1979-09-04 -- -- -- EIGHTH MEETING TUESDAY, SEPTEMBER 4, 1979 The Planning Board of the City of Okeechobee, Florida, convened in its Eighth Meeting in the Council Chambers at the City Hall, Okeechobee, Florida, at 7:00 P.M., Tuesday, September 4, 1979. Chairman John D. Cassels, Jr. presiding. Others present were: Jim Wright, Christina Hooker, Frank Altobello, Robert Joiner; David Conlon, City Attorney and Janice M. Mann, Secretary BOARD OF ADJUSTMENTS AND APPEALS REQUEST FOR VARIANCE - HARDEN Hubert Harden appeared before the Board of Adjustments and Appeals re- questing a five (5) foot variance on Lot 20, Block 9, City of Okeechobee. The Board reviewed the guidelines before rendering a decision as follows: 1) Do special conditions and circumstances exist which are peculiar to the land which is not applicable to other lands, stvuctures, or buildings in the same zoning district? Yes, if there are other dwellings already in existance on the adjacent lots the property then becomes useless without a variance. 2) Are there special conditions and circumstances not result of the actions of the applicant? No. 3) Would a literal interpretation of the provisions of the zoning ordinance deprive the applicant of rights commonly enjoyed by other properties in the same zoning district? Yes. 4) What is the minimum variance that will make possible the reasonable use of the land, building or struct~re? The five (5) feet requested. 5) Granting the variance requested will not confer the applicant any special privilege that is denied by this zoning ordinance to other lands, buildings, or structures in the same zoning district. No, granting this is in accordance with what has been done in the past. 6) Would the grant of the variance be in harmony with the general intent and purpose of this zoning ordinance, and will not be injurious to the neighbor- hood, or otherwise detrimental to the public welfare? Yes. With no further discussion, Member Wright moved to grant the variance of five (5) feet necessary to build as requested in the application, seconded by Member Hooker, vote unanimous. ~ 23 4 - pc; Member Altobello moved to adjourn the Board, seconded by Member Hooker, vote There being no further business of the Board of Adjustments and Appeals, unanimous. PLANNING BOARD REZONING REQUEST - LASHLEY James D. Lashley and Murray Fulford (neither present) made application Residential, Single Family. for the rezoning of All of Block 5 and 6, City of Okeechobee from Holding to One letter of objection was presented to the Board from Mrs. Hyman Nisson City of Okeechobee. of 1202 N.W. 8th Avenue, Lots 1 thru 12, Block 7 and Lots 1 thru 6, Block 10, weather. No reason was stated for the Objection. Mrs. Nisson was unable to be present due to inclement ing rezoning requests unless a plan of use is presented. Attorney Conlon suggested the Planning Board adopt a policy of not grant- whether Mr. Lashley understood the type of application he made. Chairman Cassels did not see the need of tabling the request to determine for the most restrictive type of use with gUidelines. Cassels felt plans should not be required when the request is specifically Chairman Member Altobello requested this issue be tabled for two reasons, 1) more detailed information from the owner and 2) Mrs. Nisson shoud have the privilege of coming before the Board to voice her objections. seconded by Member Joiner. With no further discussion, Member Altobello moved to table the request, Members Cassels and Wright voted no. Members Hooker, Joiner, and Altobello voted yes. Vote carried.
