1984-02-07 - - - PROPOSAL TO AMEND ORDINANCE #258 Discussion to amend Ordinance #258 for less footage from a church or school for on premises consumption of wine and beer where food is served by special exception. Attorney Conlon advised the board needed to distinguish how the distance is to be measured. Discussion ensued. Member Altobello stated he thought the distance should be measured fron the center of the lot to the center of the designated lot and measure on city map. Member Ferneau stated he liked the 700 feet with the special exception. vice Chairman Wright stated he thought to leave the 700 feet and measure from front door to front door and measure on city map. After a lenghty discussion member Ferneau moved to table until the next meeting to give the board members more time to study the matter. Seconded by member Altobello. Motion carried. MALLETTE WESTBROOK Mr. Westbrook advised the board, the tour to Cardinal Industrials is scheduled for February 2, 1984, at 10:00 o'clock A.M. REGULAR MEETING FEBRUARY 7, 1984 The Planning Board/Board of Adjustments and Appeals met in regular session on Tuesday, February 7, 1984, at City Hall in theCouncil Chambers, Okeechobee, Florida at 7:00 P.M. Members present were: Jim Wright, Darrell Ferneau, Frank Altobello and Madam Cahirman Brenda O'Connor. Member Lula Worthen was absent. Others present were: Building and Zoning Administrator, Mallette Westbrook; Attorney David Conlon; and Secretary, Beatrice Castorina. BOARD OF ADJUSTMENTS AND APPEALS Madam Chairman O'Connor called the Board of Adjustments and Appeals into session. 1 [) r~ ~ ~ pgr APPROVAL OF MINUTES There being no additions or corrections to the minutes, member Wright moved the minutes of January 10th, 1984 meeting stand approved as presented. Seconded by member Ferneau. Motion carried. DAVID SATUR & JIM HODGES - REQUEST FOR SPECIAL EXCEPTION David Satur and Jim Hodges appeared before the board to request a special exception to allow a propane gas bulk plant on a parcel of unplatted property located on SW 7th Avenue, which is zoned Industrial. MR. Satur stated he has talked with the Fire Chief and Fire Chief Tomey told him every thing was o.k. with him as long as it was in compliance with the NFPA and it was past' through the Board of Adjustments and Appeals for the special exception. Mr. Satur also stated there would be a chain link fence erected around the propane gas tanks. Member Wright stated he didn't want to see anything brought into the City that would be an eye sore to the community. Madam Chairman O'Connor asked lias far as there being a saftey hazard wasn1t there periodic checks by other people on those types of bulk plants." Mr. Satur stated yes; they were inspected by Commissioners Gunter's office; State fire Marshall and a man from the L.P. Gas division that comes monthly and on an annual basics and investigate any problems locally. Attorney Conlon advised that a complete set of plans stating the location of the tanks and etc. would be needed before the special exception could be granted. He also advised the board members need to know exactly what the site plans would look I ike, so they would know what they were granting the special on. Member Ferneau stated he was concerned with the location because of how close the res- idence were in the area, and wanted to know if the tanks could be put underground. Mr. Satur stated the Fire Marshall's office would not let the tanks be put underground because the tanks can be maintained above the ground where an eye can be kept on them also test the valves on them. There are problems with extracting the fuel from the underground. Mr. Satur stated they have a track record of safety in their other plants. Member Wright asked if they would bring in individual home tanks and taking them to houses, and if so would they be storing these tanks on the property. Mr. Satur stated yes, but not a tremendous amount. Member Wright asked when they bring in the old tanks, where would they be bleeding them. Mr. Satur stated into other tanks. After a lenghty discussion, Member Wright moved to table this request until the next meeting. Seconded by member Altobello. Discussion ensued. Madam Chairman O'Connor called for a vote with Members Altobello and Wright in favor and Members Ferneau and O'Connor opposing. With the motion not passing, discussion ensued. Member Ferneau stated he would like to talk to the fire chief about the safety of the plant with the residences as close as they are, and he moved to recess until the 20th day day of February, 1984. There was no second, therefore the motion died on the floor. Member Altobell noved to table the request until next month. Seconded by member Wright. Motion carried. ADJOURNMENT There being no further business to come before the board, member Altobello moved to adjourn. Seconded by member Wright. Motion carried. APPROVAL OF MINUTES There being no corrections or additions to the minutes of January 10, 1984 meeting, member Ferneau moved the minutes stand approved as presented. Seconded by member Wright. Motion carried. CAROL W. BRYANT - REQUEST FOR REZONING Carol Bryant appeared before the board to request a rezoning of lots 7,8,9 & 10, Block 6, South Okeechobee, from Residential Single Family to Commercial. This property is located at 905 S.W. 2nd Avenue and a house is already on the property, which she intends to use as a real estate office. Member Ferneau asked Ms. Bryant if she had considered rezoning to CPO. Ms. Bryant stated no. She also stated she preferred the commercial zoning. After a lenghty discussion Ms Bryant requested the appl ication be amended for CPO and be re-advertised for next meeting. Member Wright moved the secretary process the amended application. Seconded by member Ferneau. Motion carried. PROPOSAL AMENDMENT TO ORDINANCE # 258 Member Ferneau moved to table this matter until the next meeting for further study. Seconded by member Altobello. Motion carried. MALLETTE WESTBROOK Mr. Westbrook asked the board members to think about and study restricting tractor trailers in an residential area. He stated he would have some data for the next meeting also, Mr. Fortner, Director of Publ ic Works, would be present at the meeting to have input and answer any questions.
