AN EMERGENCY ORDINANCE ENACTED BY THE CITY COUNCIL OF THE CITY OF
OKEECHOBEE, FLORIDA, DESIGNATING THE CHIEF OF POLICE AS THE EMERGENCY
MANAGEMENT OFFICIAL FOR THE CITY OF OKEECHOBEE; PROVIDING FOR THE CHIEF OF
POLICE TO DECLARE A 72-HOUR STATE OF EMERGENCY WITHIN THE CITY OF
OKEECHOBEE DUE TO THE PREDICTED PATH OF HURRICANE DORIAN; PROVIDING FOR
ACCEPTING THE RECOMMENDATION BY THE CHIEF OF POLICE TO EXTEND THE 72-HOUR
DECLARATION; PROVIDING FOR DECLARATION TO CONTINUE FOR AN INDEFINITE PERIOD
OF TIME AS DEEMED APPROPRIATE BY THE CHIEF OF POLICE; PROVIDING FOR
AUTOMATIC EMERGENCY MEASURES; PROVIDING FOR DISCRETIONARY EMERGENCY
MEASURES; PROVIDING FOR FILING DECLARATIONS AND MEASURES IN THE OFFICE OF
THE CITY CLERK AND PUBLICATION TO NEWS MEDIA; PROVIDING FOR VIOLATIONS;
PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Okeechobee, Florida, a municipality under the laws of the State of Florida, is empowered by
Florida Statute 870.043 to declare the existence of an emergency within the City when in the opinion of the
Chief of Police,the person designated by Florida Statute 870.042 as the Emergency Management Official for
the City of Okeechobee;that a situation exists that potentially constitutes an imminent threat to public safety,
peace or order, and threat to public and private property or persons; and
WHEREAS, the City of Okeechobee is predicted to be included in a hurricane warning issued by the State of Florida
Emergency Management Services and the National Weather Center,which designation declares that the City
of Okeechobee could experience hurricane force winds within 24-hours of such designation; and
WHEREAS, the hurricane warning issued by virtue of Hurricane Dorian, is predicted to be a category 4 storm with
sustained winds in excess of 130 miles per hour; and is forecasted to pass over or very near to the City of
Okeechobee on approximately Monday,September 2,2019. Such storm is capable of inflicting serious loss
of property and or lives; and
WHEREAS,the track of the storm is uncertain, but due to its present forward motion, is expected to cause sustained
winds, rain and potential for damage for a time period in excess of that 72-hour period permitted to be
imposed by the Chief of Police; and
WHEREAS, the City Council is permitted to adopt ordinances on an emergency basis with one reading, by virtue of
Florida Statute 166.041(3)(b), and has taken all reasonable steps to advertise to the general public that an
Emergency Public Hearing will be held at 1:00 p.m. on Friday, August 30, 2019.
THEREFORE, in order to preserve the peace and order within the City;to monitor and prevent civil unrest, looting or
other unlawful conduct; to permit repair of utility and municipal services, clean up and restoration of basic
services; and to assist in the protection of life and property, the City Council, by a minimum of a two-thirds
vote, adopts the following emergency Ordinance to be effective throughout the municipal boundaries:
1. THAT the Chief of Police is hereby designated the Emergency Management Official for the City of
Okeechobee under Florida Statute 870.042, possessing the authority to enact a state of emergency
within the municipal boundaries of the City, or parts thereof.
2. THAT the state of emergency shall commence immediately upon the declaration by the Chief of
Police and shall terminate at the end of a period of 72 consecutive hours thereafter unless, prior to
the end of such 72-hour period, the state of emergency is terminated by the Chief of Police,
Governor of the State of Florida, or City Council as provided in Florida Statute 870.047.
3. THAT at the request and recommendation of the Chief of Police,the City Council hereby authorizes
the extension of the state of emergency for a time period in excess of 72-hours if deemed necessary
by the Chief of Police, and to continue for such time period until terminated by the Chief of Police,
Governor of the State of Florida, or City Council.
4. THAT pursuant to Florida Statute 870.044, for the duration of any declared state of emergency or
extension thereof, and effective immediately upon the declaration, the following acts shall be
prohibited:

a. The sale of,or offer to sell,with or without consideration, any ammunition or gun or other firearm
of any size or description.
b. The intentional display, by or in any store or shop, of any ammunition or gun or other firearm of
any size or description.
c. The intentional possession in a public place of a firearm by any person,except a duly authorized
law enforcement official or person in military service acting in the official performance of their
duty.
5. THAT pursuant to Florida Statute 870.045, the Chief of Police, in addition for the duration of the
declaration or extension thereof, may enact in his discretion as necessary,all or any of the following
additional emergency measures, in whole or in part,with such limitations and conditions as he may
deem appropriate:
a. The establishment of curfews, including but not limited to, the prohibiting of or restricting
pedestrian and vehicular movement, standing, and parking, except for the provisions of
designated essential services such as fire, police, and hospital services, including the
transportation of patients thereto, utility emergency repairs, and emergency calls by physicians.
b. Prohibiting the sale or distribution of any alcoholic beverage, with or without the payment or
consideration therefore.
c. Prohibiting the possession of any person in a public place of any portable container containing
any alcoholic beverage.
d. The closing of places of public assemblage with designated exceptions.
e. Prohibit the sale or other transfer of possession,with or without consideration,of gasoline or any
other flammable substance or combustible liquid altogether or except by delivery into a tank
properly affixed to an operable motor-driven vehicle, bike, scooter, boat, or airplane and
necessary for the propulsion thereof.
f. Prohibit of the possession in a public place of any portable container containing gasoline or any
other flammable or combustible liquid.
6. THAT pursuant to Florida Statute 870.048, it is declared that any violation of the declaration or of
any emergency measure established, shall be punished as a misdemeanor of the first degree,
punishable as provided in Florida Statutes 775.082 or 775.083,and enforced as deemed necessary
by the Chief of Police, or his designee or Officers.
7. THAT any state of emergency or emergency measure declared or ordered and promulgated by
virtue of the terms of Florida Statutes 870.041 through 870.045,the Chief of Police shall as promptly
as practicable file a copy in the Office of the City Clerk and deliver copies to appropriate news media
for public and radio and television broadcast thereof. If practicable, such state of emergency
declaration,emergency measure or extension there of shall be published by other means such as by
posting and loudspeakers.
8. THAT all ordinances or parts of ordinances in conflict herewith are hereby repealed.
9. THAT if any provision or portion of this ordinance is declared by any court of competent jurisdiction
to be void, unconstitutional, or unenforceable, then all remaining provisions and portions of this
ordinance shall remain in full force and effect.
10. THAT this Ordinance shall be effective immediately upon its adoption.

be provided to its employee. Employees will also list their name on the appropriate
Departmental Sheet and the City Barn Fuel log and number of gallons used.

Hoping you and your family are safely hunkered down!
We continue to closely watch Hurricane Dorian and the impact to the State of Florida. With the official
issuance of Hurricane and Tropical Storm warnings for our area and as of today, our Waste Management
of Okeechobee Hauling District is closed. Due to the storm's wavering travel speed and track our
decision to close today and Tuesday, our collection operations are not expected to be running until
Wednesday and possibly Thursday. We will continue to monitor the storm and work closely with you
and our disposal operations (Tony).
Please find the attached correspondence in accordance with our solid waste franchise agreement as
related to Hurricane Dorian and its projected impact.

Dear Marcos:
Due to the approach of Hurricane Dorian and the conditions and concerns that will result
from this powerful storm, this letter will serve as notice by Waste Management Inc. of
Florida ("Waste Management") that Waste Management will temporarily be unable to
perform services under the parties' collection contract while force majeure conditions
exist. Since Hurricane Dorian is predicted to be a major hurricane, we are providing this
notice in anticipation of the storm's effects, a force majeure event under the terms of our'
agreement and Florida law. The force majeure conditions include unsafe working
conditions (including sustained windspeeds of 30 MPH), potentially impassable/blocked
roads; power interruptions; shortages of fuel, materials, and/or labor, and/or other
circumstances resulting from this Hurricane which will hinder Waste Management's
ability to provide normal service. In addition, should the designated disposal facility to
which your waste is directed close due to the storm, collection service must also be
terminated.
Waste Management regrets this situation and intends to resume services following
cessation of circumstances hindering performance. We will contact you regarding the
provision of waste services or the continuation of the force majeure condition. Of
course, should the storm track change so that there are little or no impacts to our service
customers, employees and assets, we will provide service as long as conditions are safe
to do so. We would like to assist in whatever ways that we can during these difficult
times.

211 HelpLine Calls Double As People Prepare For Dorian
August 30, 2019- In less than a 12 hour period, 211 staff took nearly double the average phone calls (429
compared to 225 average in 24 hours) from people whom were feeling overwhelmed and frightened as the
prospect of Hurricane Dorian grows stronger. 211 staff want the community to know that they are available
24/7 to help with information & questions about shelters, sheltering requirements, and evacuation zones and
to note that Special Needs & Pet Friendly Shelters require a registration process.
211 staff have been calming and comforting callers, many whom are elderly and or isolated, feeling helpless
and/or alone. Anyone can call or text anytime- even if you just need to talk.
211 will also follow Emergency Operations & county leaders as the status of the storm is updated and any
evacuation orders are given. There are no organizations that we know of who are giving out hurricane
supplies.
Information on recovery programs and services such as D -SNAP (emergency food stamps) or FEMA will not
be known until after the storm.
Quick Tips:
It is important that families and individuals do as much as they can to prepare. It takes time for emergency
recovery teams to get in place- and for roadways to be made safe and accessible. Have food and water
supplies on hand for several days- to accommodate each member of your family, including your pets (keep
an eye on small children if you fill buckets and your bathtub.) Think about your medications... having cash on
hand. Use flashlights instead of candles to prevent fire hazard. Please think of your pets, do not leave them
behind...call to find out about pet friendly shelters, hotels...or find someone or somewhere to board your
animals.
Remember to keep generator exhaust outside and away from open windows or airways if utilizing. If you are
asked to evacuate and are planning to use a shelter- learn about items you will need to bring.

Since everyone the Gov declared emergency in Okeechobee County we could post notice on outside doors
advising 1st Trim Budget Hearing could be canceled and rescheduled by advertising.
Please see paragraph:
Based on past experience, the DOR's emergency order will provide guidance with regards to the
following: posting of notices to inform of cancelled hearings; provide a timeline and guidance to reschedule
and publish a notices to re -schedule a hearing. Thus, if a TRIM hearing has to be cancelled due to the
imminence of Hurricane Dorian, a taxing authority should post a notice at the entrance of the place the hearing
was scheduled to be held to inform the public the meeting has been cancelled. The taxing authority would then
reschedule and advertise notice of a rescheduled hearing. Taxing authorities should be cognizant of any
emergency order or guidance that may be issued."
We would need to ask Lane to post the notices on each door entrance if you decide to cancel.

Update: Here is the response from DOR I just received:
"Good morning,
Whenever a named storm is imminent, the following actions would occur:
* The governor will issue an executive order declaring a state of emergency and will list the
counties that would be impacted by the storm. Executive Order 19-189 has been issued. The
executive order suspends the effect of any statute, rule, or order to allow whatever mitigation,
response, or recovery action necessary to cope with the emergency.
* The Executive Director of the Department of Revenue (DOR) will soon issue an emergency
order implementing the provisions of the governor's executive order. The DOR's emergency
order will relax or temporarily suspend the requirements of section 200.065 pertaining to the
timeline for conducting TRIM hearings.
Based on past experience, the DOR's emergency order will provide guidance with regards to the
following: posting of notices to inform of cancelled hearings; provide a timeline and guidance to
reschedule and publish a notices to re -schedule a hearing. Thus, if a TRIM hearing has to be

Has anyone experienced having to reschedule the first public hearing on the budget due to a
storm, etc.? Our first public hearing is scheduled for Tuesday, September 3 and the County is
considering rescheduling it due to Hurricane Dorian; however, I don't see any guidance in the
TRIM manual indicating what to do. There is an example of an advertisement to publish if the
Property Appraiser publishes an incorrect public hearing date/time but that isn't the case. I'm
specifically looking for advice on what advertisement needs to be done to remain compliant with

TRIM. I did find a Notice of Continuation for a recessed tentative hearing but that means you
still have to start the hearing and have a quorum of the Board in order to recess it.

NOTICE IS HEREBY GIVEN that the City Council for the City of
Okeechobee will conduct an Emergency Public Hearing, on Friday,
August 30, 2019, 1:00 PM, or as soon thereafter as possible at City
Hall, 55 SE 3rd Ave, Rm 200, Okeechobee, Florida.
The purpose of the public hearing is to consider adopting proposed
Emergency Ordinance No. 1194 designating the Chief of Police as
the Emergency Management Official for the City which provides him
with the authority to enact a state of emergency within the municipal
boundaries due to the projected path of Hurricane Dorian. The public
is invited and encouraged to attend.
ANY PERSON DECIDING TO APPEAL any decision made by the
City Council with respect to any matter considered at this meeting
will need to ensure a verbatim record of the proceeding is made and
the record includes the testimony and evidence upon which the
appeal will be based. In accordance with the Americans with
Disabilities Act (ADA), any person with a disability as defined by the
ADA, that needs special accommodation to participate in this
proceeding, contact the City Clerk's Office no later than two business
