Magistrate Azcona found the property to be in violation atthistimeand has ordered thecaseto come before the nextscheduled Magistrate hearing for review. Officer Sterling Testified thatthe Noticeof Violation/Noticeof Hearing was had delivered; and signed forbyOmar Ouf on August 27, 2019. Notice of Violation and Notice of Hearing were signed by Michael Lecrenier and returned to us on August28, 2019. Special Magistrate Azcona found that case 190624011 Michael Lecrenier 809 SE 1 OthStreetto be in violation of Ch 30 Sec 30-43 Public Nuisance and Ch 30 Sec 30-44 General Cleaning and Beautification. Magistrate Azcona imposed a fine of $50.00 a day starting 14 days after proper notification. Magistrate Azcona also added a $25.00 administrative fee. Code Enforcement Officer Sterling testified that Case 190712013 Earl Clay 905 SW Park Street is a vacant lotthat has grassthatisgrown up about2 inches high. Case No. 190626010 Leon Edouard 903 SE 8th Avenue Ch 30 Sec 30-43 Public Nuisance Ch 108 Sec 10811, 108.1.3, 108.1.5 Unsafe Structure, Structure Unfit for Human Occupancy and Unsafe Equipment Case No. 19015005 Elizabeth Hare, 1115 NW 4th Street IPMC 108.1.3: Unfit for Human Occupancy 108.1.5: Dangerous Structure 304.1.1: Unsafe Conditions Officer Sterling deferred the explanation of Case No. 190626010 over to City Building Official Jeffery Newell, The City Building Official stated that this case was brought to his attention from the City Code Enforcement, and that the neighbors had called and advised that the property to be a threat if a storm comes through, I was requested to advise the Code Enforcement of my findings. Jeffery Newell showed the evidence in the exhibit that the Code Enforcement had prepared. Mr. Newell stated that what we are looking for is the property owner to bring the structure up to code within 60 days, or if unable to do so have a reasonable explanation. Code Officer Sterling also stated that this property/owner is a repeat violator. Magistrate Azcona asked if after 60 days a fine of 50.00 would be enough? City Attorney Cook stated that perhaps a fine bigger would get the property owners to do something faster, Code Officer Sterling recommended a fine on 50.00 a day for 60 days after commencing proper notification, and then after that if nothing has been done, make the fine 100.00 a day. Special Magistrate Azcona found Case No. 190626010 Leon Edouard 903 SE 8th Ave. to be in violation of Ch.30 Sec. 30-43 Public Nuisance, Ch. 108 Sec 108.1.1, 18.1.3 & 108.1.5 (Unsafe Structure, Unfit for Human Occupancy and Unsafe Structure and Equipment) also FI. Building Code 202. Due to the evidence and testimony of the City Building Official, and the City Code Enforcement Officer. Magistrate Azcona ordered property owner Leon Edouard be fined $50.00 a day for 60 days after proper notification and after the 60 days if nothing has been done fine goes to $100.00 a day. Plus a onetime fee of $25.00 for administrative fees Officer Sterling Testified Notice of Violation/Notice of Hearing was sent via certified mail and received by the property owner. Officer Sterling stated that he spoke with the County Fire Marshall regarding doing a train burn. The County Fire Marshall told him other structures were too close to be done safely. Officer Sterling also stated that Mrs. Hare has been given plenty of time Special Magistrate Azcona found case 19015005 in violation of IPMC 108 Sec 108.1.3 Unfit for Human Occupancy, 108.1.5 Dangerous Structure And 304.1.1 Unsafe Conditions. Due to the testimony and evidence provide by Code Enforcement Officer Sterling, Magistrate for Elizabeth Hare to be in violation and imposed a fine of $25.00 a day 14 days after proper notification. Case No. 190411010 Kemp Properties of Okeechobee: 909 S Parrott Ave Ch 30 Se 30-43 Public Nuisance Ch 30 Sec 30-44 General Cleaning and Beautification Case No. 190227015 Wendi Snow. 801 SE 6th Court Ch 30 Sec 30-43 Public Nuisance Ch 30 Sec 30-44 General Cleaning and Beautification Case No. 190416004 Perry Arnold. 620 NE 4th Ave. Ch 30 Sec 30-43 Public Nuisance Ch30 Sec 30-44 General Cleaning and Beautification Officer Sterling Testified that the property was inspected in March 2019. Found property to have Overgrown Vegetation, Mold on the Building and General Maintenance need to be done. Office Sterling also noted the Statement of Hearing and Notice of Violation was sent out on July 10, 2019. Returned signed by Lacy McAdams. On 0810712019 Ruby called stating that they would be starting to do clean up on the property as of 0811312019. Special Magistrate Azcona found that case 190411010 to be in violation of Ch 30 Sec 30-43 Public Nuisance and Ch 30 Sec 30-44 General Cleaning and Beautification, due to the testimony and evidence brought forth from Code Officer Sterling. Special Magistrate Azcona Imposed a fine to start 30 days after proper notification of $50.00 a day, and a onetime fee of $25.00 for administrative fees. Code Enforcement Officer Sterling testified that Case 190227015 Wendi Snow was inspected on February 26, 2019. He stated that the property needed to be mowed and trimmed, also that all debris to be removed from the property. He also stated that a Notice of Violation and Notice of Hearing was sent out July 10, 2019 by certified mail. Mrs. Wendi Snow signed for the certified mail. Officer Sterling also went on to stated that this property owner and the property are repeat violators. Sterling also went on to stated that the place is a disaster, The weeds are about 3 — 4" high and that this is the 4th or 5t" time in violation. Special Magistrate Azcona Found Case 190227015 Wendi Snow, 801 SE 6th Court to be in violation of Ch 30 Sec 30-43 Public Nuisance and Ch 30 Sec 30-44 General Cleaning and Beautification. He also found that Mrs. Snow be a repeat violator due to Mr. Sterling's Testimony and Evidence presented. Magistrate Azcona ordered property owner Wendi Snow to be fined $50.00 a day after proper notification and a onetime fee of $25.00 for administrative fees. Code Enforcement Officer Sterling testified that Case 190416004 Perry Arnold was inspected on April 17, 2019 He stated that the property is up for sale and that the yard is overgrown and there is debris that needs to be removed. The Notice of Violation and Notice of Hearing was sent out certified mail and returned signed by Perry Arnold. Special Magistrate Azcona Found Case 190416004 Perry Arnold, 620 NE 4th Ave. to be in violation of Ch 30 Sec 30.43 Public Nuisance and Ch 30 Sec 30.44 General Cleaning and Beautification, due to Stelling's testimony and evidence. Magistrate Azcona ordered property owner Perry Arnold to be fined $25.00 a day after proper notification and a onetime fee of $25.00 for administrative fees. DRAFT AGENDA VI. He stated that the property needed to be mowed and have all debris removed. He also stated that the notice of Violation and Notice of Hearing was mailed out on July 8, 2019. This was returned singed by Andrew Deese on July 12, 2019. Special Magistrate Azcona found Case No. 190416003, Melissa Deese, 1612 NW 7th Ave to be in violation of Ch 30 Sec 30-43 Public Nuisance and Ch 30 Sec 30-44 General Cleaning and Beautification to be in Violation due to Code Enforcement Officer Sterling's Testimony and evidence presented. Magistrate Azcona imposed and fine of $25.00 a day starting after proper notification, and a onetime fee of $25.00 for administrative fees. Code Enforcement Office Sterling testified that on May 25, 2019., tenants that also occupy this build have been complaining in regard to the AIC drain draining on the public sidewalk. He also stated that this is an eye soar due to the mildew and it is a danger for someone to slip and fall. Officer Sterling also stated that the Notice of Violation and Notice of Hearing were sent out certified mail on July 10, 2019. This was returned on July 15, 2019 signed by Devin Maxwell. Special Magistrate Azcona found Case 190625006 Downtown Okeechobee LLC, 300 BLK SW Park Street to be in violation of Ch 30 Sec 30-43 Public Nuisance and Ch 30 Sec 30-44 General Cleaning and Beautification. Due to Officer Sterling's testimony and evidence presented. Magistrate Azcona imposed a fine of $50.00 per day after proper notification and a onetime fee of $25.00 for administrative fees. Code Enforcement Officer Sterling testified that on March 26, 2019, neighbors called complaining about Mr. Summerfords fence. Officer Stealing stated he check to see if Mr. Summerford had applied for a permit. At this time no permit has been applied for. Attorney John Cook stated that we should keep in mind if Summerford comes into compliance, he will still have a fine with the City Building Department. Officer Sterling stated that on July 8, 2019 a Notice of Violation and Notice of Hearing was sent out by certified mail and returned unsigned. The property was posted on August 1, 2019.
