Petition No. 00-003 SE is a request for a Special Exception to allow a church on a lot
less than five acres in a Residential Single Family One Zoning District. Tom W.
Conely, Attorney is applying for the owner, Sylvia Nelson. The property is located at
112 Southeast 5th Avenue and legally described as Lots 7 and 8, Block 253 and a
portion of the now abandoned Florida East Coast Rail Road Right-of-Way adjacentto
Lots 7 and 8, Block 253, City of Okeechobee
Attorney Tom Conely address the Board showing a site plan with more parking spaces
bringing the total parking to twenty three spaces, two of those being handicap. He also
presented a letter from the Okeechobee Police Department signed by Captain Denny
Davis, stating the department had no concerns regarding parking and traffic for the
proposed site.
Planning Consultant Jock Robertson stated Staff recommended the Special Exception
be granted since it meets all required conditions as set out in the Land Development
Regulations and are as follows:

The proposed use is not contrary to the Comprehensive Plan requirements. A church
on a lot less than five acres in Residential Single Family One Zoning District is
specifically authorized in the Land Development Regulations. The proposed use would
have minimal adverse effect on the public interest, mostly limited to Sundays. The
location for the proposed site is appropriate since it was previously used as a church
and is found to be reasonably compatible with the adjacent uses.

The proposed use would not adversely affect property values or living conditions, nor
be a deterrent to the development of adjacent property. There are existing buffers on
the boarder of the property, which would reduce any impacts to surrounding uses,
should they arise. It will not create a density pattern that will overburden public facilities
including schools, streets and utility services. Since traffic would be limited to mostly
Sundays, the proposed use would not create traffic congestion, flooding or drainage
problems nor would it affect public safety.
