Staff Report Applicant: Charles & Myrna Farmer Small-Scale Comprehensive Plan Amendment Petition No. 04-O03-SSA The applicant's request, to change unplatted acreage from Single Family to Commercial Future Land Use, seems at first to be inconsistent with the current FLUM. However, this acreage is one of the few remaining areas having not been platted into Single Family lots and still containing Southern access to an arterial. The location of the Industrial Park to the north assures that there will be some north/south roadway access points into this region. The City's inventory of vacant commercial land is presently extremely limited. If this request is combined with other contiguous areas it would be appropriate to reconsider the Future Land Use map change to Commercial. It is also important that transportation impacts be shown for these proposed areas, preferably combined rather than separate reports. A. Consistency with the Land Use Categories and Plan Policies. The applicant's request is consistent with currently adopted Future Land Use Element policies and the use categories of the Comprehensive Plan. B. Concurrency of Adequate Public Facilities There is public water available near this property. Sewer is not currently available at this site. Some streets are not existing in this area. C. Compatibility with Adjacent and Nearby Land Uses The requested Plan Amendment can be consistent with nearby properties if they are also changed to Commercial Future Land Use. D. Compliance with Specific Standards of the Plan. See Below. City of Okeechobee April 20, 2004 MEMO Land Planning Agency re: meeting of April 27/amendment to LDR's It has come to our attention that there are certain discrepancies in division 9 of our zoning ordinances, which is for central business district (CBD); historically, this district has included the area of downtown on south Park Street, which are the storefront businesses that depend on street parking for their customers. As such, the codes allow up to 85% of the building lot to be covered by building, and up to 100% coverage including concrete or paving. However, this district has expanded over the years, and now generally runs from 7th avenue on the west, over to the boundary of Eckerd's on 3rd avenue on the east, down to V-save on the south and south park street, and up to Bank of America and park street on the north. The concern is that section 90-316 states that all other codes in the city apply in this zoning district, including parking, drainage and landscaping. However, if the building covers the entire lot, as is permitted, then there is no room to enforce parking and drainage. Our thinking is that we would not want to change the zoning district to absolutely require parking and drainage, as that would make all the buildings on Park street non-conforming. On the other hand, buildings like the bank, grocery store, and Tucker group realty have parking, and could not operate depending solely on the available on-street parking. Therefore, the city proposes to amend the CBD zoning district to continue to allow zero set-back and 85% lot coverage, but to require a developer to address parking, drainage, landscaping, and other areas of the code to the extent the physical parameters of their lot permit the city to do so. We have a similar requirement to bring non-conforming structures up to code when ownership changes hands, and while it has been difficult to consistently enforce, it has worked quite well. The request then is that the board vote to recommend to the city council to amend the zoning district requirements in this manner and set it for public hearing. ~t&f~ JOM R.
