1980-11-04 - -- -- ELEVENTH MEETING TUESDAY, NOVEMBER 4, 1980 The Planning Board and Board of Adjustments and Appeals of the City of Okeechobee, Florida, convened in its eleventh Regular Meeting in the Council Chambers at City Hall, Okeechobee, on Tuesday, November 4, 1980, at 7:00 P.M. Members Frank Altobello, Dale Burk, Darrell Ferneau, James Kirk and Jim Wright were present. Others present were: Mallette Westbrook, Building Official; David Conlon, City Attorney, and Janice M. Mann, Deputy Clerk. BOARD OF ADJUSTMENTS AND APPEALS Member Wright nominated Dale Burk as temporary Chairman of the Board of Adjustments and Appeals and Planning Board, seconded by Member Altobello, vote unanimous. Pro-Tem Chairman Dale Burk called for nominations for permanent Chairman of the Board of Adjustments and Appeals and also the Planning Board, whereby it was moved by Member Altobello and seconded by Member Wright to appoint Dale Burk as permanent Chairman of both Boards, vote unanimous. APPROVAL OF MINUTES Member Wright moved to approve the minutes of the Board of Adjustment and Appeals as presented, seconded by Member Altobello, vote unanimous. W. ALLEN MARKHAM - REQUEST FOR VARIANCE Mr. W. Allen Markham not being present, the request for variance was tabled. ANTON HOEL - REQUEST FOR SPECIAL EXCEPTION Mr. Anton Hoel, representing the Morman Church, appeared before the Board to affirm and elaborate his request for a special exception, allowing a church to be built on less than five acres. Property located at the north east corner of South West 6th Street and South West 4th Avenue (Block 195). The plans of construction include three phases, the Board to rule on Phase I. Mr. Hoel presented a complete set of plans which included landscaping and adequate parking. The Board reviewed the nine requirements of Zoning Ordinance #402 and found that the construction of a church on Block 195 caused no problems. No further discussion, Member Altobello moved to grant the petition for a Special Exception for the Church, upon the condition that construction commence on Phase I within ninety (90) days, 2nd that the parking lot, sign and building be built according to the plans and specifications on file in the Building Department, seconded by Member Wright, vote unanimous. Building Official Westbrook waived the right to appeal the decision within fifteen (15) days, so construction can begin immediately. Member Altobello moved to adjourn the meeting of the Board of Adjustments, seconded ~n. Oil 09 by Member Ferneau. Motion and second withdrawn to discuss the duties of the Board. DUTIES OF BOARD OF ADJUSTMENTS AND APPEALS Attorney Conlon elaborated on the duties of the Board of Adjustments and Appeals as set out in Zoning Ordinance #402: 1) Power over Zoning Administrator 2) Granting variances and special exceptions only if there is a unique characteristic. The Board discussed the jurisdiction of the Board of Adjustments and Appeals. Chairman Burk stated the Board had two options, 1) take each request for variance on a case by case basis, or 2) have the Planning Board recommend, to the City Council, that the Zoning Ordinance be amended to require 95' frontage instead of 100'. After lengthy discussion the Board agreed to recommend, as the Planning Board, an amendment of the front footage requirement. MARKHAM - REQUEST FOR VARIANCE W. Allen Markham appeared before the Board regarding his request for a variance on the following parcel of land: Lots 1 & 2, Block 178, City of Okeechobee After brief discussion the Board advised Mr. Markham that a variance was not needed, if the triplex is built facing South West 6th Avenue, which has a 142.50 foot frontage. All other requirements have been met. Member Altobello moved to adjourn the meeting of the Board of Adjustments and Appeals, seconded by Member Ferneau, vote unanimous. PLANNING BOARD APPROVAL OF MINUTES Member Altobello moved to approve the minutes of the October 7, 1980, Planning Board meeting, seconded by Member Ferneau, vote unanimous. PROPOSED LOT CLEARANCE ORDINANCE Attorney Conlon reviewed several points to be considered for a Lot Clearance ordinance. The Board discussed the different possibilities and agreed a great deal of thought and study is needed. The Board agreed to review the sample ordinance from other cities, then discuss details at the next meeting. AMENDMENTS TO ZONING ORDINANCE #402 AMENDMENT #1 Member Ferneau moved to recommend the City Council amend Zoning Ordinance #402 and -- .. .. - - - reduce the required front footage of Residential, General (RG) zoned property from 100 feet to 95 feet, seconded by Member Altobello, vote unanimous. AMENDMENT #2 Member Wright moved to recommend City Council amend Zoning Ordinance #402 to require paved or concrete off-street parking, seconded by Member Kirk, vote unanimous. Board instructed Attorney Conlon to draft the necessary ordinance amendment titles to be advertised. ZONING ORDINANCE #402 - PENALTY (Page 69) Member Ferneau brought to the Board's attention the fact that the penalty clause on page 69 of Zoning Ordinance #402 was not complete. Attorney Conlon to check into the matter and report back.
