Code Officer Sterling gave testimony that Case #05-213 was now in compliance. Member Gamiotea moved to
remove Case #05-213 from the table; seconded by Member Montesi.

Code Officer Sterling informed the board he had been in contact with Mr. & Mrs. Nichols who are
responsible for the property since Ms. Thompson is deceased. W. Nichols told Mr. Sterling he should be able
to complete the cleaning of the property within ten days. Member Gamiotea moved to remove Case #05-205 from
the table; seconded by Member Montesi.

Code Officer Sterling testified the property had an old house which was unsafe. There was a lengthy discussion

among the board as to whether the nuisance could be abated immediately by the City or whether the owner needed
to be given time to board up the structure. Member Montesi moved to find Case# 05-233 in violation of Chp 30
Sec 30-43 and allow twenty days from date of notification to comply, after that a twenty-five dollar per day fine
would be imposed; seconded by Member Revels.

which record includes the testimony and evidence upon which the appeal is to be based.

Code Officer Sterling told the board that the property had been in violation from December 7, 2005 but was now
incompliance. Member Irby moved to find Case# 05-305 in violation of Chp 30 Sec 30-44 from December 7, 2005
until January 9, 2006 but has come into compliance as of January 10, 2006; seconded by Member Castorina.

Member Montesi discussed making an amendment to her motion on Case #05-233, Ethel Jackson, in order to give
the Code Officer more specific direction for bringing the property in compliance. However after further discussion
among the board it was decided an amendment would not be necessary, all that was needed was a consensus by the
board. Therefore it was the consensus of the board to direct the code officers to inform the property owner that the
building must be completely boarded up to prevent any access and that the yard and property should be cleaned.
Chairperson Worley requested the Code Office keep the board informed of any change in the status of cases
that have previously been fined by the code board.
There being no further items on the agenda Chairperson Worley adjourned the meeting at 8:15 p.m. The next
regular Code Board Meeting is scheduled for Tuesday, February 14, 2006.
