magistrate Azcona recommended the fine be
reduced to $661.00 plus the foreclosure filing fee of $400.00 was also to be paid, totaling
$1,061.00 due.

D. A motion was made by Council Member- to approve an Electric Vehicle
Charging Equipment Agreement wit Flgrida Power and Light [as provided in Exhibit
6]; seconded by Council Member j
Terms: 10th anniversary of the date on which commissioning for the Equipment was
completed (initial term). Shall renew on a year-to-year basis after the initial term until the 13th
anniversary. Payment of electricity: City responsible for paying all consumption costs for
electricity dispensed. Charge for Use of Equipment: City agrees that users will be charged
(a) a rate between $0.25 and $0.35 per kilowatt hour for the consumption dispensed from the
equipment and (b) vehicle idling fees after grace period will be $0.40 per minute. Charges
will be collected by a third party provider, and will remit to City all charges collected on a
quarterly basis. On or prior to January 31 of each year, FPL will make a payment -to City equal
to the amount by which the aggregate amount of the City's payments to FPL. Location: East
South Park Street between Southeast 2nd and 3rd Avenues (up to six spaces).

C. Ms. Joyce Bussell addressed the Council regarding the Train Station. Here on my own
behalf, im the kind of person who likes to do what no one elses likes to do. Not being kept
up, its filthy, unsafe, unhealthy, detriment to our town, butterfly garden, median, parks are
beautiful, I notice these things. But the train station, have any other been by there. So
you've seen what I've seen. DW -called last year. JB -I go by the train station, as of today,
it smells cleaned, windows clean, cigarette bins have been cleaned. Chief Peterson got
code enforcement involved and a letter sent to CSX and they have agreed that it will be
cleaned on a routine basis. DW -Amtrak controls that and we've met with him and that's
who we will contact. JB -I met the lady at the time but that was the end of it. Who's been
removing the trash and bushes. DW—they do have a landscape person. Chief -Mr. Walpole
has been taking the trash out but really the responsibility relies on the Amtrak. JB -1 feel
very good about it and it smelled clean when I went by today. Thank you all for your help,
its an asset to the community. DW -thank you for your persistence.

Council discussion: DW -Attorney I guess I didn't quite understand this but under Section
1, the very last sentence is what ties this just to restaurants. I think that's what we were
trying to do.
MDO-the County just did adopt a modified ordinance to not limit.
DW -1 would suggest that this would be more controversial to this. The county did it in two
ordinances. That might be better if they want to do. Another discussion. Atty agreed.
WA -bring back another ordinance?
DW -County passed this ordinance, then at the next meeting past another ordinance to
allow package sales at 10am. They did this one and another one, passed 3 to 2. Have to
have another ordinance with two readings if the council wants to go that way. Cleaner
way to do it under council comments to susggest that.

DW -couple of questions, I asked the police chief in advance. If you notice, I think the
magistrate recommended a fine reduction and the city attorney recommended a waiver
to drop the fine completely. So I guess the motion we have in frton of us, attorney,
recommend fine reduction? If this motion passes, this gentleman would still owe a $279
fine.
JF—yes, representations made that we investigated that did not hold true.
DW -that kind of answers those questions. Contractor rather than individual.
MC -original Case in 2015, back in 2019 same case?
Bob -old cases
MC -what happened in 2019, still in violations? He hasn't paid the fine?
Bob -as of right now property is in compliance, representative has been cooperative.
DW -it was still in violation and it had not been cleaned up.
MC -had not paid fine or not in compliance?
Bob -the property was brought into compliance in 2017 the daily fine stopped, and we're
now cleaning up old cases. He was hard to get a hold of.

DW -this is the property that we've been dealing with forever. House is being remodeled I
see.
Bob -this reduction includes $400 for Foreclosure paperwork.
WA -what happened
DW -the property was sold and the new owner has cleaned up and remodeling completely.
BK -Mr. and Mrs. Feltenberger are in the audience this evening. I certainly like to say night
and day difference. Very welcoming to the neighborhood. And I'd like tosay that initially
the code enforcement fine reduction stuff to 10% of some fine, but after my new neighbors
have done and what they've had to go thru just to be able to do what hes doing, he's had
fines to clear up with FPL, OUA, and whatever else, not just us. So it kind of made me
take a different perspective, its not black and white. Um and I would actually like to
recommend that we bring them down to a flat $500-$600 dollars which covers the court
fees, just knowing what he's had to go through and the other fines from other agencies,
and
DW -normally we accept or deny the magistrate recommendation
JF -establish a record why its being reduced. The Speical Magistrate does not have final
authority.
DW -motion to amend the amount would be in order.
BK -make a motion to amend the fine reduction amount to $600 total; seconded by MC.
BJ -my only feelings on it, I think the code enforcement is really doing a good job, two
major itmes at town hall meeting, code enforcement and speeding. I appreciate what
you're doing in the communciyt. Some of these issues we are talking about tonight and
its taken 3 to 4 years to come into compliance, neighbor may be unhappy, I understand
the situation, but I'm in favor of enforcing the code enforcement. 3 to 4 years is a little
long to let it ride. I just think we should be able to cover the costs we have invested. I
would like to see what the magistrate recommended.
DW -I would tend to agree, I think we have a responsibility to uphold what the magistrate
has recommended, large reduction to begin with, understand and appreciate.

MDO-thank the FPL reps. More innovative in parks, I know that some of you don't know
the term, its something you do have to charge, first one in the county. We did look at the
sights along down town. They have to have something for the person to do per FPL.
South Park west of 441 we already have an issue. Fixing to reduce for ADA parking. We
didn't want to go through there (2nd, 3rd 4th Avenues) because of festivals. We do have
infrastructure at the location, and no one really uses those spots. Agreement pretty
stratight forward. We don't have to pay for infrastructure, etc. it costs us nothing. Being
innovative, more foot traffic this side.
DW -this might put us into the 21St century.

DW -how long to recharge
Anush-fast charging station, not doing many of those sights, one of few in the state. 20 to
30 minuntes to charge
DW -all kinds of cards
Anush-more universal, tesla can purchase an adapter if they want to utilize the station.
DW -tesla has their own; other questions?
MC -are you happy with this location.
Anush-very happy
BK -do people, is there an app to find the closest station? No billboard ads
Anush-theres a couple of different apps, google maps and apple maps are now including
this.
DW -and they do pay for that
Anush-yes
WA -appreciate your interest in coming here; I feel it should be on the West side. Twice a
year, I just feel on the east side of 441 its not going to get that much use.
DW -1 think the problem down there is no left hend turn from the East. People know where
every charging station is. Either way is fine, this is much more accessible coming either
way.
WA -1 don't see the difference from here or the west side
MDO-what spaces will be available the most time throughout the year. Even if you have
a lot of traffic.
BJ -west side complains that there isn't enough parking as it is,
MC -my suggestion is down by the butterfly garden. WE have so much more that side of
the street.
WA -there's not a lot there.

the map will guide them.
WA -there's just no shopping on this side.
DW -these people will walk, they're not like us just kidding.
WA -I know they're there, possible future of development, does that fit into that as well.

BJ -just want to remind everyone TH mtg on 3/11 like everybody there. Also parade coming up very
shortly and a rodeo.

BK -since I wasn't here the last meeting, can I get that time as well. Id like to ask the Administrator, the
LDR comp plan review, are we starting to work on that, or Charter review. MDO-talked to attorney,
moving forward within a week. BK -comp plan next year, id really like to talk about implementing a
moratorium on the rezoning and FLUM change fees, depending on the acreage, those fees that go
along with it are not cheap. We are looking at doing updates, I would like to, whatever the proper lingo
is, I can't remember a time when one of those applications have came before us, wasn't something that
should have already been done. But what about those applications that come before us before then.
MDO-talked to Planner, working on some of the administrative ones. JF -I spoke to hime and that is a
priority on his list, planning decisions being made. In progress. MDO-get back to you about fees. BK -
can I request that be an agenda item to have that discussion. MDO-1 know that the planning board is
having a workshop next month, they can discuss.
