ACTION - DISCUSSION - VOTE
Petition No. 00-001 V is a request for a Variance to allow a set back of 2' and 6" to
keep from cutting down a hundred year old tree in order to build a screen room in a
Residential Single Family One Zoning District. The property is located at 2001
Southwest 3rd Avenue and legally described as Lots 7,8 and 9, Block 42, First Addition
to South Okeechobee

Member Mueller moved to approve Variance petition No. 00-001 to be compatible with
the intent and purpose of the Land Development Code and based on the findings
contained in the Staff Report dated September 19, 2000; seconded by Member Keller.

Commercial Zoning District. The Applicant is Owners Adron and Pam Chambers. The
property is located at 1120 West North Park Street and legally described as Lots 12
and 13, Block 27, Northwest Addition.
Planning Consultant Jock Robertson stated Staff recommended the Special Exception
be granted since it meets all required conditions as set out in the Land Development
Regulations ans are as follows:

The purposed use in not contrary to the Comprehensive Plan requirements. Automotive
sales lot is allowed as a Commercial land use with appropriate safeguards and meet
proper design standards with ingress, egress and landscaping in order to avoid
negative public impacts.
IV. NEW BUSINESS CONTINUED
Consider Petition 00-005 SE. Owner/Applicant, Adron and Pam
Chambers. The property is located at 1120 West North Park Street and
is legally described as Lots 12 and 13, Block 27 to allow an Automotive
Sales Lot on Commercial Zoned Property.

The proposed use would not adversely affect property values or living conditions, nor
be a deterrent to the development of adjacent property. There must be properly
landscape and designed to avoid negative traffic impacts and unsightliness. It will not
create a density pattern that will overburden public facilities including schools, streets
and utility services. The proposed use will be required to properly design to not create
traffic congestion, flooding or drainage problems and public safety.

on the findings contained in the Staff Report dated September 19, 2000; seconded by
Member Hoover.
