1983-04-25 - - - REGULAR MEETING MONDAY, APRIL 25, 1983 The Planning Board/Board of adjustments and Appeals met in regular session on Monday. April 25, 1983, at 7:00 P.M., in the Council Room, at City Hall in Okeechobee. Members present were: Darrell Ferneau, Frank Altobello, Brenda O'Connor and Chairman Kirk. Member Wright was absent. Others present were: Building and Zoning Administrator, Mallette Westbrook; City Attorney, David Conlon; and Secretary, Beatrice Castorina. BOARD OF ADJUSTMENTS AND APPEALS Chairman Kirk called the Board of Adjustments and Appeals into session. APPROVAL OF MINUTES There being no additions or corrections to the minutes, Member Ferneau moved to accept the minutes of the January 4, 1983, meeting as presented. Seconded by member Altobello. Motion carried. CHRISTINE HOOKER - REQUEST FOR VARIANCE Christine Hooker appeared before the board to request a variance on lots 1,2, and 20' of lot 3. Block 230, 1st addition to City of Okeechobee to reduce the set back requirement from 20 feet to 3 feet along bhe back of the property. because the property is abutting Residential Single Family zoned property. She also request a 1 foot set back on the north side of the property. Mrs Hooker told the board she is moving the old Raulerson house to this area. She will be restoring the building for office spaces. Chairman Kirk called for objections and/or comments on the variance. There were no objections voiced. Discussion ensued. The board reviewed the findings for a variance. Chairman Kirk stated the chair would entertain a motion for the variance. Member Altobello stated he wished to abstain from voting because he re- presented an institution involved in the transfer of the property. Attorney Conlon advised Member Altobello would still have to vote. He could fill out a form and file it with the clerk's office stating that his association would in no way influence his vote. Member Ferneau moved to grant the variance request to reduce the setback to 3 feet in the back and 1 foot on the north side. Member O'Connor seconded. Motion carried. ADJOURNMENT There being no further business to come before the Board of Adjustments and Appeals, Member Altobello moved to adjourn. Seconded by Member O'Connor. Motion carried. PLANNING BOARD Chairman Kirk called the Planning Board into session. APPROVAL OF MINUTES There being no additions or corrections to the minutes, Member O'Connor moved 14.1. ¿vT to accept the minutes of the March 1, 1983 meeting as presented. Seconded by Member Ferneau. Motion carried. WALLACE AND DORA NORTON - REZONING Attorney John Cassels, representing Wallace and Dora Norton appeared before the Board regarding the rezoning of the property located at 103 South West 11th Avenue. This matter of business was tabled at the March 1, 1983, meeting to enable Attorney Cassels to obtain a rendering of parking spaces for the Board. Attorney Cassels presented the board with the plan, also a petition of home owners in the area that is for the rezoning. Chairman Kirk asked the board members and the audience if they had any questions. There were none. Member Altobello moved to recommend the City Council grant the rezoning of lot 1, Block 3, 1st addition to Okeechobee, from Residential Single Family to Commercial. Seconded by Member O'Oünnor. Members O'Connor, Kirk and Altobello voted yes. Member Ferneau voted no. Member Wright was absent. GORDON LEGGETT - PROPOSAL TO CHANGE RECREATION AREA AT RIVER BEND MOBILE HOME PARK Mr. Leggett stated he had sold the park to Mr. DeLuccio, who wants to make some changes in the park, one of which is a recreational area. Mr. DeLuccio stated the changes to the board. Discussion ensued among Mr. DeLuccio, Mr. Leggett and Board members. Chairman Kirk advised the board he had received three letters from owners of mobile homes who were objecting to the change of the recreational area. Chairman Kirk asked if there was anyone in the audience wishing to comment on this matter. Mrs Grover of lot 53 stated all the mobile homes were not individually owned. Barbara Woodall of lot 69 stated, "you can't see at the stop sign at the recreation area because they have put a trailer in the area and it is hard to see down the road". Alan Palmore of lot 94 stated he was a saleman at River Bend Mobile Home Sales, and he thinks it is safe at the stop sign. Shirley McCloud of lot 71 stated another mobile home had been put into the recreational area before the current mobile home was put there. Martha Coone of lot 51 stated the mobile home was blocking the view of the road, and also wanted to know how he could put a mobile in the recreational area if he couldn't put a building. Mr. Phillips of lot 43 stated how could you put three or four mobile homes in the recreational area when you can't put a building on it. He stated he bought in the park with the idea that, that was the recreation area. Eugene Coone of lot 51 stated when they bought there mobile home and moved into the park, Mr. Leggett promised to develope the recreation area. Mrs Grover stated it was a beatiful park and that is why they want to stay there and not move. Helen Rowell of lot 4 stated they haven't had street lights for a couple of months and it is dark in their section. Sam Rector of lot 37 stated the street should be investigated by a experienced man under the safty supervision. A gentleman for lot 45 stated he was the first one in the park and he would treat the owners right if they treat him right. - - - - - - Chairman Kirk asked Attorney Conlon that if, when the original park was developed hadibeen disignated as a recreation area would, this require it to remain a recreation area. Member Ferneau asked if the Board had the power to change the area. After a lengthy discussion, Attorney Conlon stated the Board needed to look back at the original presentation to see what was represented. Discussion ensued with Member Ferneau moving to table the issue until the next meeting so that Attorney Conlon can research the matter. Seconded by Member Altobello. Motion carried. Attorney Conlon asked the board if they would change the meeting night to a Tuesday night. After discussion Member Ferneau moved to change the meeting to the first Tuesday of each month. Seconded by Member O'Connor. Motion carried. DOWLING WATFORD Dowling Watford appeared before the board concerning metal buildings. He stated he did not think metal buildings should be used in a commercial zone. Mr. Watford stated it should be looked into and perhaps allowed as a request for a special exception. MALLETTE WESTBROOK Mallette Westbrook asked the board to look into an Ordinance regulating parking in a residential zone, which would restrict parking for vehicles over 3/4 tonn~onger than twenty four (24) hours on street right-of-ways. ADJOURNMENT There being no further business before the Planning Board, Member Ferneau moved to adjourn. Seconded by Member O'Connor. Meeting adjourned at 8:55 P.M.
