February 8, 2005 Code Enforcement Board meeting was called to order at 7:02 p.m. by Chairperson Worley.

There were no request for the addition, deferral or withdrawal of items on today's agenda.
Code Officer Byrd stated Case #04-025 was scheduled for a training burn on February 5, 2005 however due to
weather conditions the training burn had to be rescheduled for February 19, 2005.
Code Officer Byrd stated Case #03-045 was scheduled for a training burn on February 5, 2005 however due
to weather conditions the training burn had to be rescheduled for February 19, 2005.
Code Officer Byrd testified Case #05-010 was in violation of Chp 30 Sec 30-44 General cleaning due to some
large tree stumps that had been placed on a City right of way. Property owner Anita Nunez addressed the Code
Board stating it was her understanding that FEMA or City of Okeechobee would be removing debris caused by the
hurricanes. Code Officer Byrd informed the Board he had talked to Waste Management and the City Public Works
Department and neither of them would be able to remove the debris. Member Gamiotea suggested checking with
the mulching plant.. Chairperson Worley said the City Code Board had been allowing as much time as possible
for property owners to clean up storm damage but was now in the process of dealing with debris that has still not
been removed. He also stated that the responsibility of the Code Board is to be sure the Code of Ordinances is
being enforced. Tom Murphy spoke on behalf of David and Anita Nunez. He stated that the County
Commissioners had informed them if the debris was pulled out to the road it would be picked up. He suggested
that this was a problem the City should be aware of and find some way to resolve it. Ms. Nunez stated the City
had removed other debris along that same street. Chairperson Worley told the property owner that it would be up
to the City Council and not the Code Board to determine if the City would be responsible to remove storm debris.
Member Montesi moved to table Case #05-010 until the next regular meeting in order to allow the property
owners enough time to go before the City Council; seconded by Member Castorina.

Status Report from Code Officer Byrd
ADJOURNMENT - CHAIRPERSON WORLEY.
PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any
decision made by the Code Enforcement Board with respect to any matter considered at
this meeting, he/she may need to insure that a verbatim record of the proceeding is made,
which record includes the testimony and evidence upon which the appeal is to be based.
Tapes are for the sole purpose of backup for official records of the department.

CODE BOARD ACTION
Code Officer Byrd gave a report to the Code Board in reference to clean-up that was taking place along NE 9'
Street which will be used for access into the new industrial park. He also informed the Code Board about the
building which was formerly U & V Discount Beverage stating the owner plans to demolish the building and
clean-up the property.
There being no further items on the agenda Member Gamiotea moved to adjourn; seconded by Member Sweda .
Chairperson Worley adjourned the meeting at 7:30 p.m. The next regular Code Board Meeting is scheduled for
Tuesday, March 8, 2005.
