Public records Okeechobee county Florida, and hold a reversionary interest to a life estate retained by defendant Kemp. 3. That the subject property is vacant real estate, not homestead property and not otherwise exempt under section 4(a) Article X, Florida Constitution. 4. That the City of Okeechobee, Florida possesses the right and obligation to enforce city codes and ordinances within its boundaries pursuant to ch. 162 Florida Statutes. 5. That the City of Okeechobee sent to defendant by certified mail, on November 27, 2017, a notice of violation of city codes under FS 162, for which the defendant acknowledged receipt by green card signature. The notice included a request to appear at code board hearing on December 12, 2017 to address the violation. 6.That the code violation was assigned case no. 017-00036 by City staff, and the matter proceeded to public hearing before the City of Okeechobee code board. 7. That the matter was heard by the code board at the December 12, 2017 meeting, at which time the defendant did not appear in person or through counsel. The board heard sworn testimony through the code officer, who made findings of fact and law that the defendant was in violation of section 30-44 general cleaning and 30-43, public nuisance, code of ordinances. Pursuant to that finding, the board ordered a daily fine of $50.00 per day and lien recorded on March 15, 2018, at OR Book 804 Page 94 Public records Okeechobee county, Florida; (attached hereto exhibit "A") 8. Pursuant to F.S. 162.09(3), if a valid lien remains for a period of 90 days and does not otherwise come into compliance with city codes, the City may elect to file a foreclosure of the lien. As of the 90th day, and at all times since, said lien has not been satisfied and the property has not come into compliance with city codes. In addition to mailing, the plaintiff posted a notice of lien upon the property itself December 22, 2017 (exhibit "B") 9. That the amount of the lien accrued to the date of this petition, September 19, 2019, is $ 39,831 , at $50.00 per day from December 12, 2017, and accruing in like amount thereafter until entry of judgment of foreclosure by the court. 10. That the Plaintiff believes that there are or may be persons who are or may be interested in the subject matter of this action whose names after diligent search and inquiry are unknown to the Plaintiff. That said unknown parties may claim as heirs, devisees, grantees, assignees, lienors, creditors, trustees, or other claimants by, through, under, or against the Defendant(s) herein, and therefore all of said unknown parties are made defendants in this action. My Questions: 1. Is Ord #961/#06 -012 -SSA adopted? The final decision approved by DOAH didn't address the comp plan amendment (#06 -012 - SSA) even though the original petition requested "it be found not in compliance and not adopted." I cannot find where the City Council ever rescinded action on it. If it is adopted, then we need to have the FLU map updated to show the 9.89 ac is actually MF not SF. 2. (2) In addition to providing notice as set forth in subsection (1), at the option of the code enforcement board, notice may also be served by publication or posting, as follows: (a)1. Such notice shall be published once during each week for 4 consecutive weeks (four publications being sufficient) in a newspaper of general circulation in the county where the code enforcement board is located. The newspaper shall meet such requirements as are prescribed under chapter 50 for legal and official advertisements. 2. Proof of publication shall be made as provided in ss. 50.041 and 50.051. (b)1. In lieu of publication as described in paragraph (a), such notice may be posted at least 10 days prior to the hearing, or prior to the expiration of any deadline contained in the notice, in at least two locations, one of which shall be the property upon which the violation is alleged to exist and the other of which shall be, in the case of municipalities, at the primary municipal government office, and in the case of counties, at the front door of the courthouse or the main county governmental center in said county. 2. Proof of posting shall be by affidavit of the person posting the notice, which affidavit shall include a copy of the notice posted and the date and places of its posting. (c) Notice by publication or posting may run concurrently with, or may follow, an attempt or attempts to provide notice by hand delivery or by mail as required under subsection (1).
