IV. NEW BUSINESS.
A.
Consider Petition No. 06-001-V: Thomas Close is the applicant on behalf of
property owners, CBC Management Corporation. The subject property is located
at 110 Northwest 3rd Street. The purpose for the request is to allow for a rear set
back from 10 feet to 4 feet for a fIre escape stairway within a Heavy Commercial
Zoning District (Ref. LDR's Sec.90-285(2)(a)).
Mr. LaRue briefly reviewed the Staff Report as follows:
Planning Staff Report Discussion: After reviewing this application, Staff has determined that
the request generally does satisfy the criteria outlined below for granting the variance: (A)
Evidently, a second floor of an office building triggers the need for a fITe-escape stairway or the
building could have a sprinkler system. It is difficult to assume that meeting fire code standards
necessitates an automatic setback variance. Since this is a vacant site, it is difficult to see that the
conditions of the variance request can not be resolved by the applicant. (B) The application needs
to demonstrate that no other design or method of meeting fire code standards is possible. Economic
hardship is not sufficient to warrant a variance. (C) Usually, a new building will not be allowed
a four-foot encroachment into the setback area. (D) If the stairwell were allowed in the setback,
it does not appear that the encroachment is excessive. (E) It is difficult to assume that granting
the variance for a new building would not set a precedent. (F) Under normal circumstances such
an encroachment would not be compatible with the City's Land Development Code.
Planning Staff Report Recommendation: Staff recommends denial of the request to allow a
variance from Section 90-285 permitting the applicant to have a setback of four feet (correction
noted on Staff Report which reads six feet) instead of the required 10 feet.
Mr. Robert Cannellos, architect of the project, and Sheryl Wells of Close Construction presented
the plans of the stairway. Ms. Wells remarked that the site had been granted a 20 percent parking
reduction and parking spaces can not be deleted in order to accommodate the stairway.
Board Member Hoover expressed that she did not see the hardship, which must be proven in order
to constitute a Variance, since the building is still under construction.
Ms. Wells remarked that all space has been accounted for and there would be no way to
accommodate for the stairway without the four foot setback granted by the Variance.
The Board discussed at length options of an emergency rescue ladder instead of a stairway. Fire
Chief Smith explained that as far as emergency purposes and handicap accessibility, the stairway
would be more feasible.

Consider Petition No. 06-002-V: Kimberly Anderson is the applicant on behalf
of property owner Clifford Kauffman, Jr. The vacant subject property is located
between 809 and 823 Southeast 8th Street. The purpose for the request is to allow
a single family dwelling to be built on a lot, 70 feet wide. The minimum lot width
requirement is 75 feet (Ref. LDR's Sec. 90-105(1)).
Board Member Maxwell moved to approve Petition No. 06-001- V allowing a rear set back from

RSF-1 Zoning District in the City. (B) The size of the lot does not result from the actions of the
applicaRt nor does it appear that the narrow width is a result from a recent lot split. (C) The literal
interpretation of the minimum lot width of 75 feet would unnecessarily deprive the applicant of
rights to build a dwelling on the property and would create an undue hardship on the applicant.
(D) The requested variance of five feet would reduce the minimum lot width to 70 feet. This
would allow the applicant to use the land as proposed. (E) By granting this request the City will
not be conferring any special or unique privileges to the applicant that is denied by the Code to
other properties in the same Zoning Districts. (F) Granting the variance would be in harmony with
the intent and purpose of the Code. The variance would not be injurious to the neighborhood or
detrimental to public welfare.
Planning Staff Report Recommendation: Staff recommends approval of the request to allow
a five foot variance from Section 90-105(a) permitting the applicant to construct a single-family
home on a 70 foot wide lot.

Consider Petition No. 06-003- V: Randy G. Whaley is the applicant on behalf of
property owners Ernest and Ella Whaley. The subject property is located at 1416
Southwest 3rd A venue. The purpose for the request is to allow a single family
dwelling to be built on a lot, 50 feet wide and 6,650 square feet of area. The
minimum lot width requirement is 75 feet and lot area 10,000 square feet (Ref.
LDR's Sec. 90-105(1)).
Board Member McCoy asked whether this property was sold knowing it would need a variance?
Ms. Kimberly Anderson, prospective owner, answered that should the variance not be granted, she
will not purchase the property. She can not answer on behalf of the current owner, Mr. Kauffman
Jr., as what his intentions are.
Discussion continued. Board Member Hoover moved to approve Petition No. 06-002- V allowing
a single family dwelling to be built on a lot, 70 feet wide; seconded by Board Member Whidden.

conditions of size and shape which are not applicable to other areas within the RSF-l Zoning
District in the City. The lack of width is a major circumstance of uniqueness. Also it appears that
contiguous lots to the subject parcel are also 50 feet in width. (B) The size of the lot does not
result from the actions of the applicant and it appears that the subject lot has not recently been
converted to its substandard width. (C) Literal interpretation of the minimum lot area.
requirements of 10,000 square feet and minimum lot width of 75 feet would unnecessarily deprive,
the applicant of rights to build a dwelling on the property; This would create an undue hardship
on the applicant and would appear inequitable as other homes next to this lot are built on similar

Planning Staff Report Discussion (D) continued: width to 50 feet. This would allow the
applicant to use the land as proposed. (E) By granting this request the City will not be conferring
any special or unique privileges to the applicant that is denied by the Code to other properties in
the same Zoning Districts. This variance is not for setbacks or anything but the lot width and
minimum size provisions. (F) Granting the variance would be in harmony with the intent and
purpose of the Code. The variance would not be injurious to the neighborhood or detrimental to
public welfare.
Planning Staff Report Recommendation: Staff recommends approval of the request to allow
a variance from Section 90-105(a) permitting the applicant to construct a single-family home on
a 50 foot wide lot with a total area of 6,650 square feet. It should be noted that this recommenda-
tion does not give permission for the location of the proposed house. The proposed site plan as
submitted does not meet the RSF-l front setback provisions.
Mr. Randy Whaley spoke on behalf of the applicants, Ernest and Ella Whaley, and remarked that
they are aware that the lot is small, but they are requesting the variance so he may live near parents
to care for them. He has found a house plan which is narrow to fIt on the lot.
Board Member McCoy remarked, there are other vacant 50 foot lots in the area; what size lot will
we stop at to allow variances? Discussion continued.
Board Member Whidden moved to approve Petition No. 06-003- V allowing a single family
dwelling to build on a lot, 50 feet wide and 6, 650 square feet of area; seconded by Board Member
Johns.

Mr. LaRue briefly reviewed the Staff Report as follows:
Planning Staff Report Discussion: (A) A hand car wash and detailing service is not mentioned
in the Comprehensive Plan. If properly located and adequately protected for drainage, parking, etc.
it would not be contrary to the City's comprehensive Plan. (B) The proposed use is specifically
authorized as a special exception use in the zoning district under Section 90-313(2), which
specifically includes auto service stations and car washes. (C) With proper conditions placed on
this special exception, it will not have an adverse effect on the public. (D) If properly screened
and located, this use can be reasonably compatible with adjacent uses. (E) With proper conditions
this use need not be a deterrent to the development of surrounding properties. (F) The car wash
may be required to be screened from surrounding uses to reduce the impact to adjacent uses.
Suggested improvements and landscaping will correct any negati ve impacts for the project and will .
be addressed at the site plan review stage. (G) The use will not create a density pattern that will ,
overburden public facilities. (H) At this time, there are no concerns for this issue. Any that may
arise will be addressed at the site plan review stage.

Consider Petition No. 06-002-SE continued.
Planning Staff Report Recommendation: Ba~d on the above Special Exception fmdings, the
request should be approved. It should be understood that this operation is being conducted at the
applicant's home. The City, if desired, should limit the business at this location to no more than
two cars at one time. If business should increase the applicants will be required to operate only
under the following conditions: (1) A drainage plan should be shown for the car wash area
addressing Health Department and City Engineering concerns and assuring that runoff will be kept
on-site. (2) Limited hours of operation should be established. (3) Landscaping around the car
wash should be shown as buffers from the intersecting street and bordering properties. (4) A site
plan delineating where cars will be worked on, parking plus ingress and egress to the business.
Ms. Inez Shank, property owner, and Mr. James Leal were present and explained to the Board that
they have been in business for ten years. They work by appointment only and there are adequate
drains already at the curbs.
There was a brief discussion on this matter.
Board Member Hoover moved to approve Petition No. 06-002-SE to allow a limited car
wash/detail business within the Commercial Business Zoning District, whereas the Special
Exception applies to the current owner only; seconded by Board Member McCoy.

converted to its substandard width. (C) Literal interpretation of the minimum lot area
requirements of 10,000 square feet and minimum lot width of 75 feet would
unnecessarily deprive the applicant of rights to build a dwelling on the property. This
would create an undue hardship on the applicant and would appear inequitable as other
homes next to this lot are built on similar small sized lots. (D) The requested variance of
3,350 square feet would reduce the minimum lot area to 6,650 square feet and the
requested variance of 25 feet would reduce the minimum lot width to 50 feet. This would
allow the applicant to use the land as proposed. (E) By granting this request the City will
not be conferring any special or unique privileges to the applicant that is denied by the
Code to other properties in the same Zoning Districts. This variance is not for setbacks or
anything but the lot width and minimum size provisions. (F) Granting the variance
would be in harmony with the intent and purpose of the Code. The variance would not be
injurious to the neighborhood or detrimental to public welfare.
Staff recommends approval of the request to allow a variance from Section 90-105(a)
permitting the applicant to construct a single-family home on a 50 foot wide lot with a total
area of 6,650 square feet. It should be noted that this recommendation does not give
permission for the location of the proposed house. The proposed site plan as submitted does
not meet the RSF-1 front setback provisions.

Consider Petition No. 06-002-SE: Inez Shank is the applicant and property owner. The
subject property is located at 300 Southwest 2nd Street. The purpose for the request is to
allow a car wash within the Commercial Business Zoning District (Ref. LDR's Sec. 90-
313(2)).

Staff Report Findings: (A) A hand car wash and detailing service is not mentioned in the
Comprehensive Plan. If properly located and adequately protected for drainage, parking, etc.
it would not be contrary to the City's comprehensive Plan. (B) The proposed use is
specifically authorized as a special exception use in the zoning district under Section 90-
313(2), which specifically includes auto service stations and car washes. (C) With proper
conditions placed on this special exception, it will not have an adverse effect on the public.
(D) If properly screened and located, this use can be reasonably compatible with adjacent
uses. (E) With proper conditions this use need not be a deterrent to the development of
surrounding properties. (F) The car wash may be required to be screened from surrounding
uses to reduce the impact to adjacent uses. Suggested improvements and landscaping will
correct any negative impacts for the project and will be addressed at the site plan review
stage. (G) The use will not create a density pattern that will overburden public facilities.
(H) At this time, there are no concerns for this issue. Any that may arise will be addressed
at the site plan review stage.
Based on the above Special Exception findings, the request should be approved. It should
be understood that this operation is being conducted at the applicant's home. The City, if
desired, should limit the business at this location to no more than two cars at one time. If
business should increase the applicants will be required to operate only under the following
conditions: (1) A drainage plan should be shown for the car wash area addressing Health
Department and City Engineering concerns and assuring that runoff will be kept on-site. (2)
Limited hours of operation should be established. (3) Landscaping around the car wash
should be shown as buffers from the intersecting street and bordering properties. (4) A site
plan delineating where cars will be worked on, parking plus ingress and egress to the
business.

Please accept our application for a variance of four feet within a ten foot set back for the
above referenced parceL
When the building plans were reviewed by the City a request was made for two
additional frre exits - one at the south end of the building ( first floor) and one for the
second story connected to an exterior stairway. When the fire escape stairway is added, it
will encroach within the ten foot setback at the rear of the proposed building.
Due to other set backs and parking requirements, we are unable to move the building
forward four feet. Further, the location of the first floor fire exit would prohibit us from
relocating the exterior stairway on the south end of the building. Therefore, we are
requesting a variance to allow for the installation of the fire escape stairs within the ten
foot easement.

Legal Description:

Introduction:
The applicant is requesting a variance from Section 90-285 of the City of Okeechobee Land
Development Code to allow for a 6-foot setback in the CHV Zoning District, which requires a
10- foot setback.
Background:
The subject property is approximately .488 acres fronting on 3rd Street. The applicant intends to
construct a new commercial office building, which will require a fire escape stairway. The
proposed site plan shows the stairway encroaching 4 feet into the setback. The structure will
have public utilities and the adjoining property users are as follows:

Discussion:
After reviewing this application, Staff has determined that the request generally does satisfy the
criteria outlined below for granting the variance:

A. Special conditions and circumstances exist which are peculiar to the land or
structure involved, and are not applicable to other land or structures in the same
zoning district.
Evidently, a second floor of an office building triggers the need for a fire-escape
stairway or the building could have a sprinkler system. It is difficult to assume
that meeting fire code standards necessitates an automatic setback variance. Since
this is a vacant site, it is difficult to see that the conditions of the variance request
can't be resolved by the applicant.
B. The special conditions and circumstances do not result from actions of the
applicant.
The application needs to demonstrate that no other design or method of meeting
fire code standards is possible. Economic hardship is not sufficient to warrant a
varIance.
C. Literal interpretation and enforcement of the Land Development Code would
deprive the applicant of rights commonly enjoyed by other properties in the same
zoning districts under the terms of the Land Development Code, and would work
unnecessary and undue hardship on the applicant.
Usually, a new building will not be allowed a four-foot encroachment into the
setback area.
D. The variance, if granted, is the minimum variance necessary to make possible the
reasonable use of the land or structure.
If the stairwell were allowed in the setback, it does not appear that the
encroachment is excessive.
E. Granting the variance request will not confer on the applicant any special
privilege(s) that is (are) denied by the Land Development Code to other land or
structures in the same zoning district.
It is difficult to assume that granting the variance for a new building would not
set a precedent.
F. Granting the variance will be compatible with the intent and purpose of the Land
Development Code, and the variance will not be injurious to the neighborhood or
detrimental to the public welfare.
Under normal circumstances such an encroachment would not be compatible
with the City's Land Development Code.

Introduction:
The applicant is requesting a variance from Section 90-105 of the City of Okeechobee Land
Development Code to allow the construction of a single-family home on a 70 foot wide lot in the
RSF-1 Zoning District. The RSF-1 Zoning District requires a minimum lot width of 75- feet.
Background:
The subject property is approximately 0.253 acres fronting on SE 8th Street. The applicant
intends to construct a single-family residence on a 70-foot wide lot. The dwelling will have

After reviewing this application, Staff has determined that the request generally does satisfy the
criteria outlined below for granting the variance:

A. Special conditions and circumstances exist which are peculiar to the land or
structure involved, and are not applicable to other land or structures in the same
zoning district.
Yes, the subject property has unique conditions of size which are not applicable to
other areas within the RSF-l Zoning District in the City.
B. The special conditions and circumstances do not result from actions of the
applicant.
No, the size of the lot does not result from the actions of the applicant nor does it
appear that the narrow width is a result from a recent lot split.
C. Literal interpretation and enforcement of the Land Development Code would
deprive the applicant of rights commonly enjoyed by other properties in the same
zoning districts under the terms of the Land Development Code, and would work
unnecessary and undue hardship on the applicant.
Yes, literal interpretation of the minimum lot width of 75 feet would
unnecessarily deprive the applicant of rights to build a dwelling on the property
and would create an undue hardship on the applicant.
D. The variance, if granted, is the minimum variance necessary to make possible the
reasonable use of the land or structure.
Yes, the requested variance of 5 feet would reduce the minimum lot width to 70
feet. This would allow the applicant to use the land as proposed.
E. Granting the variance request will not confer on the applicant any special
privilege( s) that is (are) denied by the Land Development Code to other land or

General Information
Location: 1416 S.W. 3rd Avenue, Okeechobee, FL
Legal Description:
Lot 4, Block 25, South Okeechobee, according to the Plat
thereof, as recorded in Plat Book 5, Page 7, Public Records
Okeechobee County, Florida.
Introduction:
The applicant is requesting a variance from Section 90-105 of the City of Okeechobee Land
Development Code to allow the construction of a single-family home on a 50 wide lot, with a
total area of 6,650 square feet, in the RSF-1 Zoning District. The RSF-1 Zoning District requires
a minimum lot width of 75-feet and minimum total area of 10,000 square feet.
Background:
The subject property is approximately 0.15 acres fronting on SW 3rd Avenue. The applicant
intends to construct a single-family residence. The dwelling will have public utilities and the
adjoining property users are as follows:

Discussion:
After reviewing this application, Staff has determined that the request generally does satisfy the
criteria outlined below for granting the variance:
A. Special conditions and circumstances exist which are peculiar to the land or
structure involved, and are not applicable to other land or structures in the
same zoning district.
Yes, the subject property has unique conditions of size and shape which are not
applicable to other areas within the RSF-1 Zoning District in the City. The lack of
width is a major circumstance of uniqueness. Also it appears that contiguous lots
to the subject parcel are also 50' in width.
B. The special conditions and circumstances do not result from actions of the
applicant.
No, the size of the lot does not result from the actions of the applicant and it
appears that the subject lot has not recently been converted to its substandard
width.
c. Literal interpretation and enforcement of the Land Development Code would
deprive the applicant of rights commonly enjoyed by other properties in the
same zoning districts under the terms of the Land Development Code, and
would work unnecessary and undue hardship on the applicant.
Yes, literal interpretation of the minimum lot area requirements of 10,000 square
feet and minimum lot width of 75 feet would unnecessarily deprive the applicant
of rights to build a dwelling on the property. This would create an undue hardship
on the applicant and would appear inequitable as other homes next to this lot are
built on similar small sized lots.
D. The variance, if granted, is the minimum variance necessary to make possible
the reasonable use of the land or structure.
Yes, the requested variance of 3,350 square feet would reduce the minimum lot
area to 6,650 square feet and the requested variance of 25 feet would reduce the
minimum lot width to 50 feet. This would allow the applicant to use the land as
proposed.

structures in the same zoning district.
No, by granting this request the City will not be conferring any special or unique
privileges to the applicant that is denied by the Code to other properties in the
same Zoning Districts. This variance is not for setbacks or anything but the lot
width and minimum size provisions.
F. Granting the variance will be compatible with the intent and purpose of the
Land Development Code, and the variance will not be injurious to the
neighborhood or detrimental to the public welfare.
Yes, granting the variance would be in harmony with the intent and purpose of the
Code. The variance would not be injurious to the neighborhood or detrimental to
public welfare.
Recommendation:
Staff recommends approval of the request to allow a variance from Section 90-l05(a)
permitting the applicant to construct a single-family home on a 50 foot wide lot with a total area
of 6,650 square feet. It should be noted that this recommendation does not give permission for
the location of the proposed house. The proposed site plan as submitted does not meet the RSF-1
front setback provisions.

Legal Description of Subject Property:
Lots 11 and 12, Block 167, Okeechobee, According to the plat thereof, recorded in Plat
Book 5, Page 5, of the public records of Okeechobee County, Florida.
Item before the Board of Adjustment:
The matter for consideration by the City of Okeechobee Board of Adjustment is an
application requesting a Special Exception in the CBD Zoning District for property located
at 300 S.W. 2nd Street.
Background:
The subject property is approximately 0.33 acre(s) fronting on S.W. 2nd Street, which is
subject to this Special Use Exception petition. The applicant intends to operate an auto
detailing/hand car wash at the site. The structure has public utilities and the adjoining
property users are as follows:

Consistency with Land Development Regulations:
When reaching a conclusion on a Special Exception, the Board of Adjustment shall
consider and show in its record the following findings:
A. The use is not contrary to the Comprehensive Plan requirements.
A hand car wash and detailing service is not mentioned in the
Comprehensive Plan. If properly located and adequately protected for
drainage, parking, etc. it would not be contrary to the City's comprehensive
Plan.

B. The use is specifically authorized as a special exception use in the zoning
district.
The proposed use is specifically authorized as a special exception use in the
zoning district under Section 90-313(2), which specifically includes auto
service stations and car washes.
C. The use will not have an adverse effect on the public interest.
With proper conditions placed on this special exception, it will not have an
adverse effect on the public.
D. The use is appropriate for the proposed location, is reasonably compatible
with adjacent uses and is not detrimental to urbanizing land use patterns.
If properly screened and located, this use can be reasonably compatible with
adjacent uses.
E. The use will not adversely affect property values or living conditions, nor be
a deterrent to the development of adjacent property.
With proper conditions this use need not be a deterrent to the development
of surrounding properties.
F. The use may be required to be screenedfrom surrounding uses to reduce the
impact of any nuisance or hazard to adjacent uses.
The car wash may be required to be screened from surrounding uses to
reduce the impact to adjacent uses. Suggested improvements and
landscaping will correct any negative impacts for the project and will be
addressed at the site plan review stage.
G. The use will not create a density pattern that will overburden public
facilities such as schools, streets, and utility services.

H. The use will not create traffic congestion, flooding or drainage problems, or
otherwise affect public safety.
At this time, there are no concerns for this issue. Any that may arise will be

Based on the above Special Exception findings, the request should be approved. It should
be understood that this operation is being conducted at the applicant's home. The City, if
desired, should limit the business at this location to no more than two cars at one time. If
business should increase the applicants will be required to operate only under the following
conditions:
1. A drainage plan should be shown for the car wash area addressing Health
Department and City Engineering concerns and assuring that runoff will be
kept on-site.
2. Limited hours of operation should be established.
3. Landscaping around the car wash should be shown as buffers from the
intersecting street and bordering properties.
4. A site plan delineating where cars will be worked on, parking plus ingress
and egress to the business.
