GRANT OF EASEMENT
STATE OF FLORIDA
COUNTY OF OKEECHOBEE
THIS INDENTURE, made and entered into this day of , 2019, by and
between, LOUIS D'ONOFRIO, 16356 Alexander Run, Jupiter, State of Florida,
("GRANTORS"), and the CITY OF OKEECHOBEE, FLORIDA, a municipal corporation
existing under the laws of Florida ("GRANTEE"):
WHEREAS, GRANTOR is seized in fee simple of a parcel of land, roadway, alley, or right-
of-way described as:
Lot 12 of Block E, WRIGHT'S THIRD ADDITION TO OKEECHOBEE, as
set forth in Plat Book 1, Page 9; Lot 1 of Block F, and Lot 1 of Block 4,
WRIGHT'S FIRST AND SECOND ADDITIONS TO OKEECHOBEE, as set
forth in Plat Book 1, Page 13, public records Okeechobee County,
Florida; and
WHEREAS, the City Council for the City of Okeechobee, Department of Public Works,
requires access to certain canals for maintenance, and the City, by enacting, at
GRANTOR'S request, Ordinance No. 1186 Abandonment of Right -of -Way Petition
No. 19 -002 -SC, which closes that portion of Southeast 4th Street lying South of said
Lot 12 and North of said Lots 1 of Blocks F and 4, an unimproved right-of-way
approximately 40 -feet by 373.5 -feet; and
WHEREAS, the City typically would retain an Easement within the right-of-way for access
to the canals for maintenance, but due to the location of Southeast 4th Street being
in the middle of GRANTOR'S parcels, both GRANTOR and GRANTEE agreed that
placing this Easement along the North 12 -feet of said Lot 12 would minimize impact
to GRANTOR'S entire parcel.
NOW, THIS INDENTURE WITNESSETH:
That, in pursuance of these agreements and in consideration of the sum of Ten
dollars ($10.00), and other valuable consideration, receipt of which is hereby
acknowledged, GRANTOR grants unto GRANTEE, its assigns, successors in interest or
subsequent entities, and to all other likely situated as above described:
Full and free right and liberty for the GRANTEE and its authorized servants, agents,
employees, visitors, licensees, at all reasonable times hereafter, for all purposes connected
with the use and enjoyment of the land of the GRANTOR and those likely situated for
whatever purpose the land from time to time lawfully may be used and enjoyed, to cross
and re -cross, or otherwise travel upon and over certain lands owned by GRANTOR, and
the right further granted to said Easement described more particularly as follows:
THE North twelve feet (12') of Lot 12 of Block E, WRIGHT'S THIRD
ADDITION TO OKEECHOBEE, according to Plat Book 1, Page 9, public
records of Okeechobee County, Florida.

TO HAVE AND TO HOLD the Easement or right-of-way hereby granted unto
GRANTEE, its assigns or successors in interest and those likely situated as described
above, as appurtenant to the land of the GRANTEE and those likely situated and every
part of it.
