Neal, Sr. 1005 NW 8 h Avenue Ch 30 Sec 30-41 Disabled Vehicles Ch 30 Sec 30-44 General cleaning and beautification Ch 30 Sec 30-41 Disabled vehicles There were no request for the addition, deferral or withdrawal of items on today's agenda. Code Officer Sterling informed the board that the disabled vehicle had been removed from the property and was now in compliance. Member Irby moved to find Case # 05-035 was in violation of Sec 30-41 Disabled vehicles but based on the testimony of Code Officer Sterling has been found to be in compliance; seconded by Member Castorina. Worley - Yes Castorina - Yes Irby - Yes Sweda - Yes Revels - Yes Hancock - Yes Motion Carried Code Officer Sterling gave testimony that he had been in contact with the husband of the property owner and some mowing had been done however there is still a lot of work to be done before it can be found in compliance. Member Castorina moved to find Case # 05-089 was in violation of Sec 30-44 General cleaning and to allow fourteen (14) days after receipt of notification to be brought into compliance after that time a $25.00 per day fine would be imposed; seconded by Member Revels. Member Sweda moved to find Case # 05-092 in violation of Sec 30-41 Disabled vehicles and if vehicles are not removed within fifteen (15) days from receipt of notification a $10.00 per day fine would be imposed; seconded by Member Revels. There was some discussion among the board as to whether the owner had been properly notified since it was not his signature on the receipt. Member Sweda moved to find Case #05-093 in violation of Sec 30-41 Disabled vehicles but to table this case until the next regular meeting so that the Code Officer can be sure property owner was notified; seconded by Member Castorina. Worley - Yes Castorina - Yes Irby - Yes Sweda - Yes Revels - Yes Hancock -Yes Motion Carried Chairperson Worley reviewed cases that are currently under a fine. He informed the board that Case #04-026 and Case #04-025 had reached the mandatory ninety day waiting period. After some discussion Member Irby moved to recommend to City Council that they would begin foreclosure proceedings on Case #04-026; there was no second. Motion Failed. Member Sweda moved to find Case #04-026 has not been in compliance for approximately seven months and requested a letter be sent to inform the property owners of the possibility that further action will be taken at the next regular meeting to begin foreclosure proceedings if the property is not brought into compliance; seconded by Member Castorina. PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision made by the Code Enforcement Board with respect to any matter considered at this meeting, he/she may need to insure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based. Motion Failed. Member Revels moved to find Case #04-025 still not in compliance and a letter be sent to the property owners notifying them of the accrued amount of the fine and if property is not brought into compliance within thirty (30) days from receipt then a recommendation would be made to the City Council to begin foreclosure proceedings; seconded by Member Sweda. Worley - Yes Castorina - Yes Irby - No Sweda - Yes Revels - Yes Hancock - Yes Motion Carried Member Sweda expressed appreciation to Attorney Cook for his work in the case of Evelyn Dasher Estate. There being no further items on the agenda Chairperson Worley adjourned the meeting at 8:00 p.m. The next regular Code Board Meeting is scheduled for Tuesday, August 9, 2005.
