NINETH MEETING
TUESDAY, SEPTEMBER 2, 1980
The Planning Board and Board of Adjustments and Appeals of the City of Okeechobee,
Florida, convened in its nineth Regular Meeting in the Council Chambers at City Hall,
Okeechobee, Florida, at 7:00 P.M., Tuesday, September 2, 1980.
Chairman Jerry Walker presiding with the following members present: Darrell Ferneau,
Jim Wright and Frank Altobello.
Others present were: David Conlon, City Attorney; Mallette Westbrook, Building
Official and Janice M. Mann, Deputy Clerk.
BOARD OF ADJUSTMENTS AND APPEALS
APPROVAL OF MINUTES
Member Wright moved to approve the minutes of the Board of Adjustments and Appeals
as presented, seconded by Member Ferneau, vote unanimous.
REQUEST FOR HEARING DATE - ORIN LEE
Chairman Walker presented a request for a hearing from Orin Lee. Lee is seeking a
variance.
Member Ferneau moved to hear the appeal for a variance at the October 7, 1980, meeting,
seconded by Member Altobello, vote unanimous.
HENDRICKSON - REQUEST FOR VARIANCE
Ms. Lorraine A. Hendrickson appeared before the Board and presented a request for a
variance of 14.55' to meet minimum side yard requirements allowing the lots to be divided.
Attorney Conlon advised there was no problem legally but a variance is needed to
divide the lots.
Member Wright moved to grant the necessary variance as requested, seconded by Member
Ferneau, vote unanimous.
POLLARD - REQUEST FOR VARIANCE
Attorney Anthony Young presented the request for a variance for Eugene and Betty
Pollard which, if granted, would allow them to build a home in a Residential, Mobile Home
zoned district.
Attorney Young maintained that a building permit was issued and then revoked, which
created a hardship for the Pollards.
Chairman Walker was of the opinion that the permit was issued to build an addition
only and not a dwelling.
Donald Wells, assistant Building Official at the time the permit was issued, confirmed
the fact the permit was issued to build an addition only.

Board Members reviewed the plans submitted, noting the plans had no provisions for
bathroom facilities.
After lengthy discussion, Member Altobello moved to table the issue until the October 7th
meeting, seconded by Member Wright, vote unanimous.
Rather than tabling for further discussion at the next meeting and detaining the
Pollards from obtaining a dwelling, the Pollards agreed to work out details with Building
Official Westbrook. Plans for an addition to be submitted for a new permit.
There being no further business the Board of Adjustments and Appeals, Member Ferneau
moved to adjourn, seconded by Member Altobello, vote unanimous.
PLANNING BOARD
APPROVAL OF MINUTES
Member Altobello moved to approve the minutes of the August 5, 1980, Planning Board
meeting, as presented, seconded by Member Ferneau, vote unanimous.
REZONING REQUEST - MASON
Brenda Mason appeared before the Board to request the rezoning of Lots 1 thru 6
inclusive, Block 24, 1st Addition to South Okeechobee, from Residential, Single Family to
Residential, General. Ms. Mason presented detailed plans for the duplex apartments.
Chairman Walker called for comments of citizens present.
Doris Thomas - 1411 S.W. 3rd Avenue (Lots 9, 10, 11 and 12, Block 24)
objected to any change.
James W. Mueroter - 1401 S.W. 3rd Avenue (Lots 7 and 8, Block 24) both
husband and wife objected to the change.
Claudet Miller - 1315 S.W. 3rd Avenue (Lots 11 and 12, Block 21) objected
to rezoning to allow duplexes.
Member Altobello was of the opinion that the proposed apartments would blend with
single family dwellings, as opposed to an eventual commercial district.
With the assistance of Attorney Conlon, the Planning Board reviewed the sixteen require-
ments for a zoning change before rendering a decision.
Member Ferneau noted the rezoning request was spot zoning and a similar request in the
same general area was denied last year for that very reason.
In light of the oppostion and the fact it is spot zoning, Member Ferneau moved to
recommend Council deny the rezoning request, lack of second. Ferneau withdrew his motion.
Member Altobello moved to recommend the City Council grant the rezoning request of
Brenda Mason, the surrounding area being such that spot zoning in this case would be an

Ferneau and Walker Opposed, due to the three citizens. Split decision
improvement, seconded by Member Wright. Members Altobello and Wright voted yes, Members
LOT CLEARANCE ORDINANCE
Board discussed briefly different aspects of a proposed Lot Clearance Ordinance. It
was agreed that difficulties may arise when drafting such an ordinance.
Attorney Conlon suggested that Martin County and the City of Port St. Lucie be
contacted for a copy of their ordinances. Board agreed.
Chairman Walker requested that Councilman Burk attend the Workshop sessions to aid
in the drafting and planning. All agreed.
ADJOURNMENT
Member Wright, vote unanimous.
There being no further business, Member Altobello moved to adjourn, seconded by
