A. Comprehensive Plan, Future Land Use Map Amendment Application No. 05- Jim LaRue, City Planning Consultant, briefly described the Staff Report as follows:
005-SSA. Consider a recommendation to the City Council, to change the land
use designation from Multi-Family to Commercial. The subject properties are Planning Staff Report Summary of Application: The applicants are proposing to amend the

Planning Staff Report Comprehensive Plan Analysis: (A) Consistency with the Land Use
Categories and Plan Policies. As proposed, the applicants' request is consistent with Objective 2
and Policy 2.1 (c) of the Future Land Use Element. This Future Land Use Map Amendment will
bring consistency with the current zoning of a portion of the property, as stated earlier. Objective
2: The City ofOkeechobee shall continue to ensure that all new development is consistent with the
Future Land Use Element. Policy 2.1: The following land use designations are established for the
purpose of managing future growth: (c) Commercial. Permitted uses include, office, retail,
automotive wholesale, and related commercial activities. Also permitted are public facilities.
Commercial development shall not exceed a floor area ration on .00 and the maximum impervious
surface for development within this category shall not exceed 85% ofthe site. (B) Concurrency
of Adequate Public Facilities. The subject property is already developed and has adequate public
facilities. (C) Compatibility with Adjacent and Nearby Land Uses. The current existing land use
commercial plaza, an art gallery and a church parking lot. (D) Compliance with Specific
Standards of the Plan. The City's Comprehensive Plan goals, objectives and policies, as they are
intended, could allow for an amendment to the Future Land Use Map to Commercial. This
proposed amendment would be consistent and provide a link to the existing uses that are
established.
Planning Staff Report Analysis and Conclusions: This application and its appearance before the
City Council and the LP A were duly noticed for the public in accordance with public notice
requirements under Florida Statutes, Chapter 163. Based on the Comprehensive Plan, its goals,
objectives and policies, the location of this property, and due consideration of the adjacent land
uses, it is recommended that this application for a Small Scale Future Land Use Map Amendment
be approved as it is consistent with the Comprehensive Plan.

Planning Staff Report Analysis and Conclusions: This application and it appearance before

Planning Staff Report Comprehensive Plan Analysis: (A) Consistency with the Land Use
Categories and Plan Policies. Based on the application, the proposed use is consistent with

Public Facilities. Water is available to both sites. Sewer is available at the South lot line of Lot
10. Extension of sewer would be required for Lots 6 and 7 if developed separately from Lots 8, 9,
and 10. If developed as one site the sewer could flow to an existing manhole near Lot 10. S.E. 8th
Avenue is paved and maintained by the City. The proposed Multi-Family use will require, if
approved, a site plan at the Development Review stage. This will ensure that this type of development
would not adversely impact S.E. 8th Avenue or SR 70. The applicant could provide a traffic impact
study to show the effect on S.E. 8th Avenue. The development will not negatively impact schools.

c. Comprehensive Plan, Future Land Use Map Amendment Application No. 05- (C) Compatibility with Adjacent and Nearby Land Uses. The proposed land use will not create
007-SSA, continued. any adverse impacts to the surrounding property and it will be compatible with adjacent and nearby
uses. Given the property's proximity to Taylor Creek, staff is concerned that development
might negatively impact this environmentally sensitive area. The Taylor Creek right of way per
recorded plat should be recognized as non-buildable. Enforcement ofthe Land Development Code
regulation and specific policies in the Future Land Use and Conservation Elements could help
. curtail any impacts this development could have. Future Land Use Policy 2.3: The City shall
continue to require that all development proposals be accompanied by an inventory of wetlands,
soils posing severe limitation to construction, unique habitat, City shall further require that the
extent to which any development or redevelopment is proposed to be placed in/on, to disturb, or
to alter the natural functions of any ofthese resources, be identified. Such identification shall occur
at a phase in the development review process that provides the opportunity for the City to review
the proposed project to ensure that direct and irreversible impacts on the identified resources are
minimized, or in the extreme, mitigated. Where development is determined to encroach upon a
resource, the City shall require a specific management plan to be prepared by the developer, which
results in no net loss of wetlands and which includes necessary modifications to the proposed
development, specific setback and buffers, and clustering of development away from site resources,
to ensure the protection, preservation or natural functions ofthe resource. The minimum buffer for
wetlands shall be 25 feet and the average of all setbacks from the wetland resource shall be 40 feet.
Areas designated as buffers shall preserve all natural vegetative cover, except where drainageways
and access paths are approved to cross the buffer. Buffers may be supplemented only with native
tress, shrubs and ground covers. Policy 7. : e Ity s a con mue 0
development regulations consistent with the Florida Department of Environmental Protection's
(FDEP) best management practices referenced in Policy 1.4, which will minimize the flow into
Taylor Creek of organic nutrients, pesticides, sediment, and other substances having the potential
to degrade water quality. Conservation Element. Policy 4.1: Through Future Land Use Policy 2.3
and implementing land development regulations, the City shall continue to conserve wetlands and
protect water quality in Taylor Creek from adverse impacts of development. Policy 5.1: The City
shall enforce provisions in its land development regulations to ensure that new development,
regardless of its location in the City, meets the following conditions:(a) does not degrade water
quality in Taylor Creek; (b) does not threaten groundwater quality, particularly in the vicinity of
municipal wells; (c) preserves existing wetland areas; (d) avoids the disturbance of natural drainage
features; and (e) preserves habitat for endangered and/or threatened wildlife species. (D)
Compliance with Specific Standards of the Plan. The goals, objectives and policies, as they are

Planning Staff Report Analysis and Conclusions: This application has been duly noticed for
. the public in accordance with Chapter 163. F. S. Based on the application being consistent with
the Comprehensive Plan, Staff recommends approval to amend the Future Land Use Map from
Single-Family to Multi-Family.
Agency Member McCoy questioned the existing use of the property. He also questioned Mr.
LaRue whether he felt that this is spot zoning.
Jim LaRue responded that there are four lots and one rental house. Mr. LaRue explained that there
is Commercial Future Land Use to the East, and that he feels Multi-Family is more appropriate
than Commercial to help protect Taylor Creek. Mr. LaRue also explained that the Multi-Family
would have a lower density near Taylor Creek keep the environmental impact to a minimum.
Agency Member McCoy explained that he was concerned with the traffic impacts that the proposed
multiple family development could cause.
Jud Kasten, representative for the property owner and applicant, explained to the Agency that
AZBLUE, LLC is proposing to construc we v overlookin
Taylor Creek. Ms. Kasten explained that during the development of the property the developers
will try to preserve the trees as well as Taylor Creek. Ms. Kasten stated that the existing home that
will be demolished. She continued, the townhomes will not be rentals, but will be owned outright.
She stated that the driveway will not be located right across the street from the commercial
entrance, but will be relocated to keep the traffic impacts to a minimum.
Agency Member K. Keller questioned Ms. Kasten whether the units will all be under one roof, or
if there will be several buildings.
Ms. Kasten responded that the final determination has not yet been made; however, it will possibly
be three buildings each containing four units, or four buildings each containing three units.

Summary:
The applicant is proposing to amend the Future Land Us Map to allow Multi-Family
uses on the property. The subject property is currently ithin the RMF zoning
district and this request would provide consistency betw en the land use and zoning.
Comprehensive Plan Analysis
A. Consistency with the Land Use Categories and PI n Policies.
Based on the application, the proposed use of a triple is consistent with
Objective 2 and Policy 2.1(b):
Objective 2: The City of Okeechobee shall continu to ensure that all new
development is consistent with the Fut re Land Use Element.
Policy 2.1: The following land use designations a e established for the purpose
. of managing future growth:
(b) Multi-family Residential. Pe itted uses include
apartments, duplexes, condomi iums, single-family houses
, and public facilities. Maximu density shall not exceed 10
units per acre. Where affordab e housing is provided in
accordance with Housing Polic 1.6, the maximum density
for multi-family development s all be 11 units per acre.
B. Concurrency of Adequate Public Facilities
Water is available to the subject property. obee Utility Authority
offers two options for sewer for this site.
1. Extend gravity sewer along N.W. 11 th Stre t from an existing manhole
at N.W. 5th Avenue and 11 th Street to the s te: or
2. Install a small sewer pump station at the si e and pump sewer into a 12
inch force main on the South and West sid of the site.
Impacts on traffic and schools will be minimal. Any ther concerns regarding the
development can be reviewed at the Site Plan Review tage.
C. Compatibility with Adjacent and Nearby Land Us s
The proposed land use will not create any adverse imp cts to the surrounding
property as it will be compatible with the adjacent and nearby uses.

We are requesting a change in future land se for lots 6 -10
Taylor Creek Manor on SE 8th Avenue from residential to multi
family. The location is approximately 250 feet so th of State Road 70
and directly across from the Royal's Furniture sh pping plaza.
We would like to build 12 townhouses to b sold as
residential homes. We envision these units being 1,200
square feet each, two stories high with two bedrooms, two
baths and single car garage. These units w uld overlook
Taylor Creek, with a wall or hedge as a bu er to the street.
If approved, we feel our project will be an nhancement to

Summary:
The applicant is proposing to amend the Future Land U e Map to allow Multi-Family
uses on the property. The site is within the RMF zoning district and this request
would provide consistency between the Future Land Us category and the existing
zonmg.
Comprehensive Plan Analysis
A. Consistency with the Land Use Categories and PI n Policies.
Based on the application, the proposed use is consist nt with Objective 2 and
Policy 2.1 (b) of the Future Land Use Element.
Objecti~e 2: The City of Okeechobee will ensure t at all new development is
consistent with the Future Land Use ement.
Policy 2.1: The following land use designations e established for the purpose
, of managing future growth:
(b) Multi-family Residential. Pe itied uses include
apartments, duplexes, condom niums, single-family houses
and public facilities. Maximu density shall not exceed 10
units per acre. Where affordab e housing is provided in
accordance with Housing Poli 1.6, the maximum density
for multi-family development hall be 11 units per acre.
B. Concurrency of Adequate Public Facilities
Water is available to both sites. Sewer is available at he South lot line of Lot 10.
Extension of sewer would be required for Lots 6 and if developed separately
from Lots 8, 9, and 10. If developed as one site the s wer could flow to an
existing manhole near Lot 10.
S.E. 8th Avenue is paved and maintained by the City. he proposed Multi-Family
use will require, if approved, a site plan at the Develo ment Review stage. This
will ensure that this type of development would not a versely impact S.E. 8th
A venue or SR 70. The applicant could provide a traf c impact study to show the
effect on S.E. 8th Avenue.
The development will not negatively impact schools.

Policy 4.1: Through Future Land Use Policy 2.3 d implementing land
development regulations, the City shal continue to conserve
wetlands and protect water quality in aylor Creek from adverse
impacts of development.
Policy 5.1: The City shall enforce provisions in it land development
regulations to ensure that new develop ent, regardless of its
location in the City, meets the followi g conditions:
(a) does not degrade water quality 'n Taylor Creek;
(b) does not threaten groundwater uality, particularly in the
vicinity of municipal wells;
(c) preserves existing wetland area ;

(d) avoids the disturbance of natur I drainage features; and
(e) preserves habitat for endangere and/or threatened wildlife
r speCIes.
D. Compliance with Specific Standards of the Plan.
The goals, objectives and policies, as they are intende within the
Comprehensive Plan, would allow for an amendment 0 the Future Land Use
Map to Multi-Family. The proposal would be consist nt with uses allowed
within the Multi-Family category.
Analysis and Conclusions
This application has been duly noticed for the public in ac ordance with Chapter 163.
F.S. Based on the application being consistent with the C mprehensive Plan, Staff
recommends approval to amend the Future Land Use Ma from Single-Family to
Multi-Family.

C. Compatibility with Adjacent and Nearby Land U es
The proposed land use will not create any adverse im pacts to the surrounding
property and it will be compatible with adjacent and earby uses.
Given the property's proximity to Taylor Creek, staff is concerned that
development might negatively impact this environmE ntally sensitive area. The
Taylor Creek right of way per recorded plat should b recognized as non-
buildable. Enforcement of the Land Development C de regulation and
specific policies in the Future Land Use and Conserv ltion Elements could help
curtail any impacts this development could have.
Future Land Use
Policy 2.3: The City shall continue to require that all development
proposals be accompanied by an inver tory of wetlands, soils
. posing severe limitation to constructic n, unique habitat,
City shall further require that the exte t to which any development
or redevelopment is proposed to be pI ced in/on, to disturb, or to
alter the natural functions of any of th se resources, be identified.
, Such identification shall occur at a ph se in the development
review process that provides the oppo iunity for the City to review
the proposed project to ensure that dir ct and irreversible impacts
on the identified resources are minimi ?:ed, or in the extreme,
mitigated. Where development is dete mined to encroach upon a
resource, the City shall require a spec' ~c management plan to be
prepared by the developer, which resu ts in no net loss of wetlands
and which includes necessary modific itions to the proposed
development, specific setback and bu fers, and clustering of
development away from site resource~ , to ensure the protection,
preservation or natural functions of th resource. The minimum
buffer for wetlands shall be 25 feet an :i the average of all setbacks
from the wetland resource shall be 40 feet. Areas designated as
buffers shall preserve all natural veget ative cover, except where
drainage ways and access paths are apl roved to cross the buffer.
Buffers may be supplemented only wi h native tress, shrubs and
ground covers.
Policy 7.1: The City shall continue to amend and ~nforce land development
regulations consistent with the Florida Department of
Environmental Protection's (FDEP) b st management practices
referenced in Policy 1.4, which will m inimize the flow into Taylor
Creek of organic nutrients, pesticides, sediment, and other
substances having the potential to deg ade water quality.
