Member Frank Altobello was absent. rv'.tembers Dale Burk, Darrell Ferneau, Jim Wright and James Kirk were present. Beatrice Lowe, Secretary; David Conlon, Attorney. Others present were: Mallette Westbrook, Building and Zoning Administrator; BOARD OF ADJUSTMENTS AND APPEALS Chainnan Burk called the Board of Adjustments and Appeals into session. APPROVAL OF MINUTES Appeal to Fire Chief's Decision, paragraph 5, to read. After reading from page 30-A, Chainnan Burk asked for a correction in ~~y 5, 1981 minutes on Gilbert Oil Company- paragraph I: 1-6 of the National Fire Code of 1979 as adopted through Ordinance by the City, Attorney Conlon asked Chief Tomey, if in issuing his order to Mr. Culbreth to comply with the 20' foot setback, he had considered this exception for him and if he Attorney Conlon also asked the Chief to explain: "What Mr Culbreth was appealing." determined that it is a recognized hazard to the point he will have to strictly comply. Chief Tomey's answer was yes to Attorney Conlon'"s question concerning his consider- with the code. Chief Tomey then explained Mr. Culbreth's appeal. Member Wright moved to approve the minutes of the May 5, 1981 meeting as corrected. Altobello was absent. Vote Carried. Seconded by member Ferneau. Members Kirk, Wright, Ferneau and Burk voted yes. Member LAN AND NORMA ARMSTRONG AND RICHARD AND HELEN WARD- REQUEST FOR SPECIAL EXCEPTION Richard Ward appeared before the Board of Adjustments and Appeals to request a special exception to build professional and business office "spaces at N.W. 5th street and N. W. 2nd Avenue. After going over the findings for a special exception member 83 -..I PH Kirk moved to grant the request for special exception with a 6 months time limit to begin construction and to be completed 15 months after construction has begun and the size of the building to be in accordance with the code. Seconded by member Ferneau. r·1embers l(irk, Wri.ght, Ferneau and Burk voted yes. Member Altobe1lo was absent. Vote carried. BEN BURDESHAW - REQUEST FOR SPECIAL EXCEPTION Ben Burdeshaw, on behalf of Ranch Fertilizer, appeared before the Board to re- quest a special exception to put a mobile home on the property at 710 N.E. 5th Avenue to be used as a residence for a security guard. After reviewing the Ordinance 11402 and a lenghty discussion the Board felt it could not grant a special exception to this request. The Board suggested Mr. Burdeshaw go to the City Council and make a recommend- ation to the Council to amend Ordinance 1402. ADJOURNMENT :Member Ferneau moved to adjourn, seconded by member lark. Members lark, Wright, Ferneau and Burk bated yes. ~.tember Altobel10 was absent. Vote carried. PLANNING BOARD Chainnan Burk called the Plarming Board into session. JOHN STROUD - REQUEST FOR SPECIAL EXCEPTION John Stroud appeared before the P1arming Board to request a special exception to put a travel trailer on.his property at 908 N. W. 3rd Street to live in, while completing his house. After discussion on this request, Member Wright moved to recommend to the Council to grant a 60 day temporary use permit to Mr. Stroud, seconded by member Kirk. Nembers Kirk, Wright Ferneau and Burk voted yes. ~1ember Altobel10 was absent. Vote carried. APPROVAL OF MINUTES :Member lark moved to approve the minutes of the ~Jay 5, 1981 meeting as presented. Member Kirk moved to approve the minutes of the June 2, 1981 meeting as presented, seconded by member Ferneau. Members Kirk, Wright, Ferneau and Burk voted yes. :tv1ember Altobello was absent. NORTON - REQUEST FOR REZONING John Cassels, representing Wallace Norton, appeared before the baard to request a rezoning from Residential Single Family to Commercial, lot 6, Block 143, City of Okeechobee to be used as an Orthodontist office. Rev. Kilgore representing the Church of God noted to the Board that they were in favor of the request. There were no objection voiced. The Board went over the findings for a rezoning. r'1ember Kirk moved to recommend to the Council to grant this rezoning request from Residential Single Family to Commercial, seconded by member Wright. Members Kirk, Wright, Ferneau and Burk voted yes. Ivfember Altobello was absent. Vote carried. JAJ.1ES R. TENNISWOOD - REQUEST FOR REZONING James R. Tennis'WOod appeared before the Board to request a rezoning from Residential General (RG-2) to Commercial, lots 1,2,3, and 4, Block 142, to build professional Offices. There were no objection from the audience. The Board went over the findings for a rezoning. Member Ferneau moved to recommend to the Council to approve the request for rezoning this property from Residential General (RG-2) to Commercial, seconded by member Wright. Members Burk, Ferneau, Wright and Kirk voted yes. r-Iember Altobel10 was absent. Vote carried. POSSIBLE NEED TO Ar-ffiND ORDINANCE # 402 Member Wright moved to table a possible amendment to Ordinance 11402 on mobile homes as security shelters until the Board could study the code further and bring it back to the next meeting. POSSIBLE NEED TO A:tvŒND ORDINANCE # 402 :tvfember Kirk moved to recommend to the City Council to amend Ordinance 1/402, page 38, section 9. 2 to read as follows: PROCEDURES IN SECURING A TEMPORARY USE PERMIT UNDER SUBSECTION 1. ABOVE Temporary use permit application for uses set out in subsection 1, above, shall be submitted to the Pla":Uling Board, which may grant or deny a temporary use permit, or may grant a temporary use permit subject to suitable conditions, safeguards, and stipulations. A public hearing, with due notice, is required before the Planning 85 ..... ~JH Board. The rest of the section will stay the SéllJle as it is. POSSIBLE NEED FOR AMEND~T OF THE ORDINANCE REGARDING UNFENCED AND/OR UNFILLED BORROW PITS Chainnan Burk read an Ordinance received from the Orange Park code to the Board on Excavation and/or filling. After discussion Chainnan Burk asked R. C. Fellows to notify others cities to see what kind of fencing is required in their city, also Attorney Conlon to check into grandfathering in of barrowed pits. LANDSCAPING ORDINANCE :f;fember Ferneau moved to put the study an.d discussion of the Landscaping Ordinance on the next agenda, seconded by member Kirk. r'1embers Kirk, Wright, Ferneau and Burk voted yes.
