The matter for consideration by the City Council, acting as the Land
Planning Agency for the City of Okeechobee, is an application by Tom
W, Conely, III, Attorney for Owner; Palmdale Oil Co., Inc., Property

The commercial zoning district would not create an isolated
situation and would be consistent with the surrounding urban

Density Pattern and Thereby Increase or Overtax the Load on
Public Facilities Such as Schools, Utilities, Streets, Etc.
The proposed change will not have an impact on the population
density or surrounding schools. Public utilities that exist in the
area will not experience any major increase or appreciable
demand from a project of this size. The streets in the area will
not experience any major increase in traffic volume, nor will
the proposed development alter the existing Level of Service
(LOS).
4. Existing District Boundaries Are Illogically Drawn in Relation
to Existing Conditions on the Property Proposed for Change.
The existing district boundaries are not illogically drawn.
5. The Proposed Change Would Be Contrary to the Proposed
Land Use Plan and Would Have an Adverse Effect on the
Comprehensive Plan.
The proposed change is consistent with the Future Land Use
Map and various Land Use policies regarding commercial
development.
6. Changed or Changing Conditions Make the Passage of the
Proposed Amendment Necessary.
The City of Okeechobee is experiencing growth and the Future
Land Use Map for the City indicates that much of the
commercial growth is to occur along its major roadways and
adjoining properties.
7. The Proposed Change Will /Will Not Adversely Influence Living
Conditions in the Neighborhood.
The proposed change will not have an adverse impact to the
nearby commercial area.

NARRATIVE OF PROPOSED LAND USE ACTION
The applicant wishes to have the subject property rezoned from CBD to
Commercial to bring the historic and present use into compliance will all
applicable zoning regulations. In addition the applicant wished to upgrade
and construct new facilities and improvements on the subject property and
comply with EPA regulations.
STANDARDS FOR REZONING
1. The proposed land use change is not contrary to the established
land use and in fact is in keeping with the proposed future land use.
2. The proposed change would not create an isolated district unrelated
to adjacent and nearby districts.
3. The proposed change would not materially alter the population
density pattern and thereby increase or overtax the load on puublic
facilities such as schools, utilities, streets, ect.
4. Existing district boundaries are not illogically drawn in relation
to existing conditions on the property 'proposed for change.
5. The proposed change would not be contrary to the Proposed Land Use
Pland and in fact is in compliance with the Proposed Land Use Plan.
6. The need to comply with EPA regulations make the passage of the
proposed changes necessary.
7. The proposed change will not adversely influence living conditions
in the neighborhood.
8. The proposed change will not create or excessively increase traffic
congestion or otherwise affect public safety.
9. The proposed change will not create a drainage problem.
10. The proposed change will not seriously reduce light and air to
adjacent areas.
11. The proposed change will not adversely affect property values in
the adjacent area.
12. The proposed change will not be a deterrent to the improvement or
development of adjacent property in accord with existing regulations.
13. The proposed change will not constitute a grant of special
privilege to an individual owner as contrasted with the public welfare.
14. The property can be used in accord with existing zoning.
15. The change suggested is not out of scale with the needs of the
neighborhood or the City.
16. This business presently operating on this site has existed for a
number of years, the applicant is upgrading the improvements on the subject
property and the proposed use is a permitted use in this zoning category.
