The Planning Board/Board of Adjustments and Appeals of the City of Okeechobee, Florida, covened in its regular meeting in the Council Chambers, at City Hall, Okeechobee, on Tuesday, August 4, i981. at 7:00 P.M. Members Jim Kirk, Darrell Femeau, Jim Wright and Frank Altobello were present. Member Dale Burk was absent. Others present were: Mallette Westbrook, Building and Zoning Administrator; Beatrice Lowe, ::iecretary; David Conlon, Attomey. APPROVAL OF MINUTE::i Member Wright moved to approve the minutes of July 7, 1981 as presented. Seconded by member Iemeau. Members Wright, Femeau, rark and Altobello voted yes. 1'I.ember Burk was absent. Vote carried. SUE BURK.!:;;::> AND PAULETTE COCKRELL - REQUEST FOR ;::>PECIAL illCŒPTION ,-Sue Burkes and Paulette Cockrell appeared before the Board to request a special exception for a Day Care Center on the property at 406 N. W. 4th Street. There were no objections voiced. After discussion Mrs. Burkes and Mrs Cockrell agœeed to plant a hedge on the property within 90 days or the exception will expire and the business must move. The signed agreement will be attached to the minutes. The Board went over the findings for a special exception. Member Al tobello moved to grant this request for special exception with three months to make any necessary improvemants requested by the Board. Seconded by member Wright. Members Altobello, Kirk, Wright and Femeau voted yes. Member Burk was ab- sent. Vote carried. ADJOURNMENT Member Femeau moved to adjourn the Board of Adjustments and Appeals, seconded by member Wright. Members Kirk, Wright, Femeau and Altobello voted yes. rvJember Burk was absent. PlANNING BOARD CO-Lhainnan Kirk calied the Planning Board into session. 87 H8 APPROVAL OF MINUTES IvJember Ferneau moved to approve the minutes of July 7, 1981, meeting as presented, seconded by member Wright. Members Kirk, Fem.eau, Wright and Altobello voted yes. Member Burk was absent. Vote carried. L. M. TAYLOR - REQUEST FOR REZONING Phil Berger, representing L.M. Taylor, appeared before the Board to request a rezoning from Residential Single Family to Commercial, property on Highway 70 East. There were no objections voiced. After discussion the the Board went over the findings for a rezoning. Member Altobello moved to recommend to the council to grant this rezoning request, as read by Attorney Conlon, from Resdentiel Single Family to Commercial upon the conditions that this zoning will revert back to Residential and lose its commercial classification if the following conditions are not met. 1. The rendering presented is made a part of the request for our official files. 2. That actual construction in accordance with the rendering is commenced within 180 days from August 4, 1981. 3. That construction be based upon the proposed rendering and not material variance from it. 4. That construction will be completed within 365 days. 5. That the 70' foot right of way shown on the rendering be granted to the Public within 180 days commencing construction. 6. That adequate drainage is provided for and certified by the City engineer as being adequate, prior to any oc:cupancy of the structure requiring drainage. 7 . That the parking lot be paved and landscaped as presented in the rendering. 8. A hearing will be provided by the Board to consider any future extension upon request. Seconded by member Wright. Members Wright, Ferneau, Kirk and Altobello voted yes. Member Burk was absent. Vote carried. FENCING BORROW PITS Co-Chairman Kirk reètd a memo from Richard C. Fellows, that Belle G1ade was the only City, that was contacted, to have a requirement for fencing borrow pits. - - - - - - - Member Altobello moved to recommend to the Council to propose. an Ordinance to enforce a four (4) foot American wire fence to be placed around borrow pits. Seconded by Member Ferneau. Members Ferneau, Kirk, Altobello and Wright voted yes. Member Burk was absent. Vote carried. lANDSCAPING ORDINANCE IV1ember Wright moved to table discussion on this until the next meeting, seconded by member l'erneau. Members Ferneau, Kirk, Altobello and Wright voted yes. Member Burk was absent. Vote carried. ZONING ADM1NI:::>TRAl'OR Building and Zoning Administrator Westbrook asked the Board to consider rezoning a piece ot property between North a.Tld South Park Street to commerciaL After discussion and going over the District iegulations map. Member Wright moved to recommend to the Council to move Itemif4 of pennitted uses in Industrial to be renamed Item 1t3 of special exceptions in Industrial, seconded by member Altobello. Members Wright, Kirk, Altobello and Ferneau voted yes. Member Burk was absent. Vote carried. DARRELL FEHNEAU IVJember Ferneau asked the members to look in the code book at page 6:¿ on traffic, and asked the members for suggestions on the traffic problem in the City.
