Code Officer Byrd informed the Code Board that all necessary permits and fees had been completed by the property owner in order for the City Fire Department to schedule a training burn on October 30, 2004. Member Montesi moved to table Case #04-037 until the next regularly scheduled meeting; seconded by Member Nelson. Code Officer Byrd gave testimony that Mr. Lawson had been in contact with the Code Enforcement Office and asked for a five day extension to bring the property in compliance. Member Montesi moved to find Case #02-122 in violation of Sec 30-44 and give an extension until October 30, 2004 to come into compliance after that a fine of $10.00 per day would commence; seconded by Member Irby. Worley - Yes Irby - Yes Montesi - Yes Nelson - Yes Sweda - Yes Weisser - Yes Motion Carried Code Officer Byrd gave a report on Case #03-045 Suzette Quarles which is in the process of being scheduled for a training burn as soon as all permits and fees have been completed by the property owner. October 12, 2004 - CEB Regular Meeting - Page 3 of 4 422 AGENDA Status report from Attorney Cook 1 CODE BOARD ACTION Attorney Cook informed the Code Board that he had made a request to the City Council for a second count to be added to the lawsuit against Marvin Brantley which would abate the nuisance. Attorney Cook suggested the Code Board make a motion to declare Mr. Brantley's property a nuisance in accordance with Florida Statue 823.05 which would support the claim in the lawsuit to abate the nuisance. Member Irby moved to find property located in the Okeechobee City limits owned by Marvin Brantley specified as Parcel #00019, #00018, & #00022 to be declared a public nuisance in accordance with Florida Statute 823.05; seconded by Member Nelson. Worley - Yes Irby - Yes Montesi - Yes Nelson - Yes Sweda - Yes Weisser - Yes Motion Carried Attorney Cook gave a status report on the Evelyn Dasher property stating as of today the fines total twenty- eight thousand five hundred and fifty dollars ($28,550.00) and filing a civil suit for the amount of the fine would not accomplish anything as far as bringing the property into compliance. He advised the board that he felt the best course of action would be to recommend to the City Council that the property be condemned. Member Irby moved to recommend to the City Council that Case #02-216, Evelyn Dasher Estate be condemned based on a previous decision made by the Code Enforcement Board to declare the property a public nuisance; seconded by Member Montesi.
