Code Officer Hancock gave testimony that the property was in compliance as of June 29, 2004. Mr. Raleigh Parsons addressed the board stating due to illness and deaths in his family he was unable to take care of the property. However he has now been able to bring the property into compliance and assured the board it would be kept in compliance until he is able to sell it. Member Gamiotea moved to make a recommendation to City Council that the fine in Case #03- 096 be reduced from $2,200.00 to $110.50; seconded by Member Montesi. Code Officer Hancock stated the City Fire Department is scheduled to have a training burn on July 31, 2004 to remove the unsafe building on the property in Case #04-037. Member Montesi moved to table Case #04-037 until the next regularly scheduled meeting on August 10; seconded by Member Gamiotea. Member Montesi moved to find Case #04-016 in compliance as of June 14, 2004 and the fine stopped as of that date; seconded by Member Revels. Status report from Code Officer Hancock CODE BOARD ACTION Attorney Cook gave a status report in reference to Case # 02-216 Evelyn Dasher Estate. He stated the lawsuit was prepared and he just needed a check from Finance in order to file it. Chairperson Worley reviewed the status of cases currently under a fine. There was discussion among the board members in reference to Case #04-017, 04-018 and 04-019 as to whether action could be taken on them since they have reached the mandatory ninety -day waiting period. There was further discussion in reference to Case #04-020 which will reach the ninety -day waiting period on July 17, 2004. Attorney Cook advised the Code Board that a motion could be made to make a recommendation to the City Council on these cases without notification to Mr. Brantley. Based on that information Member Revels moved to make a recommendation to City Council to begin foreclosure proceedings on Cases #04-017, #04-018, and #04-019 in order to enforce the lien, also if Case #04-020 is not in compliance as of July 19, 2004 to recommend City Council begin foreclosure proceedings on this case as well; seconded by Member Castorina.
