April 12, 2005 Code Enforcement Board meeting was called to order at 7:08 p.m. by Chairperson Worley.

There were no request for the addition, deferral or withdrawal of items on today's agenda.
Code Officer Byrd presented a letter to the Board members from Suzette Quarles requesting a ninety day extension
to bring her property into compliance. The letter stated that Ms. Quarles had been put on a two week waiting list
with Waste Management to get a dumpster. However when Code Officer Byrd checked with Waste Management
he was told Ms. Quarles was not on their waiting list. Code Officer Byrd gave testimony that nothing more
had been done to bring the property in compliance since the last meeting in March and that the property was not
in compliance at this time. There was some discussion among the Board as to whether Ms. Quarles should be
sent a new notice of violation since Case #03-045 had been found in compliance on March 6, 2004 when the
abandoned house was boarded up. Member Montesi moved to find Case #03-045 not in compliance for failure to
remove debris within the two week period which was stated in the training burn agreement and to allow two weeks
from receipt of notification to bring the property in compliance after that time a fine of $50.00 per day would
commence; seconded by Member Nelson.

Chairperson Worley recommended that Code Officer Byrd discuss Case #03-045 with Attorney Cook and
determine what action needs to be taken in this matter. Code Officer Smith commented that he felt a new notice
of violation should be sent to the property owner in order to clear up any confusion. After further discussion the
Board decided not to take any action at this time.
Code Officer Byrd testified that a notice of violation had been hand delivered a few months ago asking the property
owner to remove a mobile home that had been destroyed during a hurricane. At the time there had been a death
in her family and he had allowed the property owner extra time to come into compliance. However at the time
of this meeting nothing had been done. Member Montesi moved to table Case #04-173 until the next regularly
scheduled meeting; seconded by Member Castorina.

Member Gamiotea read the definition of a repeat violation from Florida Statutes 162.04 (5) in order to clear up
some questions that had been raised in reference to whether a property owner could be cited as a repeat violator.
Chairperson Worley informed the Board that Liz Weisser had declined reappointment for her next term. He thanked
her on behalf of the Code Board for her service and expressed the Board's appreciation for her participation as
a Code Board member.
Member Gamiotea made the Board aware that the Evelyn Dasher Estate Case #02-216 had been sold in an auction
at the Okeechobee County Courthouse on April 5, 2005 for a sum of $33,600. He said after talking with the clerks
office it was his understanding that once the delinquent property taxes were paid then government liens were next
to be paid.
