The subject property is currently zoned as Residential Multi-Family (RMF). There are special conditions that exist which are peculiar to the structure involved, and are not applicable to other land or structures in the same zoning district. The existing garage was built prior to the current code adoption and does not meet current setbacks. This request is to allow the construction of a carport to be uniform with th existing garage, which will not additionally encroach on the adjacent property. IV. NEW BUSINESS. Consider Variance Petition Ol-004-V by John W. and Kim E. Burnett. The purpose ofthe variance is to have a three-foot, eight-inch side setback rather than the required ten-feet in a Residential Multi-Family (RMF) zoning district. (Exhibit 1). A. I Mr. Julian Leggett, adjacent property owner, had concerns for how the carport will look when completed. He felt it would not flow with the surrounding properties. Mr Leggett also had concerns for the survey submitted as part of the application. He had a survey from the same surveyor and they both were inconsistent he wanted the Board to recognize this to settle a civil disagreement. Attorney Cook informed Mr. Leggett that the Board of Adjustment is only to consider the variance request that was submitted and whether or not it is consistent with the codes.
