Planning Consultant John Domer advised the board that Petition 01-001-SE needs to be
tabled until the City Council considers their petition. The concenses of the board was to
table petition 01-001-SE until the March 27, 2001 meeting

Petition 01-002-SE is a request to allow an Automotive Sales Lot in a Heavy
Commercial Zoning District. The Owner is Willard Mays. The property is located at 108
Southeast 5th Avenue and legally described as Beginning at the SE corner if Lot 8 of
Block 253, Town of Okeechobee, According to the Plat Book 2, Page 4, Public Records
of Okeechobee County, Florida and run North along the East Boundary of said Lot 8,
extended across right-of-way East Coast Railway to the SE Corner of Lot 1, of said Block
253: Thence run North to the East boundary of said Lot 1, extended across right-of-way
of Florida East Coast Railway to the South Boundary line of South Park Street. Thence
run West along the South line of South Park Street 100 feet; Thence run South to the
NW corner of Lot 7 of Block 253; Thence run South along the West boundary of Lot 7 to
the SW Corner; Thence run East along the South Boundary line of Lots 7 and 8 of said
Block 253 to the Point of Beginning, Less and Except therefrom, the South 100 feet of
the aforedescribed property.
Planning Consultant John Domer stated Staff recommended the Special Exception be
granted since it meets all required conditions as set out in the Land Development
Regulations as follows: The purposed use is not contrary to the Comprehensive Plan
requirements. An Automotive Sales Lot is allowed as a commercial land use with
appropriate safeguards and meet proper design standards with ingress, egress and
landscaping in order to avoid negative public impacts.

The proposed use would not adversely affect property values or living conditions, nor be
a deterrent to the development of adjacent property. There must be proper landscaping
and designed to avoid negative traffic impacts and unsightliness. It will not create a
density pattern that will over burden public facilities including schools, streets and utility
services. The proposed use will be required to be properly designed to not create traffic
congestion, flooding or drainage problems and public safety.
