Code Officer Byrd stated that the new owners, National Pest Control, had agreed to clean up the debris that was

left from the training bum. Mr. Byrd said the property had come into compliance on 12/15/04. Member Irby
moved to find Case #04-037 in compliance as of 12/15/04; seconded by Member Sweda.

Code Officer Byrd gave testimony that Mr. Lawson had done a very thorough job cleaning his property. Code

Officer Byrd said the property had come into compliance on 11/22/04. Member Sweda moved to find Case #04-122
in compliance as of 11/22/04 and to rescind the $10.00 per day fine since the owner complied quickly; seconded
by Member Nelson.

Code Officer Byrd reported that Case #04-025 was not in compliance as of 1/11/05. Chief Smith testified there

was a safety issue involved in doing a training burn on this property. Code Officer Hancock also testified he had
talked to Ms. Brown and she stated she would clean the property during the holidays, but it was not cleaned well
enough for the structure to be checked for hazardous items which can not be burned. There was some discussion
among the board members. Member Sweda recommended sending a letter to the owner stating specifically what
needs to be done so that a training burn could be done. Code Officer Hancock said he had advised the owner on
the telephone, he felt due to her personal and financial hardship she would not be able to get the work done. The
board discussed trying to find some assistance from a church group or a community benevolent organization.

Code Officer Byrd stated Ms. Quarles had mailed the documents necessary to do a training burn on her property
and it was scheduled to be burned on 2/5/05. No further action was taken by the board on this case until the
training burn is completed.
Chairperson Worley stated some concern about various properties in the City that were apparently not being
maintained. Code Officer Byrd assured the board that many of these areas were already being worked on. Mr.
Worley asked the Code Officers to inspect some property on Hwy 441 N belonging to Mike Arnold.
Code Officer Byrd gave an update to the board in reference to property owned by Andrew Rubin. He said he had
talked to the daughter who is now the executor of the estate and she is currently in the process of getting someone
to maintain the property and make necessary repairs.
Attorney Cook was not present in order to give a status report.

which record includes the testimony and evidence upon which the appeal is to be based.
