THIS CAUSE came before the Code Enforcement Board, City of Okeechobee, for public
hearing on August 13 , 20 19 . After due notice to the respondent, the Board having heard
evidence on the alleged violation by witnesses or affidavit makes the following findings:
A. FINDINGS OF FACT:

Property has been found to have: Dangerous Structure, Unsafe Conditions and
Unfit for Human Occupancy
B. CONCLUSIONS OF LAW:
The owner of the property described above has been found in violation
of: IPMC Sec 108.1.3,108.1.5 & 304.1.1
C. ORDER: The City of Okeechobee Code Enforcement Special Magistrate has
determined you have violated the Code of Ordinances, IPMC Sec 108.1.3,108.1.5 &304.1.1
concerning your property located at 1115 NW 4th Street , Okeechobee, FL .
If you do not correct the violation within 14 days after proper notification , or notify the
Code Enforcement Officer of the correction, the Magistrate imposes a fine of $ 25.00 per
day, Also a onetime fee of 25.00 for administrative fees, commencing that date and continuing
daily until the violation is corrected or the city is notified by you and verifies the correction,
which ever first occurs. Further, if you do not correct the violation by said date, a copy of this
order as a claim of lien, shall be recorded in the office of the Clerk of Circuit Court, Okeechobee
County, Florida, and once recorded, becomes a lien
on real and personal property pursuant to Florida Statute 162. You have a right within thirty
days, to appeal this finding and order by Writ of Certiorari to the Circuit Court, Okeechobee
County, Florida. If you correct the violation prior to the above date, it is your obligation to
contact the Code Enforcement Officer to verify such compliance.

1. My name is Fred Sterling certified code inspector for the City of Okeechobee and I've been
duly sworn in prior to presenting evidence.
2. Respondents(s) Elizabeth Hare is/are () present or 9( not
present. The property is occupied by (x) owner(s), () tenant or (x) vacant.
3. This case concerns property located in the municipal boundaries of the City of Okeechobee
at 1115 NW 4th Street . According to Official Records of the Okeechobee County
Property Appraiser the owner(s) of record is/are Elizabeth & Rodger Hare
. City exhibit no. 1
4. On March 15, 2019 , I personally inspected the property and observed the following:
A. Unfit for Human Occupancy
B. Dangerous Structure
C. Unsafe Conditions
D. Damaged Building
5. Based upon my investigation, I issued a courtesy card/letter to Respondent(s) notifying them
of the violation with a request to have the property come into compliance within 10 days.
6. On June 26, 2019 I re- inspected the property and found it
still in violation.
A Notice of Violation/Notice of Hearing was issued on July 10, 2019
and delivered by:
(x) Certified mail.
( ) Personal hand delivery.
( ) Posting Notice of Violation/Notice of Hearing on the subject property.

7. Notice of Violation/Notice of Hearing gave Respondent(s) 14 days to correct
the following violations:
a. Ch Sec 108.1.3 for violation of: Unfit for Human Occupancy
b. Ch Sec 108.1.5 for violation of Dangerous Structure
c. Ch Sec 304.1.1 for violation of Unsafe Conditions
d. Ch Sec IPMC for violation of Damaged Building
8. Prior to the hearing, a final inspection of the property was done and I determined:

I am writing you today in regard the case and property listed above. As you were aware the
property was found in violation of International Property Maintenance Code Section 108.1.13,
102.1.5 & 304. 1.1 at the August 13, 2019 Special Magistrate Hearing. You were imposed a fine
of $25.00 dollars a day to start 14 days after proper notification, with an Administrative fee of
$25.00. The fine ran from September 10, 2019 until you came into compliance on September
18, 2019. The total amount due including the Administrative fee is $475.00. I would like to get
this issue resolved before any further action is taken. Please send a check/money order to the
above address wrote out to the City of Okeechobee and reference Case # 190315005. Once I
receive this, I will get a satisfaction of lien recorded at the courthouse and send you a copy. If

STATEMENT OF VIOLATION AND NOTICE OF HEARING
Pursuant to Florida Statutes 162.02 and 162.12, Florida Statutes, and the Code of Ordinances of City of
Okeechobee, I (hereinafter the "City of Okeechobee), the undersigned Code Enforcement Officer hereby gives
notice of an uncorrected violation of the City of Okeechobee Code, as more particularly described herein, and
hereby requests a Hearing before the Okeechobee City Code Enforcement Special Magistrate.

Marcos, The lien was for Unsafe Structure, Unfit for Human Occupancy and Unsafe Conditions. Mrs. Hare tried to get a
controlled burn, but the fire department said structures were to close. She received all notification certified mailed
return receipt and all was all signed and returned to us. I just spoke to her and the fine ran for only 8 days, with all the
confusion I told her we would do a Lien Satisfaction. She only owes 225.00, Fred had me put them into compliance for
vegetation clean up, and that was not even the violation. I told her as soon as this COVID 19 is over I would get a
satisfaction filed at the court house.
