REGULAR MEETING
TUESDAY, FEBRUARY 5, 1985
The Planning Board/ Board of Adjustments and Appeals met in regular session on,
Tuesday, February 5, 1985, at City Hall in the Council Chambers, Okeechobee, Florida at
7:00 P.M.
Members present were: Building and Zoning Administrator, Mallette Westbrook; Acting
Attorney, Lester Jennings; and Secretary, Beatrice Castorina.
BOARD OF ADJUSTMENTS AND APPEALS
Madam Chairman O'Connor called the Board of Adjustments and Appeals into session.
APPROVAL OF MINUTES
There being no additions or corrections to the minutes of January 8, 1985 meeting,
member Ferneau moved the minutes stand approved as presented. Seconded by member Wright.
Motion carried.
CHARLES FARMER - REQUEST FOR A VARIANCE
Mr. Farmer appeared before the Board to request a 0' setback on lots 4,5,6, Block 151,
City of Okeechobee. After discussion member Ferneau moved to table this item so Mr. Farmer
could get more information for the Board. Seconded by member A1tobello. Motion carried.
This item was tabled intil February 12, 1985.
STEWART AND MARY LIGHTSEY - REQUEST A VARIANCE ANDAPPEALDECISSION OF BUILDING AND ZONING
ADMINISTRATOR
Jerry Bryant, attorney for Mr. and Mrs. Lightsey was present to appeal the request.
He advised the board Mr. Westbrook has denied an occupational license to Mr. and Mrs.
Lightsey because the business was non-conforming to the zoning.
Mr. Bryant stated the Lightsey's have lived on the property for 30 years or more. He
advised the board he has a signed affidavit stating the bait business has been there more
than 30 years and an airboat business has been there aleast 15 years. He stated they were
requesting the board overturn the decision of the Building and Zoning Administrator, Mr.
Westbrook. The license was denied because the property is located in a residentially zoned
area and it is non-conforming use to the present zoning statis. The zoning Ordinance came
in affect in 1978 and the Lightsey's were there way before that and stated it was grandfather'
ed in and should be allowed to have an occupational license as required by City Ordinance.
Mr. Bryant produced as evidence (10) Ten affidavits with surrounding property owner's
names and addresses stating they had no objections to the Lightsey's continuing their busines;
as they have done for the last 30 years.
Mr. Bryant stated they are asking for a grandfather statis and over rule Mr. Westbrook's
decision.
Dowling Watford, Jr. of 701 N.E. 5th Street appeared before the board stating he was
not objecting to the business continuing for a temporary time in its present condition. He
came to object a variance or special exception if that was what the request was for.
D.R. Watford, Sr. appeared before the board stating he did not object to the Lightsey's
operating on a temporary basis, but he don't want the property being encroach upon.
Member Ferneau asked Mr. Bryant if the business was going to expand in the future.
Mr. Bryant advised he has explained to Mr. and Mrs. Lightsey that, it is non-conforming use
and not allowed to expand.
Member Altobello asked if the business has been a continueous operation. Mr. Bryant
stated yes.
Attorney Jennings asked Mr. Westbrook why exactly did he turn the Lightsey's down for
a license.

The Planning Board/Board of Adjustments and Appeals met in a special meeting on
February 12, 1985, at City Hall in the Council Chambers, Okeechobee, Florida at 7:00 P.M.
Members present were: Jim Wright; Frank Altobello; Brenda O'Connor.
Members Ferneau and Worthen were absent.
Others present were: Building and Zoning Administrator, Mallette Westbrook; and Secretary,
Beatrice Castorina.
BOARD OF ADJUSTMENTS AND APPEALS
Madam Chairman O'Connor called the Board of Adjustments and Appeals into session at 7:00
P.M.
CHARLES FARMER - REQUEST FOR VARIANCE
Charles Farmer appeared before the board to answer any questions on the request for
the north 40 feet of lots 4,5,6, Block 151, City of Okeechobee. He is asking for a 0'
setback to build a commercial building on this property. This request was tabled at the
regular meeting of February 5, 1985.
There were no objections to the variance request. After discussion the board went
over the findings for a variance. With no objections to the findings member Altobello
moved to grant the variance. Seconded by member Wright. Motion carried. Member Altobello
moved to amend the request to read the variance be granted with a calender year to began
construction.
(february 1986). Seconded by member Wright. Motion carried.
AJOURNMENT
There being no further business to come before the board, member Wright moved to adjourn
seconded by member Altobello. Motion carried. Meeting adjourned.
