Mayor Kirk explained the procedures of workshops. They are for informational purposes, allowing an opportunity for
both Boards to ask questions or discuss areas of concern. He asked whether future planning and annexation issues
were the main topics to be covered or whether anyone else had specific items as well? Vice Chairperson Hoover
requested that follow-ups to special conditions, placed on Special Exceptions and Variances be discussed. Member
Maxwell had emailed a few questions or concerns to the Mayor and Council and he requested to briefly review those
items.

III. NEW BUSINESS. Mayor.
A.
Discuss Future Planning and Annexation Issues continued.
Various topics were discussed. The first item was whether the City would pursue annexations of surrounding
properties. There are two methods of annexation. One is by voluntary annexation, which is the only method the City
has used to date. This is where the property owner petitions the City to have their property annexed into the City. The
other is involuntary annexation, which the City has not had to do. Mayor Kirk commented that at some point and time
the City may have to initiate involuntary annexations just as a necessity of staying in business.
Commercial encroachment into the residential areas was discussed. The Board wanted direction as to how far the
Council was considering the encroachment from the main corridor's? Council Members responded mostly within the
first two blocks only, after 3rd Avenue there would be too much encroachment. The Board was also interested in how
much multi-family designation should be in the City. These are issues that can be addressed when the City completes
its Evaluation and Appraisal Report (EAR) for the Comprehensive Plan which is due to begin the next Fiscal Year.
Special Conditions can be placed on applications for Special Exceptions and Variances. The Board questioned
whether the City had a method in place to be sure the conditions were carried out and stayed in place. The consensus
of the Council was to instruct staff to send Code Enforcement to investigate all special conditions that should be in
place and follow up with any that are out of compliance. This will become routine from this point forward.
Member Maxwell had asked, via his email, whether the Council thought a Planning Board Member should be present
at the City Council meetings to present their reasoning for their recommendations? The consensus of the Council was,
no, they did not think that it was necessary. The minutes from the meetings articulate their discussion very well. A point
noted was that should the minutes not depict the discussion or the issue thoroughly to the Board Member's
satisfaction, that needs to be pointed out when they approve their minutes.
The final items covered were educational workshops or courses offered for planning boards. Mayor Kirk stated he
thought the Board was doing a great job and pointed out that Okeechobee is unique and we do not want to copy the
larger cities. Each Council Member noted their confidence in the Board Members stating their appreciation for the job
that they do for the City, realizing it is not always an easy task. While the City Council usually agrees with their
recommendations, it is very rare for them to vote against the Board's recommendations. They also noted that when
it is done, it is carried out with great care and not taken lightly.
Chairperson Ledferd thanked the Mayor and Council Members for meeting with the Board. Mayor Kirk stated he
appreciated their time, questions and concerns. It is important that we "stay on the same page," having these joint
workshops will help make that happen. No official action was taken at the workshop.

Follow up to special conditions on SE & variances - Dawn Hoover, stay within the scope of items.
Bill Ledferd wi grown annexations of the city
Markham, have to almost be voluntary annexation to come into the city, sure the city wouldn't have a problem
with annexing businesses in, area next to commerce center is hamrick, unless someone purchased, also water
and sewer availability is an issue.
Kirk, there is involuntary annexations
Watford, right and we've only done voluntary types, if we still had control over the water and sewer think you
would see the request, don't know if there are any advantages to being annexed if I was a property owner,
other thing in back of mind that worries me, cluster developments, Le. the Grove, they are bigger than us to
-
e
e
Page -2-
start with, support another avenue at that pOint or we're going to be in the same point port st lucie is in, wish
there was a good reason to say you need to annex into the city, can you justify that
chandler, not much industrial in the county either to annex into the city
bill, reason I was thinking of it was the commerce center, if it could be larger
kirk, annexation something the city will have to look at eventually with just the cost of staying in business, not
just industrial, commercial as well, don't see commercial setting up in the city all that much either, for us to be
a viable city we'll have to
whidden what about the commercial areas and the trend to rezone the 2nd blocks, are we going to be changing
the future plan to start going back?
Kirk, main coordinator and within 2 blocks
ledferd, SW 2nd and 3rd Avenues are about as far as we've had requests
Lowry, SW 2nd Avenue and then buffer pretty safe after that get into a lot of res, almost have to b e purchase
of 6 lots to put commercial on that, don't think that it will work to put commercial onto 3rd avenue due to the
amount of residential homes built through there
Watford, where do we stand on the review of the comp plan?
Brian, EAR coming up, focusing on capital improvement element, EAR
Watford, that would be the time to look at where we are going, that would be the best think to do, look at the
map that would be an opportunity to address those, Devin indicated there were issues you wanted to discuss,
my answer to you would be that we read your minutes and see what you all ask, ask questions even if we
know answer just for public to know, do we have confidence in the board, yes have confidence in you,
devin, sometimes county planning bd will attend and support their recommendation, didn't know if council
wanted something like that
Watford for me no, don't think that is necessary, can be intimidating to applicant and sometimes we don't agree
with your board, and we may then get into a confrontation, think the board understands in zoning matters it's
a recommendation and land use, but SE & V it's the final decision, could be awkward for both sides.
Kirk,
Watford and we're looking at it from a different angle that you may have looked at it so we may have a different
take on it
Bill, larue
Brian, soliciting constructive critical are you happy with the way the minutes, flavor of discussion,
Dawn's suggestion, special exceptions and variance, special conditions, following up on making sure they are
carried out and stay in place, create a tickler file to review annually and be sure they are carried through,
lowry some business people take what they are suppose to do and get it done, but others do not, have to give
leniency
devin, have people who do things that come after the fact
Terry, do you have a term or items that Dowling I.E.: residential areas renovated to commercial seems to be
the biggest problem, sometimes impossible to renovate an older home to meet new requirements, parking as
well, reduction of parking request we get a lot those are the types of things we also address, didn't want to do
it verses the business had a serious problem with a contractor, or older non conforming use, special exceptions

that have co and they may have a business license with a condition
Lowry nextel after the hurricanes and others, let th eco happen, had problems with some of those, when those
people come back before us they probably wont get the leniency that got before if it's a contractor or home
owner that don't follow through
terry, others watch and use the same excuses I've noticed thats why I wondered if there was an actually list
of what constitutes exceptions
Brian, 9_ licences and 12 business some have gone to TRC, asking for things, first waive for consistency
is fire inspection, things that incumbent upon, safety issues, things obtainable within time period given is where
leniency comes in, safety or fire issues aren't sacrificed,
terry do you go back in 60 days
Brian, yes that's where the tickler files comes in but that's only in occupational licenses,
Watford
Brian
Staff to follow up with all special conditions and making sure they are on there.
Kirk important that we are all on the same page
Brian also cross referencing any waste management customers to be sure we have all. Other issue was
classes, think it's a great idea, area so much deeper, offer continuing education courses on the land use topics,
Jim did a workshop on procedures and that was helpful and what standards should be met rather than just
policy
Watford we as a group
Kirk, as a group we're doing great, we don't want to be like big cities we are okee and want to remain okee but
we don't do business like we did 20 years ago as long as we work together, appreciate the work you do, and
the times we do go against you we don't do that lightly, what you're doing is working well,
Devin we sometimes we side track on site plans and that should not have a bearing on our decision in actuality
lowry sometimes well have a rezoning and we say we really want staff to look at site plan to really look
Watford, were basically suppose to be serving the public, makes it hard when you know someone is trying to
push the rules as much as possible
Doug feel about land use as far as types too much MF ? Not enough?
Kirk, have a shortage

Workshop comments; Planning Board/Council
Please consider this my input for the workshop:
Does the Council find some benefit in the Planning Board having discussion about the items prior to
voting, and stating the thoughts or opinions of the members for the record?
Is the Council pleased with the level of involvement of the Planning Board? (The county Planning
Board seems more active, attending meeting, following through on decisions, etc.)
Would the Council consider some type of periodic training for the citizen boards to better inform them
on the area of land use? (There are continuing education classes and seminars that address these areas),

planning workshop
Katrina -
I am interested in discussing the following with the city council:
1. Follow up for special exceptions, variances, etc.
(when granting special exceptions we put conditions on granting it. After granting them I drive by them every
now and then and those conditions mayor may not have been met. I think that we need some type of follow up for
these items.)
