Jim LaRue, City Planning Consultant, briefly re-described the Staff Report
last months Agency meeting as follows
Planning Staff Report Summary of Application: The applicant purchased these lots from the
Stokes Fish Company. In researching the property's history, staff has concluded that the previous
business operated without an occupational license. According to the applicant's letter of request
for a land use change, the request is being made to accommodate a commercial fishery and in
order to receive an occupation license for the intended use.
Comprehensive Plan, Future Land Use Map Amendment Application No. 04-
007-SSA. Consider a recommendation to the City Council, to change the land
use designation from Single-Family to Commercial. The subject property is
located at 701 NE 3rd Street. Carey and Gerry Harden are the property owners
and applicants - City Planning Consultant.

anmng Staff Report Comprehensive Plan Analysis: (A) Consistency with the Land Use
Categories and Plan Policies. The surrounding land uses are Single-Family. In examining these
uses, it appears that the proposed land classification of Commercial would create isolated land use
designation. Since there are no commercial uses surrounding the property such a request to
Commercial would be inconsistent with the Goals, Objectives, and Policies of the City of
Okeechobee's Comprehensive Plan and would not be considered suitable for the property. (B)
Concurrency of Adequate Public Facilities. Public utilities would be available to the site. The
roads along NE 3rd and NE 7th are paved and maintained by the City. A commercial use on the
subject property will not strain transportation facilities, but the impact of fish processing on the
sewer system is not known at this time. (C) Compatibility with Adjacent and Nearby Land Uses.
As stated earlier, the proposed land use of Commercial would create an adverse impact to the
adjacent and nearby land uses by officially establishing an isolated future land use classification

and consistent commercial zoning. Allowing this request could create an undesirable pattern of
commercial uses along the Taylor Creek area. (D) Compliance with Specific Standards of the
Plan. The proposed request is not consistent with the City's Comprehensive Plan. Listed below
are land use policies that staff considered when reviewing the applicant's request. Future Land
Use Element Policy 2.2: In accordance with property rights policies adopted by the Central
Florida Regional Planning Council in the Central Florida Regional Policy Plan, the City of
Okeechobee recognizes and shall continue to protect private property rights. In implementing the
Comprehensive Plan, the City shall continue to ensure that its land development regulations protect
the use and value of private property from adverse impacts of incompatible land uses, activities,
and hazards. Planning for land use and public facilities in the City shall consider private property
rights, and ensure citizen input into government land use making decisions affecting property
rights. Policy 3.2: The City of Okeechobee shall amend its land development regulations, by
2002, to prevent expansion of existing land uses which are inconsistent with the Future Land Use
Element. These regulations shall be enforced to ensure that when such land uses are discontinued,
they shall not be reestablished. Objective 9: The City ofOkeechobee shall continue to ensure that
proposed land use activities in the Taylor Creek area are not inconsistent with the stated goal of
the Resource Management Plan for the Lower Kissimmee River and Taylor Creek Drainage Basis,
prepared pursuant to Chapter 380, Florida Statutes.

Planning Staff Report Analysis and Conclusions: The applicant's request is inconsistent with
the Comprehensive Plan Goals, Objectives, and Policies. As such, the location of the property and
the Intended use are inconsistent with surrounding property and would create an isolated district
within the area. In this instance, it is a separate issue as to whether a nonconforming use has been
abandoned or not because of changing operators/owners. Staff recommends denial of the request
to amend the Future Land Use Map from Single Family to Commercial

Mr. LaRue continued by explaining that he still has

that are permitted within the Commercial Land Use Designation.
Attorney John Cook explained to the Agency that it would be difficult to recommend approval for
the Commercial request due to the location. He recommended that the Agency table the petition.

options. It will be possible that the petition will be withdrawn from the Land Planning Agency all
together. He explained that the applicant may fall under Section 50-45 in the Occupational License
division of the Code, stating that an occupational license may not be required for such a use

To Whom it may concern:
The property located at 701 NE 3rd St., previously owned
by Stokes Fish Compan~ of Leesburg, has been a liscensed
fish processing facility for 40 or more years.
I purchased the property with the intention of keeping it
as the same business. If I am given the re uested use change,
it would b~nefit manY, Okeechobee residents, as there are
several commercial fishermen and thier families wm&bh earn
thier living selling thier catch to fish c mpanies. These
same fishermen provide income to many othe people such as
line rackers, bait suppliers,aand other hi ed help. There
will also be several jobs provided by the ish company, like
fish cleaners and laborers. My family and will provide
a clean, safe, respectable place to buy fi h. When the
tourist corne to buy some famous "Lake Okee hobee Catfish"
they will feel good about buying from our ompany and won't
hesitate to return or recommend us to othe s. We will also
be able to help supply local restaurants w'th catfish. We will
help our surrounding neibors by cleaning u a previous
eyesore in the community, as the tenants b fore our purchase
did not maintain the property. As a 3rd ge eration commercial
Fisherman myself, I am knowledgable in eve y aspect oftthis
business, and I will maintain an operation that the fishermen
can be proud to be a part of.

Background Summary:
The applicant purchased these lots from the Stokes Fish Company. n researching the property's
history, staff has concluded that the previous business operated wit out an occupational license.
According to the applicant's letter of request for a land use change, he request is being made to
accommodate a commercial fishery and in order to receive an occu ation license for the intended
use.
Comprehensive Plan Analysis
A. Consistency with the Land Use Categories and Plan Poli ies.
The surrounding land uses are Single-Family. In examining hese uses, it appears that the
proposed land classification of Commercial would create an isolated land use
designation. Since there are no commercial uses surroundin the property such a request
to Commercial would be inconsistent with the Goals, Object ves, and Policies of the City
of Okeechobee's Comprehensive Plan and would not be con idered suitable for the
property.
B. Concurrency of Adequate Public Facilities
Public utilities would be available to the site. The roads alon NE 3rd and NE ih are
paved and maintained by the City. A commercial use on the ubject property will not
strain transportation facilities, but the impact of fish processi g on the sewer system is
not known at this time.
C. Compatibility with Adjacent and Nearby Land Uses
As stated earlier, the proposed land use of Commercial woul create an adverse impact to
the adjacent and nearby land uses by officially establishing isolated future land use
classification and consistent commercial zoning. Allowing t . s request could create an
undesirable pattern of commercial uses along the Taylor Cre k area.
D. Compliance with Specific Standards of the Plan.
The proposed request is not consistent with the City's Compr hensive Plan. Listed below
are land use policies that staff considered when reviewing th applicant's request.
Future Land Use Element
Policy 2.2: In accordance with property rights poli ies adopted by the Central
Florida Regional Planning Council in t e Central Florida Regional
Policy Plan, the City of Okeechobee rec gnizes and shall continue
to protect private property rights. In im lementing the

Comprehensive Plan, the City shall c ntinue to ensure that its land
development regulations protect the se and valued of private
property from adverse impacts of inc mpatible land uses, activities,
and hazards. Planning for land use a d public facilities in the City
shall consider private property rights, and ensure citizen input into
government land use making decision ajfecting property rights.
Policy 3.2: The City ofOkeechobee shall amend island development
regulations, by 2002, to prevent expa sion of existing land uses
which are inconsistent with the Futur Land Use Element. These
regulations shall be enforce to ensure hat when such land uses are
discontinued, they shall not be reestab ished
Objective 9: Tlte City of Okeecltobee sltall continu to ensure tit at proposed
land use activities in tlte Taylor Cree area are not inconsistent
witlt tlte stated goal of the Resource anagement Plan for the
Lower Kissimmee River and Taylor reek Drainage Basis,
prepared pursuant to Cltapter 380, Fl rida Statutes.
The applicant's request is inconsistent with the Comprehensive Plan oals, Objectives, and
Policies. As such, the location of the property and the intended use e inconsistent with
surrounding property and would create an isolated district within the ea. In this instance, it is a
separate issue as to whether a nonconforming use has been abandone or not because of
changing operators/owners.
Staff recommends denial of the request to amend the Future Land Us Map from Single Family
to Commercial.
