REGULAR MEETING
The Planning Board/Board of Adjustments and Appeals met in regular session on
Tuesday, January 4, 1983, at 7:00 P.M. in the Council Room at City Hall in Okeechobee.
Members present were: Chairman, James Kirk; Brenda Mason and Frank Altobello.
Member absent: James Wright. Member Thomas Miller resigned effective December 20, 1982.
Others present were: Building & Zoning Administrator, Mallette Westbrook; City
Attorney, David Conlon; and Secretary, Ruth Berndt.
TUESDAY, JANUARY 4, 1983
BOARD OF ADJUSTMENTS AND APPEALS
Chairman Kirk called the Board of Adjustments and Appeals into session.
APPROVAL OF MINUTES
Chairman Kirk asked if there were any corrections or additions to the minutes and
stated if there were none, the Chair would entertain a motion to approve the minutes
as presented. Member Altobello so moved. Seconded by Member Mason. Motion carried.
PLANNING BOARD
Chairman Kirk called the Planning Board into session.
APPROVAL OF MINUTES
There being no additions or corrections to the minutes, Member Mason moved to
accept the minutes as presented. Seconded by Member Altobello. Motion carried.
WORKSHOP LIVESTOCK ORDINANCE
Chairman Kirk stated this item was to have been a special workshop item, but since
there was nothing to come before the Planning Board it was scheduled for this time.
Chairman Kirk stated the floor was open for discussion.
Mr. Richard Fellows, City Administrator, address the Board.
Mr. Fellows stated this is the third or fourth time the Board has addressed this

matter and it has been advertised for public hearing twice without much response. He
also stated there has not been many complaints received on this matter and he thought
perhaps that since there is extreme lack of public interest in the matter that we did
not have a problem here. Maybe some single cases that need attention, but we have not
had that many complaints due to domestic animals like cows, horses,etc. Dogs, yes,
but not other animals.
He further stated he just wanted to make the Board aware of this and perhaps the
Board would want to by-pass it for the time being unless we get more public input.
Attorney Conlon said he thought we do have a nuisance ordinance in the event we
have a case where an animal has become a nuisance. Mr. Fellows agreed that we have
such an ordinance.
Chairman Kirk thanked Mr. Fellows for his comments and stated he is very dis-
appointed that the public has not taken an interest in this matter and that he felt
it was almost impossible to draw up an ordinance without public input.
Following a discussion among Board Members, Attorney Conlon and Administrator
Westbrook and comments from citizens Mr. Wilmer Krutz and Andy Rubin, it was decided
to table this issue,
Attorney Conlon suggested a permanent file be kept by Mr. Fellows and Mr. Westbrook
with copies of advertisements, minutes of meetings, and anything pertaining to the
livestock ordinance and any other pertinent information to document exactly what the
Planning Board has done so if questioned five years down the road it can be documented
exactly what measures the Board has taken.
Member A1tobe1lo moved to table indefinitely the livestock ordinance. Seconded
by Member Mason. Motion carried.
ADJOURNMENT
There being no further business before the Planning Board, Member A1tobel10 moved
to adjourn. Seconded by Member Mason. Meeting adjourned at 7:24 P.M.
