I Pa Board of Adiustment- December 16,2003 ACTION - DISCUSSION - VOTE I Faye Haverlock, the applicant, submitted a letter to the Board requesting that the petition be tabled to the January 27,2004 meeting. This item was tabled at the October 28,2003 meeting per thr request of the Board. It was then tabled at the November 20,2003 meeting per the request of the applicant. It will be discussed at the January 27,2003 meeting. There was no discussion on this item at this time is the last time that the Petition could was informed that this Attorney Cook advised the applicant be tabled without re-applying. Robert and Betty Braun, property owners, plan to operate a funeral and crematorium. The purpose for the Special Exception request is to have a crematorium in a Heavy Commercial zoning district. ~- , - \\) I the Board, and no public comments. Consider Petition 03-006-SE: Southern Plantation of Okeechobee, Inc is the property owner and applicant. Faye Haverlock is the representative. The purpose for the request of a special exception is to allow for an assisted living facility within a Residential Single Family (RSF) zoning district. The property is located at 309 S. W. 15th Street - Exhibit 1. A. I Jim LaRue, City Planning Consultant, addressed the Board by reviewing the Staff Report. Staff is recommending approval and that the crematorium abide by all applicable state agency requirements and no outside activities Consider Petition 03-007-SE: Robert and Betty Braun are the property owners and applicants, Vikki Aaron is the representative. The purpose for the request of a special exception is to allow for a crematorium within a Heavy Commercial (CHV) zoning district. The property is located at 205 N.E. 2nd Street - Exhibit 2. B. I There was no discussion from I IL. Pa Board of Adiustment- December 16, 2003 ACTION· DISCUSSION - VOTE I First Baptist Church ofOkeechobee, property owners, are applying for a Special Exception to allow a house of worship on a lot less than five acres. The main church building is located one block South of this property. Several other church buildings and the recreational center is also located around this area. The church is requesting a Special Exception to allow a mission house and storage facility. The current building is small and they have outgrown it, so they are looking at this site to build the new proposed 7,000 square foot building. Jim LaRue, City Planning Consultant, addressed the Board by reviewing the Staff Report. The Special Exception use is consistent with the church facility, Mr. LaRue is recommending approval Lock and s Board Member Ledferd stated for the record that he spoke with the owner of Norm Safe, and he is against the Special Exception application. , Carolyn Arnold, representative of Lakeview Builders, addressed the Board by reviewing the applicants plan. The church is proposing to construct a 7,000 square foot storage building and mission house. Pastor Randy Huckabee explained that the church does have an existing mission house, however the church has outgrown the current facility. The new building will be for storage of props and large items for different functions that the church puts on throughout the year, as well as a mission facility to distribute uncooked food, clothing, household items to the community. City Administrator questioned if the new facility would create any traffic problems, or an increased amount of pedestrians crossing the street, causing traffic hazards. Pastor Huckabee stated that there were no anticipated traffic problems or pedestrian issues Surrounding property owner Leland Dyals stated that he had no problems with the application. The purpose of the Special Exception is to allow for a house of worship on a lot less than 5 acres (customary accessory use) within a Residential Multiple Family (RMF) zoning district. Board Member Okeechobee, Inc I Pa~e 4 of5 Board of Adjustment - December 16, 2003 DISCUSSION - VOTE ACTION AGENDA I Jim LaRue, City Planning Consultant, addressed the Board by explaining that the original request was to reduce both the rear and South side setbacks to zero. Pastor Randy Huckabee explained to Mr. LaRue before the meeting that they wanted to change the request from zero setbacks on both the rear and South side setbacks, to thirteen feet fÌom the building to the property line (rear), and to three feet from the building to the alley (South side). Mr. LaRue also explained that the applicants need to prove that there is a hardship, before granting a variance. IV. NEW BUSINESS CONTINUED. He also explained the plan of the surrounding blocks. He stated that there was a hardship in this case, and it was if the church reduces the size of the building to meet the required setbacks, it would not be worth developing. He also mentioned that he was working on a use of alley agreement with Clerk Gamiotea. If Leland Dyals, stated for the record, that he does not want the status of the alley to be changed. the approval is based on changing the alley, he does not agree with the application.
