Okee (Childrens Academies)Official Records File#2020000382 Page(s):4 Sharon Robertson Clerk of the Circuit Court & Comptroller Okeechobee, FL Recorded 1/10/2020 1:17 PM Foca RECORDING $35.50 M DOCTAX PD $0.00 LICENSE AGREEMENT (Use of Alleyway and Right -of -Way) THIS AGREEMENT, by and between the CITY OF OKEECHOBEE, FLORIDA, a Florida Municipal Corporation (hereinafter "CITY"), and CHILDREN'S AGAD MIES OF FLORIDA O CP, (hereinafter "OWNERS"), dated this •17 Ill day of T ) ftin1.2 r , 20 11 WHEREAS, OWNERS hold fee simple title to the following described real property in Okeechobee County, Florida, to wit: LEGAL DESCRIPTION: LOTS 11 AND 12 OF BLOCK 35; LOT 7 AND THE NORTH ONE-HALF OF LOT 8 OF BLOCK 40; FIRST ADDITION TO SOUTH OKEECHOBEE, ACCORDING TO PLAT THEREOF RECORDED IN PLAT BOOK 1, PAGE 17 OF THE PUBLIC RECORDS OF OKEECHOBEE COUNTY, FLORIDA; and WHEREAS, the CITY owns the following platted alleyway and/or right-of-way: A 15 -FOOT WIDE ALLEYWAY WITHIN SAID BLOCK 35, LYING NORTH TO SOUTH BETWEEN LOTS 1 THROUGH 6 AND LOTS 7 THROUGH 12; AND THAT PORTION OF SOUTHWEST 19TH STREET (F/K/A TWELFTH STREET) AN UNIMPROVED RIGHT-OF-WAY BEING APPROXIMATELY 40 -FEET WIDE, LYING EAST TO WEST BETWEEN SOUTH PARROTT AVENUE AND SOUTHWEST 2ND AVENUE (F/K/A KISSIMMEE STREET); and WHEREAS, the CITY initially entered into a Letter of Agreement dated February 12, 1997, granting Gary and Debbie Frazier, D/B/A Building Blocks Day Care, and the previous owners of the aforementioned legal description, permission to erect a fence or any other item on a portion of Southwest 19th Street between Lot 12 of said Block 35 and Lot 7 of said Block 40; and WHEREAS, upon Gary and Debbie Frazier selling the real property within the aforementioned legal description to Building Blocks Preschool of Okeechobee, Inc., D/B/A Bright Futures Preschool, the CITY entered into a License Agreement dated April 16, 2009, consenting and approving for use of the same portion of Southwest 19th Street between Lot 12 of said Block 35 and Lot 7 of said Block 40; and WHEREAS, on March 17, 2015, the CITY entered into a First Amendment to the License Agreement dated April 16, 2009, consenting and approving additional improvements in the form of an extended paved circular driveway across the same portion of Southwest 19th Street between Lot 12 of said Block 35 and Lot 7 of said Block 40; and WHEREAS, the OWNERS acquired the real property as provided within the aforementioned legal description on April 1, 2016, by Warranty Deed as recorded in the Official Records Book 773, Page 131 for Okeechobee County. The OWNERS, without authorization or building permit, moved the existing fence located along the East boundary line of Lots 11 and 12 of said Block 35, eastward across the 15 -foot wide alleyway to the West boundary line of Lots 5 and 6 of said Block 35, and extended the fence located within the portion of Southwest 19th Street eastward approximately 15 -feet past the agreed upon area of use in the aforementioned Agreements, causing the alleyways within said Blocks 35 and 40 to be blocked from the public; and Page 1 of 4 WHEREAS, the OWNERS upon being made aware of their impediment of a public alleyway, moved the fence 7.5 -feet to the West along the width of Lots 11 and 12 of said Block 35, and the Southeast corner fence line was moved North by 15 -feet in order to allow access between the 15 -foot wide alleyway lying North to South in said Block 40 and the unimproved portion of Southwest 19th Street between Lot 6 of said Block 35 and Lot 1 of said Block 40. OWNERS requested to maintain the improvements in the form of fence(s), gate(s), paved driveways and playground equipment on property owned by the CITY; and WHEREAS, the OWNERS provided the CITY with letters of approval by all adjoining landowners, and consent from the Okeechobee Utility Authority, with a notation that there is a two-inch water main Tying East to West long the North boundary line of Lots 1 and 7 of said Block 40. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth herein, the parties agree as follows: 1. That the CITY hereby declares and revokes as void the following documents: a. Letter of Agreement dated February 12, 1997, between the CITY, and Gary and Debbie Frazier. b. License Agreement dated April 16, 2009, recorded in the Official Records Book 668, Pages 1915-1916 for Okeechobee County, between the CITY and Building Blocks Preschool of Okeechobee, Inc. c. First Amendment of License Agreement dated March 17, 2015, recorded in the Official Records Book 758, Pages 487-488 for Okeechobee County, between the CITY and Building Blocks Preschool of Okeechobee, Inc. 2. The CITY hereby grants this revocable license for the use of a portion of the alleyway and right-of-way as described below, and as shown on Attachment A: THE WEST 7.5 -FEET OF THE 15 -FOOT WIDE ALLEYWAY LYING NORTH TO SOUTH WITHIN SAID BLOCK 35 AND LOCATED BETWEEN LOTS 5 THROUGH 6 AND 11 THROUGH 12 (APPROXIMATELY 7.5 - FEET BY 100 -FEET); TOGETHER WITH THAT PORTION OF UNIMPROVED SOUTHWEST 19TH STREET (APPROXIMATELY 40 -FEET WIDE) LYING SOUTH OF LOT 12 OF SAID BLOCK 35 AND NORTH OF LOT 7 OF SAID BLOCK 40, WEST BOUNDARY BEING SOUTHWEST 2ND AVENUE, EAST BOUNDARY BEING: BEGIN AT THE NORTHEAST BOUNDARY MARKER OF LOT 7 OF SAID BLOCK 40, AND RUN WEST 2.5 -FEET FOR A POINT OF BEGINNING, IN A STRAIGHT LINE EXTEND NORTH 15 -FEET, THEN HEAD EAST 10 -FEET IN A STRAIGHT LINE, THEN HEAD NORTH FOR 25 -FEET TO THE SOUTH BOUNDARY LINE OF THE NORTH/SOUTH ALLEYWAY IN SAID BLOCK 35, THEN HEAD WEST IN A STRAIGHT LINE 7.5 -FEET TO THE SE BOUNDARY MARKER OF LOT 12 OF SAID BLOCK 35. With the understanding, the OWNER will maintain the portion of said alleyway and said right-of-way as herein described. Should it ever become necessary to remove any fencing/gates, or improvement thereon, in order to allow either the installation or maintenance of water, sewer, or other utility lines or any other type of installation or construction, or for any other reason chosen by the CITY, the fencing/gates, or any improvement thereon, will be removed by the OWNERS or their agents and/or assignees at the OWNERS expense within seven days of receipt of written request by the CITY for such removal. Should the CITY, for valid reasons, require the removal of the fencing/gates, or any improvements thereon, less than seven days' notice, the OWNERS agree to exercise reasonable efforts to comply with such requests. OWNERS agree to contact their insurance company and require an endorsement be added to their General Liability Insurance policy listing the CITY as an additional insured with a Certificate of Insurance, as well as a certified copy of the endorsement, furnished to the CITY showing the part of the said alleyway and said right-of-way as herein described, to be used by them, insuring the CITY against any liability arising out of alleged injuries or other activities which may occur within the alleyway and right-of- way. In any event, OWNERS agree and shall hold the CITY harmless for any and all action, suit, claim, injury, or cause of action of any nature arising out of OWNERS permissive use, and indemnify CITY for such, including costs and attorney fees. 4. OWNERS agree to furnish the CITY annually upon renewal, a copy of the Certificate of Insurance listing the CITY as an additional insured, as well as a copy of the policy endorsement with their insurance carrier. 5. OWNERS shall not, by such improvements made to the described alleyway and/or right-of-way, obstruct, close, or otherwise restrict access across the alleyway and/or right-of-way for travel thereon by the CITY or the general public, except as otherwise provided in this Agreement. 6. OWNERS agree this license is non -assignable without the express written consent of the CITY; and if OWNERS sell or transfer the subject property, their covenants, and agreements shall run with the land. 7. The City Clerk shall cause this license to be recorded in the public records of Okeechobee County, Florida. 8. OWNERS agree to reimburse the CITY all recordings costs. The applicant is supposed to provide the exact legal description, research and print copies of deeds of all adjoining property owners, prepare the letters for the adjoining property owners to sign, contact those owners to get the letters signed and then provide them to the City Clerk's Office, and a letter from OUA confirming no utilities. I'm attaching a copy of a check list we use in my office to show the correct procedures for how these are supposed to be completed. I don't want Police/Code Enforcement and Kay to think this is the normal procedures to complete a use agreement, as it is not. The applicant is supposed to provide the exact legal description, research and print copies of deeds of all adjoining property owners, prepare the letters for the adjoining property owners to sign, contact those owners to get the letters signed and then provide them to the City Clerk's Office, and a letter from OUA confirming no utilities. I'm attaching a copy of a check list we use in my office to show the correct procedures for how these are supposed to be completed. In case you're wondering, yes the check list and sample letters were all provided to the applicant when the issue first came about. Thank you. Jackie referred him to our office. Thankfully David was also in the office and was able to explain the drawing. What we actually need is a surveyor to provide a legal description. However, since that wasn't provided and in an attempt to get this matter resolved, I've taken the information and created the best legal description and sketch that I could. The next step will be for Mr. Oliveros to obtain original authorization from all adjoining land owners of the alley and street. I've attached a copy of the letters necessary for signature. If this legal description will suffice, please print the letters and sketch for each and forward to Mr. Oliveros, or stop by my office we have a copy of them in the file. Mr. Oliveros needs to fill in the purpose of using the alley and street on each of these and then he needs to obtain original signatures and forward them to my office. If this legal description will suffice, please print the letters and sketch for each and forward to Mr. Oliveros, or stop by my office we have a copy of them in the file. Mr. Oliveros needs to fill in the purpose of using the alley and street on each of these and then he needs to obtain original signatures and forward them to my office. A copy is enclosed. The license is no longer binding as it can only be transferred by written permission from the City. The City has observed that you are continuing the use of the portion of Southwest 19th Street in the same manner. This agreement constitutes a mere license from the City for the wanted use, and is revocable by the City at any time upon demand. Gary & Debbie Fraizer (owners) agrees if at any time the City requires the use of said Street right of way for the installation of utilities or for any other purpose not limited to: drainage, etc., to remove said fence or any other item at owners expense, within thirty (30) days after receiving written notice. If in fact the City requires earlier removal of said fence or any other item, then the City employees or agents may at the City's expense remove said fence or any other item and will try to preserve the fence or any other item to the best of their ability; and if replacement of the fence or any other item is allowed, it will remain the owner's full responsibility. The City and its employees will be held harmless,and indemnified by owner now and in the future, from any and all claims that may arise in connection to this granted use of street right-of-way by the owners, their guests, invitees or the public. We have spoke to the owners and he has agreed to allow us to only take the corner of the fence off. To give them enough room to drive a truck around the building.
