Special Magistrate Azcona called the October 8, 2019, Code Enforcement Special Magistrate Hearing to order at 6:30
P.M. in the City Council Chambers, located at 55 Southeast 3rd Avenue, Room 200, Okeechobee, Florida.

Special Magistrate Azcona dispensed with the reading and approved the Summary of Action for the September 10,
2019, Special Magistrate Hearing.
Code Officer Sterling requested the following Cases be withdrawn from the agenda, as they have come into

Officer Sterling testified that we are just waiting on OUA to sign the proper paperwork. All other parties have signed,
and we are waiting to get the appropriate agreement that Attorney John Cook was to draft up for Julio and The City
to sign. As soon this is done and recorded, they will be incompliance.
Special Magistrate Azcona found Case No. 190506005 Children's Academies of A. To be in violation due to
Code Officer Fred Sterling's testimony. He requested we impose a fine to start 14 days after proper
notification if not incompliance, in the amount of $100.00 a day, to include a $25.00 Administrative Fee
Officer Sterling Testified that the tenants of Carole Rosenberg Case 190913008, currently have a total of 11 dogs on
the premises. They were sent a NOV on September 13, 2019 Returned signed by Carole Rosenberg. We also sent
the tenant a copy of the NOV with no response. Mrs. Rosenberg has been in complete contact with the City Code
Enforcement Officer and informed us that she had posted a three (3) day eviction notice.
Special Magistrate Azcona found Case No. 190913008 Carole Rosenberg to be in violation of Ch 10 Sce 10.3
due to Code Officer Sterling's Testimony and imposed a fine of $25.00 a day to start 14 days after proper
notification. With a onetime Administrative Fee of $25.00

Code Enforcement Officer Sterling testified that this case has been going on since July 2019. Officer sterling testified
that the yard had been mowed and is now in compliance. The issue is the bus that has been sitting in the yard disabled
with no tag. Officer Stealing turned the podium over to Mrs. Ashley Johnson. Mrs. Johnson stated that she takes care
of an elderly man that Owens the bus, and that he was in an accident. The bus was towed to a yard but was
accumulation fees that they could not afford. That's when she had it towed to her yard. She is in the process of fighting
with the insurance company to have it deemed a total loss. Until it is deemed a loss, she cannot move the property,
due to insurance reasons.
Special Magistrate Azcona found that Case No. 1900717023 Ashley Johnson 308 NW 12th Street to be
incompliance of Ch 30 Sec 30-44 in regard to her yard due to Code Office Sterling's Testimony. In regard to
the bus Special Magistrate Azcona found her to be in violation of CH 30 Sec 30-41 Disabled Vehicle, but
recommended that the case be deferred till the next scheduled Code Enforcement Meeting to give Mrs.
Johnson time to get InTouch with the insurance company and take care of this matter. Magistrate Azcona
Imposed no fine only a onetime fee of $25.00 for administrative fees.
Code Enforcement Officer Sterling testified that Case 190725009 Sheila & Fredrick Bradley have had plenty of notice
in regard to the violations of this property, A Statement of Violation and Notice of Hearing was hand delivered on
September 24, 2018 — signed by Fred Bradley JR. As of this time they have put a tag on the Motorhome, but it doesn't
meet the setbacks. Officer Sterling stated he has spoken to Mr, Bradley on numerous occasions and nothing has
been done. He is also a repeat violator.
Special Magistrate Azcona Found Case 190725009 Sheila & Fredrick Bradley 204 SW 11th Ave to be in
Violation of Ch 30 Sec 30.43, Ch 30 Sec 30-44 and Ch 90 Sec 90-30. Due to Code Enforcement Officer Sterling's
Testimony Azcona imposed a fine of $25.00 a day to start immediately after proper notification. A $25.00 -
dollar Administrative fee was also imposed.

Code Enforcement Officer Sterling testified that Case No. 190712004 David Daniel is in violation of general
cleaning, public nuisance and not proper signs on the front of the plaza. Code Officer Sterling stated the
gentleman at the Mattress Center is now managing the building and is in the process of cleaning the property
up and painting. He also stated that they are in the process of getting new lighted signs for the front of the
property. At this time no permits have been pulled for the signs and the property is still not in compliance.
Special Magistrate Azcona found Case No. 190712004 David Daniel 102 NE Park Street to be in violation
of CH 30 Sec 30-43 Public Nuisance, Ch 30 Sec 30-44 General Cleaning and Beautification, Ch 90 Sec
90-563 &90-562. Due to Code Officer Sterling's testimony. Magistrate Azcona imposed a fine of $25.00
a day starting 14 days after proper notification., to give them time to come in and apply for the proper
permitting needed. A $25.00 -dollar administrative fee has also been imposed.
Code Enforcement Office Sterling testified that Case No. 19075016 Edwin Gassaway 1005 SW 5th Ave, was
back up for review. Officer Sterling testified to being in contact with the mortgage company and that they have
cleaned up most of the property. He stated that the back yards grass is at least waist high and that he informed
them that this needed to be taken care of. Linda from the Mortgage company informed us that they are in the
process of renting a bush hog and will have the issue resolve by the end of the week.
Special Magistrate Azcona found Case 19075016 Edwin Gassaway 1005 SW 5th Ave to be in violation
of Ch 30 Sec 30-43 Public Nuisance and Ch 30 Sec 30.44 General Cleaning and Beautification, due to
Code Officer Sterling's Testimony. Magistrate Azcona imposed a fine of $25.00 dollars a day to start
14 days after proper notification. A $25.00 -dollar administrative fee was also imposed.
Code Enforcement Officer Sterling testified that Citation #0119 Sandra Galletto 202 NE 21d Ave has been
placing advertisement signs on the city right of way for a few months. He stated that he would remove the
signs and she would put new ones out. Officer Sterling stated that he spoke to Mrs. Galletto and informed her
of the code, but she continued to put them back. Officer Sterling turned the podium over to Mrs. Galletto. Mrs.
Galletto testified that they were in fact her businesses signs and that she had permission from the other
businesses to put the signs where they were. Officer Sterling tried to explain to Mrs. Galletto that they had to
be on her property not anyone else's. Special Magistrate Azcona asked Mrs. Galletto if she understood that
and she replied yes.
Special Magistrate Azcona found Citation #0119 Sandra Galletto 202 NE 2nd Ave to be in Violation of
Ch 90 Sec 90-561 Signs, due to Code Office Sterling's Testimony and Mrs. Galletos. Azcona stated that

at this time no fines will be imposed, but Mrs. Galletto had 3 business days to remove all adverting
signs in the city. A $25.00 -dollar administrative fee was imposed.

duly sworn in prior to presenting evidence.

Pursuant to Florida Statutes 162.02 and 162.12, Florida Statutes, and the Code of Ordinances of City of
Okeechobee, I (hereinafter the "City of Okeechobee), the undersigned Code Enforcement Officer hereby gives
notice of an uncorrected violation of the City of Okeechobee Code, as more particularly described herein, and
hereby requests a Hearing before the Okeechobee City Code Enforcement Special Magistrate.

Inspector to verify compliance, with the Okeechobee City Code Section(s) cited herein, you are hereby called upon to take
notice that a Hearing will be held in this cause before the City of Okeechobee Code Enforcement Magistrate on the 10th
day aeptemper at 6:30 P.M., located at 55 SE 3rd Ave Okeechobee City Hall, Okeechobee Florida 34974 in Council
Chambers. The Magistrate will receive testimony and evidence at said Hearing and shall make findings of fact and
conclusions of law as are supported by the evidence and testimony, and shall make an order thereupon. You are entitled to be
represented by counsel, present evidence, and present testimony. Please be advised that any evidence presented to the
Magistrate for his consideration will be retained by Code Compliance Department. If you fail to appear at the hearing the
Magistrate may enter an Order of Violation, & impose a fine in your absence.

We have sent this person two letters to come into compliance, the last one being a year ago
with no response. Look into it and see if we can get it on the May agenda with the magistrate. I would
use section 46-1, blocking a city alley or right of way with the playground equipment.

Re: Street Use License Agreement Expiration
Dear Mr. Oliveros:
While conducting audits on our filing system, it has come to our attention that the previous
property owners of Lots 11 and 12 of Block 35, and Lot 7 and North -half of Lot 8 of Block 40,
First Addition to South Okeechobee, agreed to a Street Use License Agreement to use a portion
of Southwest le Street. A copy is enclosed.
The license is no longer binding as it can only be transferred by written permission from the City.
The City has observed that you are continuing the use of the portion of Southwest 19th Street in
the same manner. Additionally, you have a fence encroaching within the North/South alleyway
located in Block 35.
We would like to extend to you the same opportunity to agree to a Street/Alley Use License
Agreement. In order to do so, kindly forward to me a survey showing exactly what areas you
would like to have permission to use in order for Attorney Cook to draft a new agreement.

you in a letter, dated June 1st, 2017 that the Street Use License Agreement to use the portion of SW 19th
Street was no longer binding and that the fence on the East side of the property was encroaching the
alley.
In the last six months, no action on your part has been taken to secure legal use of either of these areas.
Given the total lack of response, The City has determined that the following actions be taken:
1. All fences, playground equipment, and any other structures or obstructions located within the
alley located on the East side of the property must be removed within seven (7) days. The fence
in the alley is obstructing the legitimate use of the alley by neighboring properties. Failure to
remove the fence and other obstructions within the allotted time will result in removal of the
obstructions by the City Public Works Department.
2. All fences, playground equipment, and any other structures or obstructions located within the
Right of Way of SW 19th Street must be removed within thirty (30) days or you must complete a
valid Street/Alley Use License Agreement with the City. Failure to remove the objects or obtain
the required agreement will result in removal of the obstructions by the City Public Works
Department. Please contact the City Clerk's office if you wish to complete a Street/Alley Use
License Agreement with the City.
A map of the two areas is attached for your reference.

1. My name is Fred Sterling certified code inspector for the City of Okeechobee and I've been
duly sworn in prior to presenting evidence.
2. Respondents(s) Edwin Gassaway is/are () present or ( ) not present. The
property is occupied by (x) owner(s), () tenant or ( ) vacant.
3. This case concerns property located in the municipal boundaries of the City of Okeechobee
at 1005 SW 5th Ave . According to Official Records of the Okeechobee County
Property Appraiser the owner(s) of record is/are Edwin Gassaway
City exhibit no. 1
4. On July 25, 2019 , I personally inspected the property and observed the following:
a. Overgrown Vegetation

5. Based upon my investigation, this case was brought Infront of the Special Magistrate on
August 13th, The Magistrate gave them 30 days to bring property into compliance, as of
August 21, 2019 the property was still not incompliance. This property was brought back
Infront of the Special Magistrate again on September 10, 2019. At this time, I had contact
with the bank that has the property, they stated they would get the property up to
compliance. I checked the property on 09/09/2019 and was still not incompliance. The
Special Magistrate found them in violation and asked to review the property at the next
scheduled Magistrate Hearing
6. On August 23, 2019 I reinspected the property and found it still in violation.
A Notice of Violation/Notice of Hearing was issued on September 18, 2019/Spoke to
Mortgage Company and informed them of the October 8, 2019 Magistrate Review and
delivered by:

proposed utility pole, guy wire or pad -mounted
transformer.

DIVISION 5. SIGNS*
Sec. 90-561. Purpose and intent.
It is widely recognized that the City of
Okeechobee is a predominantly rural community,
with reputation as an area comprised of agricul-
tural uses, along with residential and light com-
mercial activities. The city has traditionally per-
mitted advertisement within the city, appropriate
to the use or purpose, while attempting to pre-
serve and maintain the natural look and charac-
ter of the city as a quiet and visitor -friendly
community for those wishing to enjoy the atmo-
sphere of a small town.
The city council recognizes that there are var-
ious persons and entities that have an interest in

enacted a new Art. IV, Div. 5 as set out herein. The former Art.

§ 90-563
communicating with the public through the use of
signs that serve to identify businesses and ser-
vices, residences and neighborhoods, and also to
provide for expression of opinion. The council is
also responsible for furthering the city's obliga-
tion to its residents and visitors to maintain a
safe and aesthetically pleasing environment where
signs do not create excessive visual clutter and
distraction or hazards for pedestrian and vehi-
cles; where signs do not adversely impact the
predominantly residential character of the city,
and where signs do not conflict with the natural
and scenic qualities of the city It is the intent of
the city council that the regulations contained in
this article shall provide uniform sign criteria,
which regulate the size, height, number and place-
ment of signs in a manner that is compatible to
the residential scale and character of the city, and
which shall place the fewest possible restrictions
on personal liberties, property rights, free com-
merce, and the free exercise of constitutional
rights, while achieving the city's goal of creating a
safe, healthy, attractive and aesthetically pleas-
ing environment that does not contain excessive
clutter or visual distraction from rights-of-way
and adjacent properties; the surrounding natural
rural environment and residential neighbor-
hoods.

Sec. 90-562. Compliance with division pro-
visions.
Except as provided or otherwise prohibited in
this division, every sign erected on land, attached
to a building, wall, fence, pole, tree, . or surface,
that is constructed, moved, replaced or substan-
tially altered, shall comply with the regulations of
this division. Routine maintenance, repainting or
permissible changing of copy or content shall not
be considered a substantial alteration.

Sec. 90-563. Permit and plan required.
(a) Except as otherwise provided in this divi-
sion, no sign shall be erected, operated, used,
maintained, enlarged, illuminated or substan-
tially altered until a permit has been issued.
